SC collegiums recommends transfer of CJs of Orissa, J-K HCs

A separate statement has been issued with regard to the transfer of three other high court judges.&nbsp;

The Supreme Court Collegium headed by Chief Justice Uday Umesh Lalit has recommended to the Centre the transfer of Chief Justice (CJ) of Orissa High Court, Justice S Muralidhar and Chief Justice of Jammu and Kashmir High Court Justice Pankaj Mithal as CJs of Madras and Rajasthan high courts respectively.
The apex court collegium, which also comprised justices D Y Chandrachud and Sanjay Kishan Kaul, have come out with separate statements to this effect and also recommended names of three high court judges for being elevated as chief justices of Orissa, Karnataka and Jammu and Kashmir high courts.
The collegiums have recommended the name of Justice Jaswant Singh, Justice P B Varale and Ali Mohammad Magrey as as Chief Justices of Orissa, Karnataka and Jammu and Kashmir high courts respectively.

Orissa High court Chief Justice S Muralidhar made remarks on India's law system by saying that laws are structured in such a way that promotes discrimination against the poor and it works unequally for the poor and rich.Chief Justice S Muralidhar's remarks came on Thursday while addressing a lecture organised by Community for the Eradication of Discrimination in Education and Employment on “Appearing in Court: Challenges in Representing the Marginalised”.
He expressed his worry about the quality of legal aid, saying that those who get it do not really have choice. "The poor believe that if you get any service for free or it is substantially subsidised, then you cannot demand quality,” he said.
Commenting on the statistics, Muralidhar said 21% of the undertrial population of 3.72 lakh in India and 21% of the convict population of 1.13 lakh belong to the Scheduled Caste. Similarly, 37.1% of convicts and 34.3% of the undertrials belong to OBCs. The corresponding percentage for Muslims – 17.4% and 19.5%, respectively.
Adding to the statistics Muralidhar said, if lawyers from Dalit and Adivasi communities work on human rights matters, they run the risk of being labelled as Maoist/Naxalite lawyers.
