It has asserted that digital media "allows sensational content being re-circulated in a different context leading to misinterpretation by the audience", making it susceptible to being used as fake news.
"IT Rules seek to prevent the misuse of the freedom of press by empowering the audience with a mechanism to raise their grievances related to the content being published by the digital news publishers through a grievance redressal mechanism with an emphasis on the self-regulatory architecture for digital news publishers, and are therefore not only within the ambit of the Act, but also fulfill the object sought to be achieved by the (IT) Act," said the affidavit recently filed jointly by the Ministry Of Information and Broadcasting and Ministry Of Electronics and Information Technology.
"Before the notification of the Rules, digital news media was largely unregulated. It is submitted that before the notification of the Rules, no such mechanism was currently in operation with regard to news on digital media, thereby leading to a discriminatory imbalance within the news media ecosystem with respect to content on traditional media," it added.
The Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, which were notified in February, impose several obligation on online entities including an obligation to take down contentious content quicker, appoint grievance redressal officers and assist in investigations.
In its affidavit, the Centre has claimed that the regulation of media content in the electronic form, including news and current affairs content and online curated content, is well within the scope of the IT Act and the new rules do not provide any additional restrictions apart from what is already prohibited by existing statutes.
The Centre has argued that as opposed to the traditional media, the reach of digital media is "far wider as compared to traditional media" which "makes it a powerful tool for information campaigns by foreign state and non-state actors to influence public opinion in any nation".

The Delhi High Court Friday asked the Centre to reply to pleas by Facebook and WhatsApp challenging the new IT rules for social media intermediaries requiring the messaging app to &ldquo;trace&rdquo; chats and make provisions to identify the first originator of information.
The pleas have challenged the new rules on the grounds that they violate the right to privacy and are unconstitutional.
A bench of Chief Justice D N Patel and Justice Jyoti Singh issued notice asking the Centre, through the Ministry of Electronics and Information Technology, to file reply on the petition as well as the application for stay on the implementation of the Rules.
The court listed the matter for further hearing on October 22.
The counsel for the Centre said the main advocate was not available and sought an adjournment which was opposed by senior advocates Harish Salve and Mukul Rohatgi, appearing for WhatsApp and Facebook respectively.
The Facebook owned company, WhatsApp, in its plea said the requirement of intermediaries enabling the identification of the first originator of information in India upon government or court order puts end-to-end encryption and its benefits "at risk".
WhatsApp LLC has urged the high court to declare Rule 4(2) of the Intermediary Rules as unconstitutional, ultra vires to the IT Act and illegal and sought that no criminal liability be imposed on it for any alleged non-compliance with Rule 4(2) which requires enabling the identification of the first originator of information.
WhatsApp said the traceability provision is unconstitutional and against the fundamental right to privacy.

Facebook took down over 30 million posts across 10 violation categories during May 15-June 15 in the country. The social media giant has submitted its maiden monthly compliance report as mandated by the new IT rules.
Instagram took action against about two million posts across nine categories during the same period.
Facebook has said that it took action against content related to spam, violent and graphic content, adult nudity and sexual activity, and hate speech.
Under the new IT rules, big digital platforms with over 5 million users will have to publish periodic compliance reports every month, mentioning the details of complaints received and action taken thereon.
The report is to also include the number of specific communication links or parts of information that the intermediary has removed or disabled access to in pursuance of any proactive monitoring conducted by using automated tools.

"Today there are 100 crores users of Twitter in India. I am happy. Let them earn money. Allow users to criticize us. Most welcome. But when these profit-making companies start lecturing us on democracy...."
"I would like to ask a question- India is a democracy because it's elections are fair. We won Assam and lost Bengal recently. We have I dependent judiciary that keeps us asking questions like in case of Covid. We are following. Media asks tough questions from a senior minister. That's what freedom of speech and democracy is about. These issues are important. But under garb of these you think you won't comply then it's a misplaced argument."

Government sources told NDTV that the platform has lost its legal indemnity as it has yet not fully complied with all the rules that came into force on May 25.
Because of Twitter's non-compliance, its protection as an intermediary is gone. Twitter is, hence, liable for penal actions as per Indian law just as any other publisher is, NDTV reported quoting sources.

Twitter said, it was concerned&nbsp;with regards to the use of intimidation tactics by the police in response to enforcement of it's global Terms of Service, as well as with core elements of the new IT Rules.&nbsp;Twitter&nbsp;says that some elements represent a dangerous overreach that is inconsistent with open, democratic principles.
