The Supreme Court on Friday upheld the Delhi High Court order granting bail to three student activists who were jailed for a year for their alleged roled in Delhi riots case.
The Delhi Police had challenged the bail to Devangana Kalita, Natasha Narwal and Asif Iqbal Tanha. The trio will remain out on bail, the top court has said.
The Supreme Court, however, said that the High Court order could not be used as precedent for future cases. It agreed to examine the legal aspects of the Delhi High Court verdict, and said the case would be taken up next month.
The police had said that the High Court's findings are "perverse and contrary to record" and appeared to be based "more on the social media narrative.

A Delhi court on Thursday ordered the release of the three student activists who were languishing in jail for 2 days even after being granted bail by the Delhi High Court on Tuesday.
The three -- JNU scholars Devangana Kalita and Natasha Narwal, and Jamia studemt Asif Iqbal -- had spent 36 hours in jail even after the bail order as Delhi Police sought time to verify their permanent addressed before their release.
The activist moved Delhi High Court on Thursday morning seeking direction for their release. The HC asked the Trial Court to decide on the matter expeditiously after which the release order came.

Natasha was arrested on May 23 last year from her home, along with fellow Pinjra Tod activist Devangana Kalita, and booked under stringent UAPA for her alleged role in the Delhi riots. Her father was battling Covid-19 for almost a week. In the last one year, he made frequent trips during court hearings from Rohtak to Delhi in the hopes of seeing her free. He all along maintained that Natasha is "absolutely innocent" and supported her activism. Natasha now only has a younger brother, Akash, as sole surviving relative. He too is Covid positive. They lost their mother at a very young age.
