The United States government has urged the Supreme Court to dismiss "the petition for a writ of certiorari" filed by Mumbai-attack convict Tahawwur Rana, a Canadian national of Pakistani origin, against his extradition to India.
India is seeking the extradition of Rana as he is wanted in the Mumbai terror attack case. Having lost the legal battle in lower courts and several federal courts, including the US Court of Appeals for the North Circuit in San Francisco, Rana on November 13 filed a "petition for a writ of certiorari" before the US Supreme Court. In a long battle, this is Rana's last legal chance to not be extradited to India.
"The petition for a writ of certiorari should be denied," US Solicitor General Elizabeth B Prelogar said in its filing before the Supreme Court on December 16. Rana is not entitled to relief from extradition to India in this case, she argued in a 20-page submission.
In his "petition for a writ of certiorari to review the judgment of the United States Court of Appeals for the Ninth Circuit", Rana has argued that he was tried and acquitted in the federal court in the Northern District of Illinois (Chicago) on charges relating to the 2008 terrorist attack on Mumbai.
"India now seeks to extradite him for trial on charges based on the identical conduct at issue in the Chicago case," the plea has said.
Prelogar disagreed.
"The government does not concede that all of the conduct on which India seeks extradition was covered by the government's prosecution in this case. For example, India's forgery charges are based in part on conduct that was not charged in the United States: petitioner's use of false information in an application to formally open a branch office of the Immigration Law Centre submitted to the Reserve Bank of India," the US solicitor general said.
"It is not clear that the jury's verdict in this case -- which involves conspiracy charges and was somewhat difficult to parse -- means that he has been 'convicted or acquitted' on all of the specific conduct that India has charged," Prelogar said.&nbsp;

&nbsp;Moshe Holtzberg, who as a toddler survived the Mumbai terror attack in 2008, was invited to the inaugural ceremony of the newly elected Knesset (Israeli parliament) on Tuesday in a special gesture.
The 16-year-old recited a Chapter from the Book of Psalms (Tehillim) "for my brothers and friends" during the inauguration ceremony.
Next week will mark the 14th anniversary of the horrific terror attacks during which 166 people were killed by 10 Pakistan-based Lashkar-e-Taiba terrorists, who also targeted the Mumbai Chabad House.

The day is marked by several events across the country to pay respects to the victims of the attack in which six Jews were also killed at the Nariman House, popularly known as the Chabad House, by LeT terrorists.
Israeli leaders and officials have repeatedly called for the perpetrators of the horrendous crime to be "brought to justice".
Moshe was a two-year toddler at the time of the attack. His parents, Gabriel and Rivka Holtzberg, were killed in the attack, but he had a lucky escape when his nanny heard him crying and risked her own life to pull him out from the Chabad house.
The youngster addressed via video link an informal briefing of the Counter Terrorism Committee of the UN Security Council on October 28 that met in Mumbai, calling upon to find news ways to fight terror so that "nobody has to go through what he has gone through".
In the video, shared by his grandparents with PTI, he is heard narrating the incident and his lucky escape with the help of Sandra, "who risked her own life in order to save me".
Moshe also said that his grandparents, Rabbi Shimon and Yehudit Rosenberg, have raised him as their own son since then in Israel.
Recalling his meeting with Prime Minister Narendra Modi in Israel in 2017, Moshe said, "he hugged me warmly and was really excited and invited me with my grandparents to visit India".
"It was very important for him to see me," he added.
Later, they visited Mumbai during Israeli Prime Minister Benjamin Netanyahu's visit to India in 2018.
"I feel grateful to him (Modi) for his warmth and kindness," said the youngster, who dreams of becoming the Director of the Chabad House in Mumbai.
"Your gathering here in Mumbai is very important so that you will find new ways to fight against terror, so that nobody goes through what I have gone through," he concluded in his address to the Counter Terrorism Committee of the UN Security Council.
The family will be holding the remembrance day prayers for their lost ones on November 24 in Jerusalem at the Mt. of Olives cemetery, as per the Hebrew Calendar, this year.

A Pakistani terrorist who plotted attacks against India, claimed to have been dead for years, and suddenly arrested and jailed a few days ago.
In an interesting turn of events, terrorist Sajid Majeed Mir has been sentenced to 15 and a half years in prison. He was part of the 26/11 Mumbai terror attack plot, and had been declared dead by Pakistani authorities earlier.
An anti-terrorism court in Lahore issued the verdict in early June. Mir had been incarcerated at Lahore's Kot Lakhpat prison since his arrest in April. An embarrassed Islamabad apparently tried to keep the case under wraps with the Counter Terrorism Department of Punjab Police not notifying the conviction.

Sajid Mir is a Lashkar-e-Taiba operative who is on the Most Wanted lists in India and USA. He acted as the 'project manager' of the 26/11 conspiracy, and handled the plotting and reconnaissance operations. Mir recruited David Headley, who had visited India to carry out surveys of the areas which were eventually attacked. Mir is also accused of conspiring to carry out attacks in Denmark.
He now joins other top Lashkar operatives in prison. These include chief of the terror organisation, Hafiz Saeed - the mastermind of the 26/11 attacks. He has been sentenced to 68 years in prison in terror financing cases. However, he is expected to spend very little time in jail as the sentences will run concurrently.
Another Lashkar terrorist in jail is Zakiur Rehman Lakhvi. He acted as the operational commander of the 26/11 conspiracy. He is also in jail under terror financing charges.

So, why is Pakistan suddenly taking action against terrorists, after years of letting them roam free?
The country is currently trying to exit the 'grey list' of the Financial Action Task Force, or FATF. Islamabad was placed in the grey list in 2018 for allowing terror financing and money laundering from its territory. In order to exit the grey list, Pakistan has to take action against terrorists. To verify that effective action has truly been taken, FATF officials are slated to visit the country soon.
If Pakistan fails to convince FATF that it is cracking down on terrorist networks, then it might be relegated to the 'black list'. This would lead to imposition of sanctions. Foreign investments and loans will dry up, and trade with other countries will become extremely difficult.
Pakistan is already struggling with economic distress along with political instability.If the FATF decides to penalise Islamabad, it might just push the country into a Sri Lanka-like situation.
But it is also difficult to believe that a country which has encouraged terrorism for many decades, has suddenly decided to clean up its act. So, is the jailing of sinister terrorists justice, or just a show?

“And whereas, the central government believes that Hafiz Talha Saeed is involved in terrorism and he should be notified as a terrorist under the Unlawful Activities (Prevention) Act, 1967 (37 of 1967),” the notification said.
Hafiz Saeed was the brain behind the Mumbai terror attacks of November 26, 2008, in which 166 people were killed.
He had been declared a terrorist under the same law a few years ago and is currently serving a jail term in Pakistan on terror charges.
India has been consistently seeking Hafiz Saeed's custody but Pakistan has refused to do so.
Apart from the 26/11 attacks, the LeT has been responsible for a series of deadly attacks in India, mostly in Jammu and Kashmir, in which scores of civilians and security personnel have been killed over the years.

A former officer of Mumbai Police has made serious allegations against former Mumbai Police Commissioner Param Bir Singh regarding the 26/11 terror attacks in the city.
Former ACP Shamsher Pathan has alleged that Param Bir Singh, who was then posted with the Anti-Terror Squad, took terrorist Ajmal Kasab's phone from a constable and never returned.
In a letter to the Mumbai Police chief, Pathan has alleged that Singh also didn't inform his seniors about the phone.
Pathan said on November 26, 2008, when police arrested Kasab at Girgaum Chowpatty, the police team recovered a phone from the terrorist through which he was taking instruction from him Pakistani handlers.
"This is an issue of national importance and hence this matter needs to be investigated and Param Bir Singh should be arrested," Pathan has stated.
Pathan wrote to the Mumbai Police chief about the matter in July this year and has said that he didn't publicise earlier as the matter concerns national security.
Speaking to news agency ANI, Pathan must be arrested for destruction of evidence. He also alleged that Singh could have sold Kasab's phone to terror group ISIS.
