Finance Minister Nirmala Sitharaman on Monday said that Sebi chairperson Madhabi Puri Buch and her husband Dhaval Buch are defending themselves and putting out facts which contradict the allegations of Congress.
To a question on her assessment of the situation involving Madhabi Puri Buch, the minister said: "Quite a few of the allegations have been answered... I think the facts will have to be taken on board." This is for the first time that Sitharaman has spoken on the issue.
On being asked whether she was satisfied with Madhabi Puri Buch's answers, Sitharaman said, "I'm not here to judge that." The minister was speaking at News18 India Chaupal.
In a joint statement issued last Friday, Sebi chairperson Madhabi Puri Buch and her husband Dhaval Buch had denied the allegations of impropriety and conflict of interest levelled by Congress, saying they are false, malicious and motivated.
In a point by point rebuttal of the Congress allegations, Buchs said Madhabi has made all disclosures and followed Sebi's recusal guidelines.
In the joint statement -- the second since US-based short seller Hindenburg Research charged her of not being motivated enough to act on allegations against Adani group due to conflict of interest -- Buchs also addressed issues raised by opposition Congress over receiving payments from her previous employer ICICI Bank while being a whole time member of Sebi.
The statement said Madhabi Buch never dealt with any file involving Agora Advisory and Agora Partners -- the advisories where she held 99 per cent and continued to earn revenue even after she joined the market regulator body Sebi in 2017.
According to the statement, she never handled files involving the Mahindra Group, Pidilite Industries, Dr Reddy's Laboratories Ltd, Alvarez and Marsal, and Sembcorp -- the firms that had employed her husband at some time during her stint at Sebi -- as also that pertaining to her previous employer ICICI Bank at any stage after joining the regulator.
The payments that she got from ICICI Bank while being in Sebi pertained to contributory annuity scheme and exercising of ESOPs at various stages over 10 years.

Parliamentary Panel May Summon SEBI Chief Madhabi Puri Buch Amid Allegations of Corruption

The Public Accounts Committee may summon SEBI Chairperson Madhabi Puri Buch for a review of regulatory performance. This comes amid growing scrutiny and allegations against Buch, highlighting a turbulent period for SEBI&rsquo;s leadership.

The Public Accounts Committee (PAC) of the Indian parliament is likely to summon Madhabi Puri Buch, the chairperson of the Securities and Exchange Board of India (SEBI). According to media reports quoting sources, the PAC is likely to summon the SEBI chief as early as this month. The panel&rsquo;s next meeting is scheduled for 10th September.
The Public Accounts Committee, or PAC, is a key parliamentary body responsible for auditing the government&rsquo;s finances. Headed by Congress leader K. C. Venugopal, the committee has announced that it will review the 'performance of regulatory bodies.' As part of this review, they are likely to summon SEBI Chief Madhabi Puri Buch and other officials.
According to reports, this review of SEBI&rsquo;s performance was added to the agenda of the parliamentary watchdog for government spending after several members of the panel demanded a probe into the allegations against the SEBI Chief. The development comes at a time when the SEBI Chief is in the eye of multiple storms.
<h3>Hindenburg Research vs SEBI Chief</h3>
The first set of allegations against the SEBI Chief came on 10th August 2024 from Hindenburg Research, which accused her of having stakes in offshore funds linked to the Adani Group. The US-based short seller stated, "The current SEBI Chairperson and her husband, Dhaval Buch, had hidden stakes in the exact same obscure offshore Bermuda and Mauritius funds, found in the same complex nested structure, used by Vinod Adani." &ndash; end of quote.
However, the Buchs slammed Hindenburg Research's claims as 'baseless' and 'malicious.' They clarified that their investments in offshore funds were made well before Madhabi joined SEBI. They also emphasised that all necessary disclosures were made, and Madhabi recused herself from any SEBI decisions involving potential conflicts of interest &ndash; a clarification backed by SEBI.
<h3>&ldquo;ICICI Bank Salary&rdquo; Claims by Congress</h3>
The next set of allegations to hit the SEBI chief came from the Congress. On 2nd September 2024, Congress alleged that SEBI Chairperson Madhabi Puri Buch drew regular income from banking giant ICICI Bank and its insurance arm, ICICI Prudential, from 2017 to 2024.
ICICI Bank refuted the allegations. In a regulatory filing, the lender said, "ICICI Bank or its group companies have not paid any salary or granted any ESOPs to Madhabi Puri Buch after her retirement, other than her retiral benefits. It may be noted that she had opted for superannuation with effect from 31st October 2013."
<h3>Toxic Culture at SEBI?</h3>
Hot on the heels of the Congress claims, another crisis erupted for the SEBI chief, and this time within her organisation. In an unprecedented move, SEBI officials wrote to the Finance Ministry, raising concerns about a toxic work environment under the leadership of Buch. The letter, dated 6th August, which has been reviewed by several media organisations, reportedly accused the SEBI leadership of using harsh language, setting unrealistic goals, and micromanaging their work. Responding to the reports regarding the complaint, SEBI said that the issues with the employees have been resolved.
<h3>Subhash Chandra Adds Fuel to the Fire</h3>
Meanwhile, media tycoon Subhash Chandra added fuel to the fire by accusing Madhabi Puri Buch of corrupt practices and demanding that her income be probed by investigative agencies. However, a SEBI official rejected Chandra&rsquo;s allegations outright, calling them &ldquo;opportunistic comments and completely baseless.&rdquo;

ICICI Bank has denied allegations from the Congress party that SEBI Chief Madhabi Puri Buch received a salary from the bank and ICICI Pru., between 2017 and 2024. Congress spokesperson Pawan Khera made these allegations, demanding Buch&rsquo;s resignation.

ICICI Bank has refuted the allegations made by Congress that SEBI Chief Madhabi Puri Buch was drawing a salary from the lender and its group company ICICI Prudential between 2017 and 2024.
In a regulatory filing, the bank said that it had come to its attention that there were certain reports in the media alleging the payment of salary by ICICI Group to Madhabi Puri Buch, Chairperson of SEBI.
"ICICI Bank or its group companies have not paid any salary or granted any ESOPs to Madhabi Puri Buch after her retirement, other than her retiral benefits. It may be noted that she had opted for superannuation with effect from October 31, 2013," ICICI Bank said in a statement.
The lender also added that during her employment with the ICICI Group, Buch received compensation in the form of salary, retiral benefits, bonus, and ESOPs, in line with applicable policies.
"Under the bank&rsquo;s ESOP rules, the ESOPs vest over the next few years from the date of allotment. As per rules existing at the time of her ESOP grant, employees, including retired employees, had the choice to exercise their ESOPs anytime up to a period of 10 years from the date of vesting," it further added.
<h3>Congress&rsquo; Allegations Against SEBI Chief</h3>
On Monday, August 2, 2024, Congress had alleged that SEBI Chairperson Madhabi Puri Buch drew regular income from banking giant ICICI Bank and its insurance arm, ICICI Prudential, from 2017 to 2024.
Addressing a press conference in New Delhi, Congress spokesperson Pawan Khera had also questioned the basis for ICICI Bank to provide regular income to the SEBI chief. He went on to claim that Madhabi Puri Buch, while being a whole-time member of SEBI, was receiving regular income from ICICI Bank, amounting to Rs 16.80 crore.
The Congress spokesperson further accused the SEBI chief of also taking TDS from ICICI Prudential, ESOP, and ESOP from ICICI Bank.
He also claimed that this was a direct violation of Section 54 of SEBI. The Congress spokesperson demanded that, considering these accusations, Madhabi Puri Buch should resign from her post.

Indian market regulator SEBI's chairperson Madhabi Puri Buch while speaking at the CII Corporate Governance Summit defended the premium valuations Indian markets enjoy. While acknowledging the higher valuation she mentioned that this is justifiable based on factors like optimism and trust.&nbsp;

She also added that while many feel that Indian markets are expensive, that is just a reflection of the trust and faith that India commands globally.
"Why is it that our markets are commanding&hellip; this price to earnings multiple which is higher than not only the averages of the world indices but also when compared with various nations,&rdquo; said Buch while speaking at the CII Corporate Governance Summit.
&ldquo;At 22.2x, some people say that we are (an) expensive market but still why is the investment coming? Because this is a reflection of the optimism and the trust and faith that the world has in India today that we are commanding this kind of multiples in our markets,&rdquo; she added.

Madhabi Buch also highligted the strong domestic flows especially by retail investors who have been investing directly and indirectly (through mutual funds) in the stock market as an important factor to the resilience of the Indian market.
As per Business Today, Sensex has gained a little over 25% in the last one year while Nasdaq is up around 14% even as the S&amp;P500 moved up a little over 27%. Compared to most of the European and Asian benchmarks, India performed significantly better. In the last one year, Hang Seng shed 17% while Kospi and FTSE have gained only 11% and 4%, respectively.
At the CII summit, Buch also mentioned that going ahead investment products like Real Estate Investment Trusts (REITs) and Infrastructure Investment Trust (InvITs) will gain significantly in terms of value and could even be equal to the country&rsquo;s gross domestic product (GDP)
&ldquo;We think that going forward, possibly REITs and InvITs together can be in value equal to our entire market the way it is valued today. In other words, one time GDP,&rdquo; said Buch
