The court had earlier observed that the permission to Sikhs is government policy and the judiciary cannot interfere unless it is arbitrary.

A petition filed against permission to members of the Sikh community to carry 'kirpan' or daggers on flights has been dismissed.
The Delhi High Court on 22 December 2022 rejected a public interest litigation (PIL) which sought the setting-up of a committee of stakeholders to examine the issue.
The petitioner contended that he was &ldquo;not questioning&rdquo; the right to profess and practice a religion under Article 25 of the Constitution but only wanted the constitution of a committee of stakeholders to examine the issue.
&ldquo;I admit that Article 25 allows the carriage of a kirpan. But when you are flying, the regulator must apply its mind. I want constitution of a committee of stakeholders to examine the issue. If the committee feels that the notification is good, so be it. Not a problem,&rdquo; he had said.

The petitioner, a lawyer, challenged a March 4, 2022 notification by the Centre which said Sikh passengers shall have exceptional regulatory sanction to carry kirpans having blade length of not more than six inches and total length of not more than nine inches whilst on board any civilian flight in India that is operating on all domestic routes.
The court had earlier observed that the permission to Sikhs is government policy and the judiciary cannot interfere unless it is arbitrary.

US university allows Sikh students to wear kirpan on campus under THIS condition

The change comes about two months after a video showed a student at the University of North Carolina handcuffed for carrying a kirpan.

A prominent US university has announced that it would allow Sikh students to wear a kirpan on campus, a religious article in Sikhism.
The change comes about two months after a video was posted online showing a student at the University of North Carolina at Charlotte was handcuffed for carrying a kirpan.
The University of North Carolina in a statement on Thursday said that the school&rsquo;s policy will allow students to wear kirpans on campus as long as the blade length is under 3 inches and is &ldquo;worn close to the body in a sheath at all times.&rdquo; The statement released was signed by Chancellor Sharon L. Gaber and Chief Diversity Officer Brandon L. Wolfe said the ruling was effective immediately.

&ldquo;The Office of Diversity and Inclusion, with support from Institutional Integrity, also conducted additional awareness training this week with our police department and will continue its work to expand our cultural education and training opportunities for all of campus,&rdquo; the statement said.
The university also said other religious accommodations, including a request to wear a larger kirpan, can be made to the Office of Civil Rights and Title IX and evaluated on a case-by-case basis, it said.
&ldquo;Over the past several weeks, we have engaged in dialogue with representatives from the local and global Sikh communities about how we could modify University policies to honour the tenets of religious freedom while protecting the safety of our campus,&rdquo; the statement said.
The university thanked Sikh leaders, including nonprofit organisations The Sikh Coalition and the Global Sikh Council, who provided expertise and perspective to help with the policy change.

The issue was even picked up by Indian politicians like BJP leader Manjinder Singh Sirsa, who "condemned the discriminatory attitude of authorities towards Sikh students". Sirsa also appealed to India's foreign minister S. Jaishankar to address the issue at the global level.
On 23 September, a day after the incident, the university had released a statement. The varsity said that a call to police had been made over a person with a knife in the building.
The statement said, "The individual was placed in handcuffs while officers took possession of the object. The handcuffs were removed after the object was retrieved. Further investigation showed the item was a kirpan, an article of faith in Sikhism."
The statement by the university's chancellor and chief diversity officer added, "State law and University policy prohibit the possession of a knife or other edged instruments on campus, but we will use this as a learning opportunity by engaging in constructive dialogue with Sikh students and employees.  Together, we are confident we can find reasonable measures and educational opportunities that both protect the safety of our campus and the religious practices of our community members."
The statement ended by saying, "Our diversity makes us a better, richer, more successful community.  We want every Niner to feel welcomed, supported and safe. We apologize that is not what this young man felt in our union yesterday.  We are committed to ensuring it doesn’t happen again."
