A court in Maharashtra&rsquo;s Thane district has convicted a 47-year-old man for kidnapping a minor girl and sentenced him to 7 years in jail.
Additional Sessions Judge (Kalyan) P R Ashturkar, however, dropped rape charges pressed against Deepak, alias Ganesh Bhanudas Bhuktar, citing lack of evidence.
A copy of the order passed on April 8 was made available on Friday.
Ambernath resident Bhuktar was booked in March 2018 after being accused of kidnapping the 13-year-old girl and taking her to Chhatrapati Sambhajinagar, then Aurangabad.
Judge Ashturkar held that the minor&rsquo;s lack of consent or resistance was irrelevant in a kidnapping case. The court also said that Bhuktar had secretly given her a phone, which was &ldquo;indicative of malicious intent&rdquo;.
The kidnapping charge has been proved beyond reasonable doubt, the court held.
However, the court found the rape allegations lacked specific and clear evidence. It said the girl and her mother failed to provide any specific details regarding the alleged sexual assault, including date, time, or place.
Furthermore, the medical evidence did not support forceful sexual assault, the court said, acquitting Bhuktar of rape charges under the Indian Penal Code (IP) and Protection of Children From Sexual Offences (POCSO) Act.
The court then convicted Bhuktar of kidnapping and sentenced him to seven years in jail and imposed a fine of Rs 3,000 on him.
Additional Public Prosecutor Sachin Kulkarni said six prosecution witnesses, including the teenager and her mother, were examined during the trial.

The facts unfolded during an investigation, which was launched after the teen's parents filed a missing complaint to the police.

Hundreds of people attended the funeral services for four members of an Indian-origin Sikh family, including a baby girl, who were kidnapped and killed by a man earlier this month in the US State of California.
The Sikh family of four, 8-month-old Aroohi Dheri, her 27-year-old mother Jasleen Kaur, her 36-year-old father Jasdeep Singh, and her 39-year-old uncle Amandeep Singh were kidnapped at gunpoint on October 3 and killed allegedly by Jesus Salgado, a disgruntled former employee of their trucking company on October 5.
The funeral services for the Sikh family members were held in Turlock, a city in California on Saturday..
&ldquo;We are just here to show the family there now, they&rsquo;re not in this alone,&rdquo; said Mani Grewal, Stanislaus County Supervisor.
&ldquo;Our community is way better than the acts of these two individuals that have done heinous crimes,&rdquo; KTLA-TV quoted Grewal as saying.
Friends of the victims said it will take a long time for the family and community to heal.
&ldquo;I don&rsquo;t know how the family is going to come out of this tragedy. It&rsquo;s going to be very difficult. We are here to support the family,&rdquo; said Sanjeev Tewari, a friend of the family.
Saturday's memorial at Allen Mortuary was for family only, but community members were welcome to show their support outside the service, the report said.
The funeral was done according to the Sikh tradition.
Salgado entered a not guilty plea in court on Thursday, Merced County Chief Deputy District Attorney Matthew Serratto said.
He will be back in court next month. His brother, Alberto, is charged as an accessory.
Salgado, who was arrested on October 6, is charged with four counts of first-degree murder with special circumstances for the death of the Indian-origin family. He is also charged with arson and possessing a firearm by a prohibited person.
Salgado, 48, is being held on USD 450,000 bail, according to county inmate records. His attorney could not be reached for comment. A status hearing in the case is set for December 15.

CCTV footage of the kidnapping, released earlier on Wednesday shows brothers, Jasdeep and Amandeep Singh arriving at their business nine minutes apart.  The seven-minute-long surveillance video showed the suspect wearing a dark-coloured hoodie and a face mask walking around a parking lot with a white trash bag in hand. He then talked to one of the victims and followed him up to the office. A little later, the armed suspect is seen opening a side door and leading two men with bound hands identified by the police as Amandeep and Jasdeep outside the building and into the back seat of a truck.  Moments later, the kidnapper returned with the gun, leading Jasleen and her 8-month-old baby, Aroohi, out of the building into a truck.
The motive for the kidnapping has not been found. Family members said nothing was stolen from the trucking company and that the kidnapper made no ransom calls. According to investigators, the ATM card of one of the victims was used at a bank in Atwater, California after they were kidnapped.

A 48-year-old man considered a “person of interest” in the kidnapping of the four-member Sikh family has been taken into custody and is in critical condition, authorities in the US said. The victims are still missing though.

Jasdeep’s parents Dr Randhir Singh and Kirpal Kaur are natives of Harsi Pind village in Tanda block of Hoshiarpur.
Charanjit Singh, a neighbour of Randhir Singh, said Jasdeep’s parents were in a state of shock and not in a position to talk.
Randhir Singh and Kirpal Kaur retired from the health and education departments, respectively.
According to Charanjit Singh, Randhir Singh returned to India from abroad on September 29. Upon arrival, he left for a pilgrimage in Uttarakhand. When he reached Rishikesh, he received a call from daughter-in-law Jaspreet Kaur from the US who told him about the incident of kidnapping of her husband Amandeep Singh and other family members.
After learning about the incident, Randhir Singh came back to his village on Tuesday evening, and is preparing to leave for the US Tuesday night, his neighbour said.
The people of Harsi Pind and its adjoining villages rushed to the house of Randhir Singh to support the family and prayed for the safe return of the kidnapped persons to their home, said Charanjit Singh.
He further claimed that Union minister and Hoshiarpur MP Som Parkash had also telephoned Randhir Singh and assured him of full support from the central government.
Tanda Deputy Superintendent of Police Kulwant Singh said he had also visited the house of Randhir Singh and assured full support to him.
A vehicle owned by one of the family members was found on fire late Monday, which led law enforcement in the US to determine that the four had been kidnapped.
According to a news release, detectives received information Tuesday morning that one of the victim’s bank cards was used at an ATM in Atwater in Merced County.
“Investigators obtained the surveillance photo of a subject making a bank transaction where the person is similar in appearance to the surveillance photo from the original kidnapping scene,” the Merced County Sheriff’s Office statement said.
Before law enforcement involvement, the suspect identified as Jesus Manuel Salgado “attempted to take his own life,” and is currently in “custody, receiving medical attention and in critical condition.”
