An unusual scene unfolded in a bustling courtroom of the Kerala High Court, after a teary eyed petitioner stood before Justice PV Kunhikrishnan and her hands folded to seek justice.&nbsp;
According to the Bar and Bench portal, reacting to litigant Ramla Kabeer's plea for justice, Justice Kunhikrishnan said, "Judges are mortal and not deities. Usually the court of law is known as the &lsquo;temple of justice&rsquo;. But there is no god sitting on the bench. The judges are doing their constitutional duties and obligations."
Significantly, Justice Kunhikrishnan's observation revolved around an FIR lodged against Kabeer. The woman had been accused of using abusive language against Police personnel.&nbsp;
Subsequently, the case was quashed, and a departmental inquiry against the policeman was ordered.&nbsp;

"The right of a woman to make autonomous decisions about her body is at the very core of her fundamental right to equality and privacy,' the Kerala High Court said.&nbsp;

The right of autonomy over one's body is often denied to the fairer sex and they are bullied, discriminated against, isolated and persecuted for making choices about their bodies and lives, the Kerala High Court said on Monday while discharging a women's rights activist charged in a POCSO case.
Rehana Fathima, a woman's right activist, was facing charges under various provisions of the POCSO, Juvenile Justice and the Information Technology (IT) Acts for circulating a video in which she was seen posing semi-nude for her minor children, allowing them to paint on her body.
Discharging her from the case, Justice Kauser Edappagath said that from the allegations against the 33-year-old activist, it was not possible to anyone to infer that her children were used for any real or simulated sexual acts and that too for sexual gratification.
The court said that she only allowed her body to be used as a canvas for her children to paint on.
"The right of a woman to make autonomous decisions about her body is at the very core of her fundamental right to equality and privacy. It also falls within the realm of personal liberty guaranteed by Article 21 of the Constitution," it said.
The order came on Fathima's appeal against a trial court decision dismissing her plea to be discharged from the case.
In her appeal in the high court, she had asserted that the body painting was meant as a political statement against the default view of society that the naked upper body of the female is sexualised in all contexts, whereas the naked male upper body is not treated to this default sexualisation.
Agreeing with her contentions, Justice Edappagath said that painting on the upper body of a mother by her own children as an art project "cannot be characterised as a real or simulated sexual act nor can it be said that the same was done for the purpose of sexual gratification or with sexual intent".
The judge said it was "harsh" to term such an "innocent artistic expression" as a usage of a child in a real or simulated sexual act.
"There is nothing to show that the children were used for pornography. There is no hint of sexuality in the video. Painting on the naked upper body of a person, whether a man or a woman, cannot be stated to be a sexually explicit act," the court said.
The prosecution had claimed that Fathima had exposed her upper body in the video and hence, it was obscene and indecent.
Rejecting the contention, the court said that "nudity and obscenity are not always synonymous".
"It is wrong to classify nudity as essentially obscene or even indecent or immoral," it further said.
The court pointed out that women of lower castes in Kerala had once fought for the right to cover their breasts and that there were murals, statues and art of deities in the semi-nude in ancient temples and various public spaces all over the country and these are considered as "holy".
It further said that nude display of the upper body of men is never considered obscene or indecent and is not sexualised, but "a female body is not treated in the same way".

The Kerala High Court has ruled that the admin of a WhatsApp group cannot be held liable if a group member posts objectionable content.
The high court made the ruling while quashing a POCSO case against one such WhatsApp admin, in whose group a member had posted child pornography.
The court said that the only privilege held by a WhatsApp group admin over other members, is that they can add or delete any members from the group. They do not have any control over a what a member of the group posts, and they cannot moderate or censor any messages.

The court said that there was no law by which admin of any messaging service could be held liable for a post made by a member, noting that there is not master-servant or principal-agent relationship between the admin of a WhatsApp group, and its members.
It goes against the basic principles of criminal law to hold an Admin liable for a post published by someone else, the court said.

The Prime Minister is the leader of the nation and not of a political party and citizens "need not be ashamed" to carry a vaccination certificate with his photograph and "morale boosting message", the Kerala High Court said on Tuesday and dismissed a plea seeking removal of PM's photo from the Covid-19 immunisation certificates.
"Nobody can say that a Prime Minister is a Congress Prime Minister or a BJP Prime Minister or the Prime Minister of any political party. But once a Prime Minister is elected as per the constitution, he is the Prime Minister of our country and that post should be the pride of every citizen.
".. they can differ on the policies of the government and even the political stand of the Prime Minister. But the citizens need not be ashamed to carry a vaccination certificate with the photograph of the Prime Minister with a morale boosting message, especially in this pandemic situation," the high court said.
It also said that when Covid-19 pandemic can be eliminated only by vaccination, if the PM gave a message with his photograph, in the certificates, that with the help of medicine and strict control, India will defeat the virus, "what is wrong with it?" The court dismissed the petition with a cost of Rs 1 lakh, saying it was "frivolous", filed with "ulterior motives", "publicity oriented" and the petitioner probably also had a "political agenda".
"According to my opinion, this is a frivolous petition filed with ulterior motives and I have a strong doubt that there is a political agenda also to the petitioner. According to me, this is a publicity oriented litigation. Therefore, this is a fit case that is to be dismissed with a heavy cost," the judge said.
The court said in case of failure to deposit the cost within the stipulated period, KeLSA shall recover the amount from his assets by initiating revenue recovery proceedings against him.
It also said that the "petitioner should study the respect to be given to the Prime Minister and others by watching at least the parliamentary proceedings, which are available live on national TV".

"Nobody can say that a Prime Minister is a Congress Prime Minister or a BJP Prime Minister or the Prime Minister of any political party, the court said. It added that "once a Prime Minister is elected as per the constitution, he is the Prime Minister of our country and that post should be the pride of every citizen".
The court further added that the "citizens need not be ashamed to carry a vaccination certificate with the photograph of the Prime Minister with a morale boosting message, especially in this pandemic situation".
The petition had been filed by RTI activist Peter Myaliparampil, who said that to have PM Modi's picture on the certificate when people had to pay for the vaccines at private hospitals, was a violation of fundamental rights.

The Court was hearing a matter where the husband had challenged a family&rsquo;s court verdict in favour of his wife who had sought divorce.&nbsp; He had in turn filed a petition for restitution of conjugal rights which the court dismissed observing that he was treating his wife as money-minting machine and she was tolerating the sexual and mental harassment for the sake of marriage.
The High Court made several key observations such as-
&ldquo;Treating wife's body as something owing to husband and committing sexual act against her will is nothing but marital rape&hellip;&rdquo;
&ldquo;Marital privacy is intimately and intrinsically connected to individual autonomy and any intrusion, physically or otherwise into such space would diminish privacy&hellip;&rdquo;

The court ruled that "no coercive action" can be taken against News Broadcasters Association over non-compliance with IT rules.
In the petition, the NBA had stated that the new rules give government authorities excessive power to unreasonably regulate content of digital news media.

The Lakshadweep administration, which has been facing widespread protests from the islands' people over some of its policies, has proposed to shift its legal jurisdiction from the Kerala High Court to the Karnataka High Court, officials said.

Lakshadweep admin proposes for shifting HC jurisdiction from Kerala to Karnataka

The Lakshadweep administration, which has been facing widespread protests from the islands' people over some of its policies, has proposed to shift its legal jurisdiction from the Kerala High Court to the Karnataka High Court, officials said.
The proposal was initiated by the administration after as many as 23 applications, including 11 writ petitions have been filed against the administrator of Lakshadweep&nbsp;before the Kerala High Court.
It should be noted that the high court in Kerala is just 400 kms away whereas that of Karnataka is over 1,000 kms with no direct connectivity as well. Also, the mother tongue of the people on these islands is Malayalam.

The Kerala High Court on Thursday directed Lakshadweep police to grant interim bail of one week to filmmaker Aisha Sultana in case they decide to arrest her after questioning her in a sedition case.
An FIR was lodged against the filmmaker following a police complaint by the BJP's Lakshadweep unit chief C Abdul Khader Haji, who objected to her use of the term "bioweapon" while criticising the Centre and Lakshadweep Administrator Praful Khoda Patel over the easing of COVID protocols.

Meanwhile, her counsel argued that she was criticising the government and that it did not attract the charge of sedition.

The Supreme Court on Friday ordered closure of case against two Italian Marines, Salvatore Girone and Massimiliano Latorre accused of killing of two Indian fishermen off Kerala coast in 2012.
The order as passed after the Central government informed the Court that the amount of ₹ 10 crores agreed to be paid by Republic of Italy as compensation for killing two Indian fishermen has been deposited.
The Court further directed that Rs. 10 crore should be transferred to Kerala High Court registry out of which 4 crore each should be paid to the families of the two victims and Rs 2 crore should go to the boat owner.

Kerala HC refuses to stay Thiruvananthapuram airport privatisation

PTI,&nbsp;Kochi:&nbsp;The Kerala High Court on Tuesday declined to stay the further proceedings in leasing out Thiruvananthapuram international airport to Adani Enterprises.
Considering an application by the Kerala government seeking the stay, the court adjourned the case for detailed hearing.
Directing the government to produce the documents before September 9, the bench said a detailed hearing in the matter will be held on September 15.
In its application, the state government said unless the stay is granted, it will be put to irreparable injury and hardship.
The state government filed the application in the court, after an all-party-meeting in the state demanded withdrawal of the Union Cabinet's decision last week to lease out the airport to Adani Enterprises.
Last year, the high court had dismissed the petition challenging the decision, terming it as not maintainable under Article 226 of the Constitution.
The state government then filed an appeal before the Supreme Court against the high court order.
The apex court set aside the judgement of the high court and the matter was remanded back to it for a decision on merit.
Referring to the top court directive, the state government said, "all further proceedings in relation to grant of lease with regard to operation, management and development of Thiruvananthapuram international airport to Adani Enterprises Ltd, is to be stayed pending disposal of the aforementioned writ petition."&nbsp;
