On October 7, the government had sent a letter to CJI Lalit, who is set to retire on November 8, to recommend his successor.
Justice Chandrachud would have a tenure of two years as the CJI and is due to retire on November 10, 2024.

According to the Memorandum of Procedure (MoP), which governs the process of appointment of judges in the higher judiciary, the outgoing CJI initiates the process of naming the successor after getting a communication from the Law ministry.
The MoP says the senior-most judge of the apex court is considered fit to hold the office of the CJI and the views of the outgoing head of the judiciary have to be sought "at an appropriate time".
The MoP, however, does not specify the time limit for the initiation of the process of recommending the name of the successor CJI.

He was judge of the Bombay High Court from March 29, 2000 until his appointment as the Chief Justice of the Allahabad High Court.

After completing BA with Honours in Economics from St Stephen's College, New Delhi, Justice Chandrachud did his LLB from Campus Law Centre, Delhi University, and obtained LLM degree and a Doctorate in Juridical Sciences (SJD) from Harvard Law School, USA.
He practised law at the Supreme Court and the Bombay High Court and was a visiting professor of comparative Constitutional law at the University of Mumbai.

The apex court's ruling on abortion is a landmark judement, but it also conceals within in an important message on the judiciary's outlook towards safety of women in India and marital rape.

In a historic verdict on Thursday the Supreme Court ruled that all women are entitled to a safe and legal abortion process and making any distinction between a married and an unmarried woman in this regard is unconstitutional.

While the verdict on abortion is a huge step towards securing the bodily autonomy of women in our country, the verdict also held an important decision on another burning matter of safety of women. For the first time, and only within the ambit of the Medical Termination of Pregnancy Act the apex court ruled that the definition of rape must include marital rape. 


Currently, the MTP act claims that a woman is well within her rights to terminate a pregnancy up to 24 weeks, if it causes grievous harm to her physical or mental health. A pregnancy caused by rape, is presumed to constitute a grave injury to the mental health of the pregnant woman.  


It is this explanation that the Supreme Court used to justify this landmark ruling. A bench led by Justice DY Chandrachud noted that intimate partner violence is a reality that can take the form of rape, and if the MTP act does not recognise marital rape, it would compel 'a woman to give birth to and raise a child with a partner who inflicts mental and physical harm upon her.'

While the recognising marital rape as valid grounds to terminate a pregnancy is a step in the right direction, there is still some distance to travel towards complete criminalisation. At the moment, Exception 2 of Section 375 of the Indian Penal Code decriminalises marital rape and holds that sexual intercourse by a man with his own wife, the wife not being under 18, is not rape. Following a split verdict by the Delhi High Court, the matter is now in front of the Supreme Court. The court has also sought a response from the Centre on a clutch of petitions against the Delhi high court’s verdict on the issue, but put the next hearing after five months.

Could the inclusion of marital rape as rape under the ambit of MTP point to a larger paradigm shift in our court's standing on the matter? Time will tell.

In his convocation address at Gujarat National Law University (GNLU), he urged the graduating students to be guided by their "own conscience and equitable reason".
In the world of social media "with limited attention span," it helps to remember that "a lot of work we do will only have long-term impact and we should not be worried about the everyday distraction," he said in the speech, delivered through video link.
"The words famously attributed to Voltaire, 'I disapprove of what you say, but I will defend to death your right to say it,' must be incorporated into our being.
Making mistakes, being accepting and tolerant to the opinions of others by no means translates to blind conformity, and it does not mean not standing up against hate speech," the judge said.
As the students step into the outer world amid "the increasing noise and confusion of political, social and moral clashes of majority," they must be guided by the path of their "own conscience and equitable reasons," he said at the 11th convocation of the GNLU.
He also quoted writer Seth Godin's analogy of the current and the wind.
"On the river, it is the current that will move the canoe far more than the wind will. But the wind distracts us....The current is our persistent systems of class and race and gender, and powerful industry economy. And if I may add, in our context, caste as well," Justice Chandrachud said, quoting the author.
The current can be overcome, but it takes "focussed effort," the judge said.
"On the other hand, the wind is the breaking news of the moment, the latest social media sensation. And the thin layer of hype that surrounds us. It might be a useful distraction, but our real work lies in overcoming the current or changing it," he added.
"It helps to see it first and to ignore the wind where we can. This quotation is especially relevant to remember in today's world with polarising opinions and conflicting actions," the judge added.
