Kapil Sibal criticized VP Jagdeep Dhankhar for questioning the judiciary's timeline-setting power, calling it unconstitutional.

Rajya Sabha member Kapil Sibal slammed Vice President Jagdeep Dhankhar on Friday for questioning the judiciary over the timeline for the president to take decisions, saying this is "unconstitutional" and he had never seen any Rajya Sabha chairman make "political statements" of this nature.
A day after Dhankhar used strong words against the judiciary, Sibal asserted that the Lok Sabha Speaker and the Rajya Sabha Chairman remain equidistant between the opposition and the ruling party, and cannot be the "spokesperson of the party".
"Everyone knows that the Lok Sabha Speaker's chair is in between. He or she is the Speaker of the House, not the speaker of one party. They also don't vote, they only vote when there is a tie. The same is with the upper house. You are equidistant between the opposition and the ruling party," the senior advocate said at a press conference here.
"Everything you say must be equidistant. No speaker can be the spokesperson of a party. I don't say that he (Dhankhar) is but no Speaker in principle can be the spokesperson of any party. If it appears so then the dignity of the chair is lowered," Sibal asserted.
Dhankhar on Thursday questioned the judiciary setting a timeline for the president to take decisions and act as a "super Parliament", saying the Supreme Court cannot fire a "nuclear missile" at democratic forces.
Dhankhar's strong words to the judiciary came during his speech to Rajya Sabha interns, days after the Supreme Court sought to fix a timeline for the president to grant assent to the bills reserved for her consideration by the governor.
"So, we have judges who will legislate, who will perform executive functions, who will act as super Parliament and absolutely have no accountability because the law of the land does not apply to them," Dhankhar said.
He also described Article 142, which grants plenary powers to the Supreme Court, as a "nuclear missile against democratic forces available to the judiciary 24x7".
Slamming Dhankhar for his remarks, Sibal said, "If you give such statements it will look as if judiciary is being taught a lesson. It Is not neutral and not constitutional." The judiciary should not be attacked in this manner by the executive, especially two ministers - Arjun Ram Meghwal and Kiren Rijiju - and the chairman of the house, as the judiciary cannot defend itself.
"Then the polity must defend the judiciary. Independence of the judiciary is fundamental to democracy in the country. What is being done is unconstitutional," he said.
"I have never seen any chairman of the House make political statements of this nature. Even BJP chairman in the past (have not done so)," Sibal said, hitting out at Dhankhar.
Sibal said he was saddened and surprised by the statement of Dhankhar.
"Judicial institutions - high courts or Supreme Courts, if there is faith in any institution, it is the judiciary. I feel that when government people do not like the decisions of the judiciary then the start accusing that it (judiciary) has gone beyond its limit. When they like it and the opposition says something then they say it is the decision of the Supreme Court," the former Congress leader said.
When someone raises questions about Article 370 or Ramjanam bhoomi judgement, the government people point out that it is a Supreme Court decision, he said.
"When (Justice J B) Pardiwala judgement came they say how can the Supreme Court say this. The judgement which you do not like is wrong and which is as per your thinking, it is fine. It is not right for a constitutional functionary to say such a thing," Sibal said referring to Dhakhar's remarks.
"I respect him a lot but you said article 142 is nuclear missile material, how can you say this? Article 142 has given powers to the Supreme Court and it is given by the Constitution, it is not by the government it is the Constitution to do complete justice," Sibal said.
He also pointed out that the President of India is a titular head and acts on the aid and advice of the council of ministers.
"The governor acts on the aid and advice of the council of ministers in a state. So when a bill is passed it goes to the governor, the governor can make comments and send it back but if passed again, the governor has to give an assent as stated in the Constitution. The governor can send the bill to the president. President acts on the aid and advice of the ministers, so the matter goes to the Centre. The president does not have personal powers," he said.
Dhankar said how can president's power be curtailed, Sibal noted and wondered who is curtailing the power of the President.
Can the governor sit for two years on a bill that is important for people, Sibal asked and added that this amounts to an intrusion on the supremacy of the legislature.
"If you have a problem with a judgement, call for a review. If there are still problems, take an advisory opinion from Supreme Court," Sibal said.
"He (Dhankhar) talked about 1984 but did not talk about 2002. You talked about an emergency bit not undeclared emergency that is going on, you did not talk about capture of institutions," Sibal said in a scathing criticism of Dhankhar's comments.
He said it seems that he only talks about what happened in Congress governments and not after 2014.
"We moved an impeachment motion against judge of a high court in December; it was signed by more than 50 members. We are in April, it took five months to find out whether those signatures are genuine or not. How many more months would it take?" Sibal said.
"If you do not with expedition decide the matter then the argument for us is that we cannot do anything. If the governor doesn't not clear bills, the judiciary cannot do anything," he said.
If the executive doesn't do its job the judiciary has to intervene, Sibal asserted.
Article 142 of the Constitution gives the Supreme Court the power to issue orders that ensure "complete justice" in any matter before it.
Sibal also hit out at Dhankhar for his remarks questioning the lack of an FIR in the discovery of wads of burnt cash from the residence of a high court judge.
"You will tell me when FIR will be done. There is a judgement on that also that the CJI will decide. You cannot interfere in the work of courts nor can the courts interfere in your work," the Independent Rajya Sabha member said.
Sibal also recalled the 1975 Supreme Court judgment that invalidated then Prime Minister Indira Gandhi's election.
"People would remember that when the Supreme Court's decision came regarding the election of Indira Gandhi, only one judge - Justice Krishna Iyer - gave the decision," he said. "That was acceptable to Dhankhar ji, but now a two-judge bench ruling is not right because it is not in favour of the government," he said.

Dhankhar said the impregnability of the basic structure was so "demolished to pieces" by the highest court of the land that it reversed judgments of nine high courts and in one voice held that Fundamental Rights cannot be on a holiday during the Emergency. There has to be access to the judiciary, he added.&nbsp;

Opposition parties on Tuesday submitted a notice to move a motion for removing Vice President Jagdeep Dhankhar for allegedly conducting the House in a partisan manner.
Congress leaders Jairam Ramesh and Naseer Hussain submitted the notice to Rajya Sabha Secretary General P C Mody.
The vice president is the ex-officio chairman of Rajya Sabha.
The sources said about 60 opposition MPs -- including from the Congress, RJD, TMC, CPI, CPI-M, JMM, AAP, DMK -- have signed the notice.
However, they said top Congress leaders who hold Constitutional posts have not signed the notice.
Congress President Mallikarjun Kharge, Congress Parliamentary Party Chairperson Sonia Gandhi and the floor leaders of various opposition parties are also not among the signatories, the sources said.
The notice, spearheaded by the Congress, comes in the wake of turbulent ties between opposition parties and the Rajya Sabha chairman.
"ALL parties belonging to the INDIA group have had no option but to formally submit a no-confidence motion against the learned Hon'ble Chairman of the Rajya Sabha for the extremely partisan manner in which he has been conducting the proceedings of the Council of States. It has been a very painful decision for the INDIA parties to take, but in the interests of parliamentary democracy they have had to take this step," Congress General Secretary (In-charge, Communications) Jairam Ramesh posted on X.
TMC MP and its Deputy Leader in Rajya Sabha Sagarika Ghose said, "Signed by all and being moved today against Vice President. We do not have the numbers to win, but it is a strong message to fight for parliamentary democracy. Nothing against individuals, this is a fight for institutions."
The opposition has been upset with Dhankhar over multiple issues, the latest being him allowing the members of the treasury benches to raise the Cong-Soros "link" issue in the Upper House.
The minimum required numbers for moving a motion to remove the vice president is 50.
Congress MP Digvijaya Singh had accused the Rajya Sabha chairman of being partisan.
INDIA bloc parties had in August this year also considered submitting a notice for moving a resolution to remove the vice president from his office.
According to Article 67(b) of the Constitution, "Vice-President may be removed from his office by a resolution of the Council of States (Rajya Sabha) passed by a majority of all the then members of the Council and agreed to by the House of the People; but no resolution for the purpose of this clause shall be moved unless at least fourteen days' notice has been given of the intention to move the resolution."

The motion, backed by 70 signatures from MPs across several parties, underscores growing tensions between the opposition and the Rajya Sabha Chairman.
Parties including Congress, Trinamool Congress (TMC), Aam Aadmi Party (AAP), Samajwadi Party (SP), and others within the INDIA alliance are united in their push to move forward with the motion. The latest escalation occurred during Monday&rsquo;s session when BJP members accused Congress leaders of conspiring with billionaire investor George Soros to destabilize the country. The allegations sparked intense exchanges, leading to multiple adjournments of the House. Chairman Dhankhar intervened, urging members to consider the gravity of the situation, while expressing concern over threats to India's sovereignty and integrity.
The Rajya Sabha will reconvene at 10:30 am on Tuesday, with the opposition&rsquo;s no-confidence motion expected to be a key point of discussion.

The ruling party has "weaponised" the suspension of MPs as a convenient tool to "undermine democracy, sabotage Parliamentary practices and throttle the Constitution", Leader of Opposition Mallikarjun Kharge said in a letter to Rajya Sabha Chairman Jagdeep Dhankhar.
In his reply to a letter written by Dhankhar, Kharge said the Chairman's letter "unfortunately justifies the autocratic and arrogant attitude of the Government towards Parliament." Replying to the points raised by Dhankhar, the senior Congress leader urged him to examine his concerns "objectively and with neutrality as the Chairman of the Rajya Sabha." "The ruling party has indeed weaponised the suspension of members as a convenient tool to undermine democracy, sabotage Parliamentary practices and throttle the Constitution.
"If anything privilege motions have also been weaponised to muzzle the voice of the Opposition. This is a deliberate design of the ruling dispensation to undermine Parliament itself. By suspending MPs, the government is effectively silencing the voice of the voters of 146 MPs altogether," Kharge said.
"You have also mentioned that disorder was deliberate and strategised and predetermined. I would like to submit that if anything, it is the mass suspension of the Opposition MPs from both Houses of Parliament that seems to be predetermined and premeditated by the Government and I am most sorry to say, executed without any application of mind, as can be seen by the suspension of an INDIA party MP who was not even present in the Parliament," he said.
While Dhankhar, in his letter, had said that his attempts to meet the Leader of Opposition were turned down, Kharge said he had sought a statement from the Union Home Minister Amit Shah on the security breach on December 14, before the suspensions started.
"I recognise it is well within your powers as Chairman to decide on these notices. However, it was regrettable that the Chair condoned the attitude of the Hon'ble Home Minister and the Government who did not wish to make a statement on the floor of the House.
"It was even more regrettable that the Hon'ble Home Minister made his first public statement before a TV channel when Parliament was in session and the Chair did not find that sacrileging the temple of democracy," Kharge said.
He said a Union minister allegedly informed an opposition parliamentarian that most opposition MPs will be suspended before the home minister is present in the Rajya Sabha.
"We would have expected the Chairman to have inquired if such a threat was indeed issued. Such comments grossly undermines the Chair who we believe is the final authority on conducting the House including suspension of members".
He added that by suspending the MPs, the government is effectively silencing the voice of the voters of 146 MPs altogether.
Kharge said as the custodian of the House, the Chairman should protect the people's right to hold its government accountable in Parliament.
"The Chairman should also kindly note that the government has escaped accountability on all crucial issues like serious border incursions by China, or continued unrest in Manipur or the recent intrusion in the Lok Sabha by visitors who had been facilitated entry by a BJP MP," he said.
"It would be distressing when history judges the presiding officers harshly for Bills passed without debate and not seeking accountability from the government. It is disappointing that the Hon'ble Chairman feels effecting suspensions facilitated legislative business by passing bills without discussion," he said.
Kharge added that he is in agreement with the Chairman that they need to move ahead.
He, however, stressed that the answer may not lie in a discussion in the Chairman's chambers, if the government is not keen on running the House.
Kharge said he is currently out of Delhi and it would be his "privilege and duty" to meet the Chairman as soon as he is back.&nbsp;

The NDTV reported that several Congress leaders, speaking off the record, levelled allegations that the Vice-President's move is to 'keep a close watch on various committees, which clearly shows his no confidence in the existing mechanism.'
Eight members of Dhankhar's personal staff, including four posted in the Vice-President Secretariat, have been appointed on the 20 committees, an order issued by the Rajya Sabha Secretariat said on March 07.&nbsp;
Some among these 20 committees are headed by non-BJP and opposition MPs.
The Congress leaders further added that this clearly showed the Vice-President did not have confidence in the current officers who keep the Rajya Sabha secretary general updated regarding the developments in the various committees.&nbsp;
Among those appointed to the committees include the Officer on Special Duty (OSD) to the Vice-President, OSD to the Chairman and Personal Secretary to the Vice-President.
Sources in the Rajya Sabha Secretariat said there has not been any precedence of the chairperson appointing his staff to the committees.

President Droupadi Murmu administered the oath to Dhankhar during a brief ceremony at the Rashtrapati Bhavan.
Prime Minister Narendra Modi, Dhankhar's predecessor M Venkaiah Naidu, former president Ram Nath Kovind, former vice president M Hamid Ansari, and Union ministers Rajnath Singh, Amit Shah, Nirmala Sitharaman and Nitin Gadkari were among the dignitaries present on the occasion.
In the morning, Dhankhar paid tributes at Raj Ghat, the memorial of Mahatma Gandhi. "Felt blessed, inspired and motivated to be ever in service of Bharat in serene sublimity of Raj Ghat while paying respects to pujya Bapu," he tweeted then.
Once a "reluctant politician", Dhankhar's reemergence in the political scene in 2019 as West Bengal governor surprised many, so has his rise to the office of the Vice President of India.
Dhankhar was declared elected as the Vice President on Saturday after he bagged 528 votes against his rival candidate Margaret Alva's 182.
A man of many interests, his long legal career at the Rajasthan High Court and the Supreme Court and a brief stint as the junior parliamentary affairs minister at the Centre will come in handy as he presides over Rajya Sabha as its chairman.
Dhankhar, who had been associated with the Janata Dal and the Congress, joined the BJP only in 2008 after a hiatus of nearly a decade.
He has championed issues related to Other Backward Classes, including the grant of OBC status to the Jat community in Rajasthan.
While his surprise appointment as the West Bengal governor in 2019 brought him back to the political limelight, he did not shy away from the hurly-burly of politics and was caught in frequent run-ins with the state's ruling Trinamool Congress.
The BJP described Dhankhar as a "kisan putra" while announcing his candidature for the vice presidential election, a move seen in political circles as aimed at reaching out to the politically significant Jat community which had participated in huge numbers in the year-long farmers' protests on the borders of the national capital against agriculture reform measures unveiled in June 2020.

President Droupadi Murmu administered the oath to Dhankhar during a brief ceremony at the Rashtrapati Bhavan.
Prime Minister Narendra Modi, Dhankhar's predecessor M Venkaiah Naidu, former president Ram Nath Kovind, former vice president M Hamid Ansari, and Union ministers Rajnath Singh, Amit Shah, Nirmala Sitharaman and Nitin Gadkari were among the dignitaries present on the occasion.
In the morning, Dhankhar paid tributes at Raj Ghat, the memorial of Mahatma Gandhi. "Felt blessed, inspired and motivated to be ever in service of Bharat in serene sublimity of Raj Ghat while paying respects to pujya Bapu," he tweeted then.
Once a "reluctant politician", Dhankhar's reemergence in the political scene in 2019 as West Bengal governor surprised many, so has his rise to the office of the Vice President of India.
Dhankhar was declared elected as the Vice President on Saturday after he bagged 528 votes against his rival candidate Margaret Alva's 182.

A man of many interests, his long legal career at the Rajasthan High Court and the Supreme Court and a brief stint as the junior parliamentary affairs minister at the Centre will come in handy as he presides over Rajya Sabha as its chairman.
Dhankhar, who had been associated with the Janata Dal and the Congress, joined the BJP only in 2008 after a hiatus of nearly a decade.
He has championed issues related to Other Backward Classes, including the grant of OBC status to the Jat community in Rajasthan.
While his surprise appointment as the West Bengal governor in 2019 brought him back to the political limelight, he did not shy away from the hurly-burly of politics and was caught in frequent run-ins with the state's ruling Trinamool Congress.
The BJP described Dhankhar as a "kisan putra" while announcing his candidature for the vice presidential election, a move seen in political circles as aimed at reaching out to the politically significant Jat community which had participated in huge numbers in the year-long farmers' protests on the borders of the national capital against agriculture reform measures unveiled in June 2020.

The BJP on Saturday named West Bengal Governor Jagdeep Dhankhar, a Jat leader from Rajasthan with socialist background, as the ruling National Democratic Alliance's vice presidential candidate.
Making the announcement, BJP president J P Nadda lauded Dhankhar as a "kisan-putra" (son of farmer) who, he said, established himself as a "people's governor". The BJP parliamentary board in a meeting, attended by Prime Minister Narendra Modi and other senior leaders, picked the 71-year-old Dhankhar after deliberating over several names, Nadda said.
After the announcement, Modi tweeted, "Jagdeep Dhankhar Ji has excellent knowledge of our Constitution. He is also well-versed with legislative affairs. I am sure that he will be an outstanding Chair in the Rajya Sabha & guide the proceedings of the House with the aim of furthering national progress."
Soon after his name was announced, Dhankhar tweeted, "Thank you Narendra Modi ji for nominating me as the Vice President candidate for the vice presidential election." Since taking over as the West Bengal Governor in July 2019, Dhankhar has had several run-ins with the Mamata Banerjee government.
While his proactive conduct has drawn criticism from the state's ruling Trinamool Congress, the BJP has backed him.
Being a Jat, a backward community in Rajasthan, his elevation as vice president is likely to send helpful political message for the BJP as not many Jats besides former prime minister Charan Singh and former deputy prime minister Devi Lal have occupied high positions at the national level.
The BJP has had uneasy relations with Jats, a powerful agrarian community in Haryana, Rajsthan and western Uttar Pradesh, though the party has received their support in good numbers in the recent two Lok Sabha polls compared to assembly elections in these states.
BJP leaders noted that Dhankhar has been in public life for more than three decades, and his life story reflects the spirit of new India: "overcoming innumerable social and economic hurdles and achieving one’s goals".
Nadda said Dhankhar established himself as a respected lawyer in the Rajasthan High Court and later in the Supreme Court before making a mark in politics. He was elected to Lok Sabha from Jhunjhunu in Rajasthan in 1989 and had served briefly as a Union minister in the government led by Chandrashekhar. He joined the BJP later.
His election as vice president is almost a certainty as the BJP has a majority in the electoral college comprising members of Lok Sabha and Rajya Sabha. Out of Parliament's current strength of 780, the BJP alone has 394 MPs, more than the majority mark of 390.
The last date for filing of nomination papers for the poll is July 19 and the election is scheduled for August 6. Dhankar has been a keen cricketer enthusiast and is follower of spirituality and meditation, those familiar with him said. He was also involved with the grant of OBC status for Jats in Rajasthan.

The governor walked out of the assembly after his speech was curtailed.

Legislative members from the BJP too staged a walkout. BJP legislators created a ruckus and also raised slogans of 'Jai Shri Ram'.

Launching a fresh attack on West Bengal Governor Jagdeep Dhankhar, Bengal CM Mamata Banerjee on Monday called him a "corrupt" man whose name "was in the chargesheet of Jain Hawala case".

The governor, who has had regular run-ins with the Mamata Banerjee dispensation on several issues, had on earlier occasions accused the police and administration in the state of playing a partisan role and causing harassment to leaders and workers of opposition parties.&nbsp;
