Over a week after the Supreme Court termed the continued use of Section 66A of the Information Technology Act, 2000 as &ldquo;a shocking state of affairs&rdquo;, the Ministry of Home Affairs on Wednesday asked states and Union Territories to direct all police stations not to register cases under the repealed section of the IT Act.
It has also advised that cases lodged in states and UTs under Section 66A should be immediately withdrawn.
Section 66A empowered police to make arrests over what policemen, in terms of their subjective discretion, could construe as &ldquo;offensive&rdquo; or &ldquo;menacing&rdquo;. It prescribed the punishment for sending messages through computer or any other communication device like a mobile phone or a tablet, and a conviction could fetch a maximum of three years in jail.

The Supreme Court on Monday expressed concern on being told that more than 1,000 cases have been filed invoking Section 66A of the IT Act despite it being struck down seven years ago. After the section was struck down, as many as 1307 cases were filed under it.
The apex court said it is shocked at the police still registering cases under Section 66A of Information Technology Act, a controversial law that allowed authorities to arrest individuals for posting "offensive" content online.
The court was hearing a plea by an NGO seeking directions to the centre to advise all police stations against registering FIRs under this law.

Popular battle royale game PUBG Mobile is among 118 additional Chinese apps banned by the government in India after fresh tensions in Ladakh. The IT Ministry said that the apps have been banned under Section 69A of the IT Act for &ldquo;engaging in activities which is [sic] prejudicial to sovereignty and integrity of India, defence of India, security of state and public order". The ministry said that it acted upon several complaints and reports about some apps &ldquo;stealing and surreptitiously transmitting users' data in an unauthorised manner to servers which have locations outside India.&rdquo;
