The Bombay High Court, emphasizing that the Indian public is &lsquo;not gullible or silly,&rsquo; stated on June 18 that it had watched the movie &lsquo;Hamare Baarah,&rsquo; starring Annu Kapoor, and found nothing objectionable in it that was against the Quran or the Muslim community. The court further noted that the film is aimed at uplifting women.
&lsquo;The movie is in fact for the upliftment of women. The movie has a Maulana misinterpreting the Quran and in fact one Muslim man objects to the same in the scene. So this shows that people should apply their mind and not blindly follow such Maulanas,&rsquo; the high court said.
&lsquo;We don't think there is anything in the movie that would incite any violence. If we felt so we would be the first ones to object to it. Indian public is not so gullible or that silly,&rsquo; the court said.
Earlier this month, several petitions were filed in the High Court seeking a ban on the movie &lsquo;Hamare Baarah,&rsquo; alleging that it was derogatory towards the Muslim community and distorted the teachings of the Quran.
Initially, the high court postponed the movie's release. However, it later permitted the release after the filmmakers agreed to delete objectionable portions as directed by the Central Board of Film Certification (CBFC).
A division bench of Justices B P Colabawalla and Firdosh Pooniwalla noted that the film's first trailer was objectionable, but since then, all objectionable scenes have been deleted.
The bench stated that the filmmakers would be required to pay a cost for releasing the trailer before receiving certification from the censor board. The court stated, &lsquo;Violation was there regarding the trailer. So you will have to pay something towards a charity of the petitioner's choice. Cost will have to be paid. This litigation has given the film so much unpaid publicity.&rsquo;
The court also cautioned the filmmakers to be careful and not include dialogues and scenes under the guise of creative freedom that could hurt the sentiments of any religion.
&lsquo;The makers should also be careful what they put out. They cannot hurt the sentiments of any religion. They (Muslim) are the second largest religion of this country,&rsquo; the court said.
The petitioners alleged that the movie promotes domestic violence, but the bench countered that domestic violence is not limited to any single community.

The Supreme Court has stayed the release of Annu Kapoor’s movie ‘Hamare Baarah’ after taking note of allegations that the film is derogatory to the Islamic faith and married Muslim women. The film was scheduled to be released on June 14. The controversial film is already banned in Karanataka as the state government cited concerns that the movie's release could spark communal tension.

The Supreme Court has stayed the release of Annu Kapoor&rsquo;s movie &lsquo;Hamare Baarah&rsquo; after taking note of allegations that the film is derogatory to the Islamic faith and married Muslim women. The film was scheduled to be released on June 14.&nbsp;
<h2>SC stays release of &lsquo;Hamare Baarah&rsquo;&nbsp;</h2>
A vacation bench comprising Justices Vikram Nath and Sandeep Mehta took note of the submissions of lawyer Fauzia Shakil, who represented the petitioner Azhar Basha Tamboli, and asked the Bombay High Court to take an expeditious decision on the plea. The bench stayed the screening of the film till disposal of the petition by the Bombay High Court.&nbsp;
"We have seen the movie trailer in the morning and all the offensive dialogues continue in the trailer," the bench observed while staying the release of the film. All objections, including the direction to the Central Board of Flim Certification (CBFC) to select the committee, have been left open for the parties to raise before the high court, the top court said. &nbsp;
The Bombay High Court had cleared the film's release after its producers approached the court against its previous order that stayed its release till June 14.
<h2>CBFC&rsquo;s stand on film &nbsp;</h2>
Previously, the CBFC granted &lsquo;Hamare Baarah&rsquo; a U/A certification. They also asked the makers to make 11 changes starting with the title of the film. It was earlier christened &lsquo;Hum Do Hamare Baarah&rsquo;.&nbsp;
<h2>Legal troubles for &lsquo;Hamare Baarah&rsquo;&nbsp;</h2>
The movie faced serious concerns from its producers due to the imposed stay, given their substantial investments in production and distribution. This legal hurdle arose following a petition filed by activists from a specific religious community, contesting the film's release. Annu Kapoor had also spoken out and revealed receiving death threats. &nbsp;
<h2>Film banned in Karanataka&nbsp;</h2>
Earlier, the Karnataka government prohibited the release or broadcast of Annu Kapoor starrer in the state for two weeks or until further notice. This is under the Karnataka Cinema Regulations Act 1964, sections 15(1) and 15(5). The government cited concerns that the movie's release could spark communal tension. This decision follows requests from various minority organizations and delegations and a review of the film's trailer.&nbsp;

'Hamare Baarah', a film that delves into the theme of overpopulation, has attracted notice for its daring storytelling. Featuring Annu Kapoor, Manoj Joshi, and Paritosh Tripathi, 'Hamare Baarah' was originally scheduled for release on June 7, 2024, nationwide which got postponed till June 14. &nbsp;
