The Supreme Court of India will hear petitions challenging the constitutionality of the Places of Worship (Special Provisions) Act, 1991, which prohibits altering the religious character of worship places to their pre-1947 state and bars related legal proceedings.

A special bench, consisting of Chief Justice Sanjiv Khanna and Justices PV Sanjay Kumar and KV Vishwanathan, will deliberate on the matter at 3:30 pm today.

The Supreme Court of India is scheduled to hear petitions challenging the constitutionality of the Places of Worship (Special Provisions) Act, 1991, which prohibits the alteration of the religious character of places of worship to their pre-August 15, 1947 state. This law also disallows any legal proceedings aimed at reclaiming or altering such sites.
A special bench, consisting of Chief Justice Sanjiv Khanna and Justices PV Sanjay Kumar and KV Vishwanathan, will deliberate on the matter at 3:30 pm today. The petitions argue that the Act infringes upon the rights of Hindus, Jains, Buddhists, and Sikhs, preventing them from reclaiming places of worship and pilgrimage that were destroyed or altered by invaders.
Notable individuals, including Maharaja Kumari Krishna Priya of the Kashi Royal Family, BJP leader Subramanian Swamy, former MP Chintamani Malviya, and religious leaders such as Swami Jeetendranand Saraswati, have filed petitions against the Act. They contend that it violates the principles of secularism and deprives them of their right to manage, maintain, and restore sacred sites.
The petitioners also criticize specific provisions within the law, including Sections 2, 3, and 4, which they claim restrict religious practices and the right to judicial recourse. Section 3 bars the conversion of places of worship, while Section 4 prevents the initiation of lawsuits that seek to change the religious character of any place of worship from that of August 15, 1947.
The Jamiat Ulama-i-Hind, along with other Muslim organizations such as the All India Muslim Personal Law Board, has opposed the petitions, arguing that allowing these lawsuits would lead to widespread litigation targeting mosques across the country. The Anjuman Intezamia Masjid, responsible for managing the Gyanvapi mosque, has also intervened in the case to urge the dismissal of these pleas.
One of the petitioners raised concerns about the Act's exclusion of certain religious sites, claiming inconsistency in how the law treats different religious communities. The petitions also argue that the law unjustly limits the rights of Hindu, Jain, Buddhist, and Sikh communities while allowing Muslim communities to reclaim religious properties through separate provisions, such as those in the Waqf Act.
In essence, the petitioners contend that the Places of Worship Act not only violates several fundamental rights under the Constitution, including the rights to religious freedom, cultural heritage, and judicial remedy, but it also perpetuates an arbitrary and unjust status quo that prevents religious communities from reclaiming or managing their sacred spaces.

Allahabad High Court on Friday denied to grant an interim stay on the Varanasi court order allowing Hindu prayers in the southern cellar of the Gyanvapi mosque. It asked the Muslim side to amend its plea and adjourned the hearing till February 6.
Justice Rohit Ranjan Agrawal asked the Anjuman Intezamia Masajid Committee which looks after the affairs of the mosque, to first challenge the January 17 order as a result of which the court issued an order on January 31 that allowed Hindu worshippers to conduct rituals in one of the sealed cellars.
The Anzuman Intezamia Masjid Committee had moved the high court within hours of the Supreme Court refusing to hear their plea against the Varanasi district court's order and asking them to approach the high court.
The Varanasi court had ruled on January 31 that a priest can perform prayers before the idols in the southern cellar of the Gyanvapi mosque.
Appearing on behalf of the committee, advocate S F A Naqvi submitted before the court that the order was passed in a "very hurried manner" and on the day of retirement of the judge concerned.
Varanasi district judge Ajaya Krishna Vishvesha retired from service on January 31.
Naqvi further submitted that while passing the impugned order, district judges had not considered their documents.
Advocate Vishnu Shankar Jain, representing the Hindu side, pointed out that the district court by means of order dated January 17 had appointed District Magistrate, Varanasi receiver of the property in pursuance of which he took possession of the same on January 24, reports PTI news agency.
He argued that the order passed on January 31 is only a consequential order. The order dated January 17 has not been challenged, thus the appeal is not maintainable.
On this, Naqvi said he has to move an amendment application challenging the order dated January 17 also.

The committee overseeing the affairs of Gyanvapi mosque in Varanasi on Thursday approached the Allahabad High Court, challenging the &nbsp;Varanasi District Court order allowing Hindus to perform prayers in the southern cellar of the mosque, Live Law news outlet reported&nbsp;
They have sought an urgent listing of the plea.
It comes a day after the Supreme Court declined to entertain the committee&rsquo;s urgent application seeking a status quo in the matter and asked their counsel to approach the high court. Earlier in the day, prayers were performed before the idols in the 'Vyas Tehkhana'.
&nbsp;Kashi Vishwanath temple trust president Nagendra Pandey told PTI news agency&nbsp;that prayers were performed in the basement. "It was necessary to follow the court's orders, so the district administration made all the arrangements with great promptness," Pandey said.
District Magistrate S Rajlingam said, "I have complied with the court's order."
Some locals claimed that after cleaning the cellar, an 'aarti' of Goddess Lakshmi and Lord Ganesh was performed.
Official sources in the district administration told PTI news agency that at around 9.30 pm on Wednesday, the members of the Kashi-Vishwanath temple trust were called and the barricades before the Nandi statue facing the mosque's 'wazukhana' were removed.
The court had directed the local administration to make arrangements within seven days for prayers in the cellar. This will involve "proper arrangements" with metal barricades at the complex, it said.

The Allahabad High Court on Thursday reserved till August 3 its order on a plea against the survey of Gyanvapi mosque premises by the Archeological Survey of India.
The court also ordered the ASI to stay the survey work till then.
Chief Justice Pritinker Diwaker heard the matter in the afternoon session and reserved his verdict till August 3.
The high court was hearing a plea against a Varanasi district court order directing the ASI to conduct a survey to determine if the Gyanvapi mosque was built upon a temple.
The court heard the arguments from Anjuman Intezamia Masjid, which manages the mosque, and the Hindu side. Senior ASI officials were also present in the courtroom.
The high court on Wednesday said that it would take up the matter at 3:30 pm on Thursday, but Chief Justice Diwaker started hearing the case 15 minutes in advance and reserved its order before concluding the day's proceedings at 5 pm.

Earlier, the Varanasi district court had ordered an ASI study to see if the mosque was built over a pre-existing Hindu temple.

She claimed that the other Hindu petitioners in the case had defamed her by claiming that she was withdrawing the case.
Rakhi said that this had caused her immense mental pain and agony, and so, she should be allowed to "attain ultimate peace by sleeping eternally".

Five women had filed the petition seeking permission for daily worship of Hindu deities whose idols are claimed to be located on an outer wall of the Gyanvapi mosque. The Anjuman Intezamia Masjid Committee had questioned the maintainability of plea and said that the mosque is a Waqf property. 
Madan Mohan Yadav, a lawyer of the Hindu side, had claimed that the mosque was constructed after demolishing the temple.
The case is being heard by the district court following an apex court order.
Earlier, a lower court had ordered a videographic survey of the complex. The survey work was completed on May 16 and the report was presented in the court on May 19.
The Hindu side had claimed in the lower court that a Shivling was found during the videographic survey of the Gyanvapi mosque-Shringar Gauri complex but it was contested by the Muslim side.
Police Commissioner A Satish Ganesh had on Sunday said prohibitory orders have been clamped in the Varanasi commissionerate area and officers have been asked to interact with religious leaders in their respective areas to ensure that peace is maintained.
To maintain law and order, the entire city has been divided into sectors which have been allocated police force as required, he said, adding directives for flag march and foot march in sensitive areas have also been issued.
Checking has been intensified in the district's border areas, hotels and guest houses, while an eye is being also kept on social media, the police officer said.
