The Allahabad High Court adjourned to August 6 the hearing on a plea seeking an ASI survey of the Gyanvapi mosque's wuzukhana area, following the Supreme Court&rsquo;s interim directive.

The Allahabad High Court on Friday deferred to August 6 the hearing over the ASI survey of the wuzukhana (ablution pond) area except for the Shiva Linga inside the Gyanvapi mosque.
On Friday when matter was taken up, the court was informed by one of the counsel that the Supreme Court's interim order was in operation.
The Supreme Court in its interim order had barred any court from passing effective interim orders or final orders including orders directing surveys, etc., till its further directions.
Following the submission, Justice Rohit Ranjan Agarwal adjourned the matter while acting in a revision plea filed by Rakhi Singh, who is one of the plaintiffs before a Varanasi court.
The plea challenges a Varanasi judge order of October, 2023 which refused to direct the Archeological Survey of India (ASI) to survey the wuzukhana (ablution) area except for the structure which the Hindu side calls a Shivling and the Muslims describe as a fountain inside the Gyanvapi mosque located adjacent to the Kashi Vishwanath temple.

The high court had observed that the Uttar Pradesh government's 1993 decision of stopping worship rituals inside the Vyas Tehkhana was illegal.

The Supreme Court on Monday refused to stay the Hindu prayers in the southern cellar of the Gyanvapi mosque and sought response of the Kashi Vishwanath Temple trustees on the plea of the mosque management committee.
The top court also ordered maintaining of status quo on offering of namaz by Muslims in the Gyanvapi premises in Varanasi.
The court was hearing a fresh plea of the Gyanvapi mosque management committee against an Allahabad High Court decision upholding a lower court's order allowing Hindu prayers in the southern cellar of the mosque.
A bench headed by Chief Justice D Y Chandrachud also sought response of priest Shailendra Kumar Pathak Vyas by April 30 on the plea of the mosque committee.
The bench, which also comprised Justices J B Pardiwala and Manoj Misra, was hearing the plea of the mosque committee which manages the affairs of the Gyanvapi mosque in Varanasi.
The high court, on February 26, had dismissed the committee's plea in which it had challenged the district court's January 31 order allowing Hindus to offer prayers in the cellar.
While dismissing the plea of the mosque committee, the high court had observed that the Uttar Pradesh government's 1993 decision of stopping worship rituals inside the "Vyas Tehkhana" -- located at the southern cellar of the Gyanvapi -- was "illegal".

The Supreme Court has agreed to hear an appeal by the Gyanvapi mosque committee against the Allahabad High Court order.

The Supreme Court on Friday agreed to hear an appeal of the Gyanvapi management committee against an Allahabad High Court order which held that lawsuits for "restoration" of a temple where the mosque stands in Varanasi are maintainable.
"We will tag this with the main case," a bench comprising Chief Justice D Y Chandrachud and justices J B Pardiwala and Manoj Misra said.
The plea in the top court was filed by the Anjuman Intezamia Masjid, the committee which manages the affairs of the Gyanvapi mosque.
On December 19 last year, the Allahabad High Court had dismissed pleas challenging the maintainability of a 1991 suit seeking the "restoration" of a temple at the site where the Gyanvapi mosque stands.
The HC had said that the "religious character" of a disputed place can only be decided by the court.
It had dismissed five related petitions -- on maintainability and also against a survey of the mosque premises -- filed over the years by the mosque committee and the Uttar Pradesh Sunni Central Waqf Board.
The HC had held that the suit filed before the district court is not barred by the Places of Worship (Special Provisions) Act, 1991, which forbids "conversion" of the "religious character" of a place from what existed on August 15, 1947.

The suit was filed by petitioners seeking the right to worship in the Gyanvapi mosque adjoining the Kashi Vishwanath temple. Muslim litigants had challenged its maintainability, citing the Places of Worship (Special Provisions) Act.&nbsp;

The prayers began earlier this month after 31 years following a Varanasi district court order.

The Allahabad High Court on 26th February rejected a plea by the Anjuman Intezamia challenging permission granted to Hindus to offer prayers in the southern cellar known as 'vyas tehkhana' of the Gyanvapi mosque complex.
With this, the prayers, which began after 31 years following a Varanasi district court order, will continue.
The court said that the state government's 1993 order of stopping worship rituals inside Vyas Tehkhana was illegal.
Dismissing both the appeals, Justice Rohit Ranjan Agarwal said, "After going through the entire records of the case and considering the arguments of the parties concerned, the court did not find any ground to interfere in the judgment passed by the district judge on January 17, appointing the Varanasi district magistrate as the receiver of the property, as well as the order dated January 31 by which the district court permitted puja in the tehkhana." Justice Agarwal had reserved his verdict in the matter on February 15 after hearing the counsel for the parties.

The Allahabad High Court will pronounce its judgement on February 26 on a plea challenging the Varanasi district court's order allowing Hindu prayers at Vyas Tehkhana (southern cellar) of the Gyanvapi complex.
A bench of Justice Rohit Ranjan Agrawal had reserved the judgment after hearing both parties on February 15.
The Varanasi district court had on January 31 ruled that a priest can perform prayers before the idols in the southern cellar of the Gyanvapi mosque. The mosque committee moved the court to challenge the verdict.&nbsp;
The whole dispute stems from the 'Somnath Vyas' tehkhana inside Gyanvapi Mosque premises. The Hindu side claims that until 1993, religious ceremonies were conducted in the basement. But, in compliance with a directive from the state government, the religious practices were discontinued.
The cellars mentioned in the Hindu side's latest petition were not surveyed during the recent scientific survey of the Gyanvapi mosque complex carried out by the ASI. The said cellars have not been accessed yet due to blocked entrances and debris, the petitioner submitted before the Varanasi court.

The Allahabad High Court on Tuesday dismissed pleas challenging the maintainability of a 1991 civil suit pending before a Varanasi court seeking "restoration" of a temple at the site where the Gyanvapi mosque exists, while observing that the religious character of the disputed place can only be decided by the court.
Justice Rohit Ranjan Agarwal held that the suit filed before the district court is maintainable and not barred by The Places of Religious Worship Act, 1991.
The court said the dispute raised in the suit is of "vital national importance" as it affects two major communities of the country and directed the lower court to decide the suit expeditiously preferably within six months.
"No unnecessary adjournment shall be granted to any of the parties", it said.
"Interim order, if any, is vacated. ASI to submit its report before lower court. If required, the lower court may direct ASI for further survey," it said.

In a relief to the Hindu side, the Supreme Court on Friday refused to stay the Allahabad High Court order allowing the Archaeological Survey of India (ASI) to conduct a scientific survey at the Gyanvapi mosque complex to determine if the 17th-century structure was built upon a pre-existing temple.
A bench comprising Chief Justice D Y Chandrachud and Justices J B Pardiwala and Manoj Misra asked the ASI not to take recourse to any invasive act during the survey.
The bench took note of the submissions of Solicitor General Tushar Mehta, appearing for the ASI and the Uttar Pradesh government, that no excavation will be carried out during the survey nor any destruction caused to the structure.&nbsp;
