The court that was reshaped by former presidential candidate and Republican Gov. Ron DeSantis on Monday ruled that the 15-week ban signed by DeSantis in 2022 can take effect. The ban has been enforced while it was being challenged in court. A six-week ban passed in the 2023 legislative session was written so that it would not take effect until a month after the 2022 law was upheld.
Most abortions are obtained before the 15-week mark, so the current ban does not affect most people seeking abortion. But a six-week ban would likely have a major impact on women seeking abortions in Florida and throughout the South.
DeSantis appointed five of the court's seven justices.
The lawsuit was brought by Planned Parenthood, the American Civil Liberties Union and others. They argued the Florida Constitution's unique privacy clause for more than 40 years has explicitly protected a right to abortion in the state and should remain in force.
Lawyers for the state, however, said when the privacy clause was adopted by voter referendum in 1980, few people understood it would cover abortion. They told the justices the clause was mainly meant to cover &ldquo;informational privacy&rdquo; such as personal records and not abortion.
Since the US Supreme Court overturned Roe v. Wade in June 2022, most Republican-controlled states have adopted bans or restrictions on abortions. Every ban has faced a court challenge.
A survey of abortion providers conducted for the Society of Family Planning, which advocates for abortion access, found that Florida had the second-largest surge in the total number of abortions provided since Roe v. Wade was overturned. The state's data shows that more than 7,700 women from other states received abortions in Florida in 2023.
The neighbouring or nearby states of Alabama, Louisiana and Mississippi are among the 14 states with bans now in place on abortion in stages of pregnancy, with limited exceptions. Georgia and South Carolina bar it once cardiac activity can be detected, which is generally considered to be around six weeks into pregnancy and often before women realise they're pregnant.

Those 13 years old and younger will not be able to open a social media account in the state, and 14- and 15-year-olds will need parental consent to use such platforms.
Despite worries about social media, the law has also raised free speech concerns and comes at a time when right-wing state governments have pushed controversial "parental rights" legislation, notably affecting education.
Lawmakers, DeSantis said, were "trying to help parents navigate this very difficult terrain that we have now with raising kids."
Speaker of the Florida House Paul Renner said that social media is fraught with risks from traffickers and paedophiles, and that "social media platforms have caused a devastating effect on the mental well-being of our children."
Most platforms require users to be 13 or older, though they do little in terms of enforcement.
Across the country, there has been rising concern about the effects of social media on child and teen development and learning.
But the law has also sparked concerns among those worried it sets a precedent for restricting free speech online.
DeSantis, who ran an unsuccessful campaign for president and dropped out in January, has argued many times that parents should have more control over decisions affecting their children, particularly in education.
Parental rights legislation in Florida and other states has sought to give parents more input in areas deemed controversial, especially education around LGBTQ topics in schools.
While the social media ban gives parents oversight on the matter, others say that the government should stay out of such fights altogether.
DeSantis previously vetoed a stricter social media ban, which would have blocked access for those under age 16.
He said at the time that a better balance was needed between competing parental rights, privacy issues and free speech.

A young girl was buried in sand and died Tuesday when a deep hole she was digging with a little boy collapsed on them both at a south Florida beach, authorities said.
Emergency crews responding around 3 p.m. to Lauderdale-by-the-Sea found the boy, who is about 8 years old, buried up his chest in sand, said Sandra King, a spokesperson for Pompano Beach Fire Rescue.
The girl, about 7 years old, was completely buried underneath the boy, King told the South Florida Sun-Sentinel.
The hole was 5 or 6 feet (1.8 meters) deep when the collapse happened, she said.
Rescuers used support boards to keep more sand from collapsing in as they used shovels to dig the children out, King said. She didn&rsquo;t know how long they were buried.
The girl was rushed to Broward Health Medical Center in Fort Lauderdale, where she was pronounced dead, King said. The boy was hospitalized in stable condition.
It wasn&rsquo;t immediately known whether an adult was helping the children dig the hole.

At the time of the attack, Tekashi didn&rsquo;t have any security with him. According to the TMZ report, gym staff heard the commotion and immediately notified a manager. Police and emergency medical services arrived at the gym and transported Tekashi to the hospital.

The confirmed number of storm-related deaths rose to 44 statewide, the Florida Medical Examiners Commission said late Saturday, but reports of additional fatalities were still emerging county by county -&ndash; pointing to a far higher final toll.
Hard-hit Lee County alone recorded 35 deaths, according to its sheriff, while US media including NBC and CBS tallied more than 70 deaths either directly or indirectly related to the storm.
In the coastal state of North Carolina, the governor's office confirmed four deaths related to Ian there.
Biden and his wife, Jill, will visit Florida on Wednesday, White House Press Secretary Karine Jean-Pierre tweeted, but the couple will first head to Puerto Rico on Monday to survey the destruction from a different storm, Hurricane Fiona, which struck the US territory last month.
In Florida's Lee County on Saturday, rescuers and ordinary citizens in boats were still saving the last trapped inhabitants of the small island of Matlacha. Debris, abandoned vehicles and downed trees littered the pummeled hamlet's main street and surroundings that are dotted by colorful wooden houses with corrugated roofs.
The community, home to about 800 people, was cut off from the mainland following damage to two bridges, and those who fled early were only just beginning to return home to survey the destruction.
More than 900,000 customers remained without power in Florida Saturday night, hampering efforts by those who evacuated to return to their homes to take stock of what they lost.
In Fort Myers Beach, a town on the Gulf of Mexico coast which took the brunt of the storm, Pete Belinda said his home was "just flipped upside down, soaking wet, full of mud."

Biden said the storm could up as the “deadliest hurricane in Florida's history.” During a visit to the headquarters of the Federal Emergency Management Agency, where he was briefed on federal response efforts, the president said, “The numbers are still unclear, but we're hearing early reports of what may be substantial loss of life.”
