Elgar Parishad-Maoist links case accused and former Nagpur University professor Shoma Sen was released from a prison in Mumbai on Wednesday afternoon, an official said.
The Supreme Court had granted bail to her in the 2018 case on April 5.
Sen walked out of the Byculla jail in central Mumbai after the completion of all formalities, the senior prison official said.
She was greeted by her daughter and relatives outside the prison.
Sen was one of the 16 persons including activists and academics arrested in the case, related to the Elgar Parishad conclave held in Pune on December 31, 2017. Pune Police had alleged that the conclave was backed by Maoists, and the 'inflammatory' speeches made there fuelled caste violence near the Bhima Koregaon war memorial in Pune district next day.

The case relates to alleged inflammatory speeches delivered at the Elgar Parishad conclave in Pune in 2017 which allegedly triggered violence the next day near the Koregaon-Bhima war memorial.

The Supreme Court on Friday granted bail to academic- activist Shoma Kanti Sen, who was arrested in June 2018 in connection with the Elgar Parishad-Maoist links case.
A bench of Justices Aniruddha Bose and Augustine George Masih directed that she be released on bail on such conditions as the special court may consider fit and proper.
It said the conditions shall include that Sen shall not leave the state of Maharashtra without the permission of the special court.
"The appellant (Sen) shall inform the investigation officer of the NIA about the address where she shall reside during the period she remains enlarged on bail," the bench said while pronouncing the order.
It said she shall use only one mobile phone number during the bail period and share it with the investigating officer.
"The appellant shall also ensure that the mobile remains active and charged round the clock so that she remains constantly accessible throughout the period she remains enlarged on bail," it said.
"During this period, that is the period during which she remains on bail, the appellant shall keep the location status, that is GPS of her mobile phone, active 24 hours a day and her phone shall be paired with that of the investigating officer of the NIA to enable him at any given time to identify the appellant's exact location," the bench said.
It directed that while on bail, Sen shall report to the station house officer of the police station, within whose jurisdiction she shall reside, once every fortnight.
"In the event there is breach of any of these conditions or any other conditions that may be imposed by the special court independently, it would be open for the prosecution to seek cancellation of bail granted to the appellant before the special court&hellip;," the bench said.
Sen, an English literature professor and women's rights activist, was arrested in connection with the case on June 6, 2018.
The case relates to alleged inflammatory speeches delivered at the Elgar Parishad conclave held at Shaniwarwada in Pune on December 31, 2017 which police claimed triggered violence the next day near the Koregaon-Bhima war memorial located on the city's outskirts.
The Pune Police had claimed that the conclave was backed by Maoists.
The probe in the case, in which more than a dozen activists and academicians have been named as accused, was transferred to the National Investigation Agency (NIA).

Activist Gautam Navlakha, who has been accused in the Elgar Parishad case, was granted bail by Bombay High Court. However, the bail order has been stayed for three weeks during which NIA can challenge it in the Supreme Court.

The Bombay High Court in its judgment granting bail to activist Gautam Navlakha, an accused in the Elgar Parishad-Maoist links case, has noted that there was no material on record to infer prima facie that he conspired to or committed any terrorist act.
A division bench of Justices A S Gadkari and S G Dige granted bail to Navlakha on Tuesday. The full text of the judgement became available on Wednesday.
"From the material on record, it appears to us that no covert or overt terrorist act has been attributed to the appellant (Navlakha)," the high court said.

Navlakha, arrested in the case in August 2018, was in November 2022 permitted by the Supreme Court to be placed under house arrest. He is presently residing in Navi Mumbai, Maharashtra.
While granting him bail, the bench stayed the order for three weeks so that the National Investigation Agency (NIA) could approach the Supreme Court in appeal.
"We are of the prima facie opinion that on the basis of the material placed before us by the NIA, it cannot be said that there are reasonable grounds for believing that the accusation against the appellant is prima facie true," the judgement said.
"According to us, the record prima facie indicates that it was at the most the intention of the appellant to commit the alleged crime and not more than it. The said intention has not been further transformed into preparation or attempt to commit a terrorist act," the court said.
The witness statements at the most indicated that Navlakha was a member of the CPI (Maoist) which would attract only the provisions of sections 13 (participating in an unlawful activity) and 38 (membership of a terrorist organization) of the Unlawful Activities (Prevention) Act, the judges noted.
Both these sections provide for a maximum punishment not exceeding ten years.
The court also remarked that the documents, which have not been recovered from Navlakha but mention his name, have "weak probative value or quality".
"The content of these letters/documents through which the appellant is sought to be implicated are in the form of hearsay evidence, as they are recovered from co-accused," it said.
Through these documents and communications, the NIA was trying to establish Navlakha's association with the activities of a terrorist organization.
"The actual involvement of the appellant in any terrorist act cannot be even inferred from any of the communications and or statements of the witnesses. According to us, there is no material to infer conspiracy to commit an offence as contemplated under Chapter IV of the UAPA (terrorist activities)," the HC said.
It cannot even be said at this stage that the provisions of sections 15 (terrorist act), 18 (conspiracy) or 20 (being member of a terrorist organization) can be "prima facie" applied to Navlakha, it said.
The bench also cited the Supreme Court order granting bail to co-accused Vernon Gonsalves which said mere possession of literature, even if the content thereof inspires or propagates violence, by itself cannot constitute any offence under the UAPA.
"Therefore, in the present case, the said documents which have been recovered from the appellant (Navlakha) such as Agenda or Constitution of the Party or other related documents, which allegedly propagated violence, would not attract the provisions of section 15 of the UAPA (terrorist act)," the court said.

In some of the documents and letters addressed to each other by the co-accused, the name "Gautam" could be another person by the name Gautam @ Sadha who is a central committee member of the CPI (Maoist), it said.
"Therefore, it cannot be safely inferred that it is the appellant (Navlakha) who has been referred to in those documents. At this stage prima facie, we cannot presume that 'Gautam' is the same person as the identity of the said 'Gautam' is yet to be established beyond reasonable doubt by the prosecution," the HC said.
Referring to the documents submitted by the NIA where the writers have expressed their intention to cause fatality to politically influential persons or cause tremendous disturbance in society at large, the court said, "The appellant only being a member of the party cannot be prima facie held to be a co-conspirator to it." The court also refused to accept the NIA's claim that Navlakha had connections with Pakistan's Inter-Services Intelligence (ISI) as he had written a letter to a US court judge seeking clemency for Ghulam Fai (a US-based Kashmiri separatist).
It appeared that Navlakha had written the letter in his individual capacity, and at the most it can be said, being a member of his party, the judges said.
He was in jail for three years and the trial court was yet to frame charges in the case, and hence the possibility of the trial being concluded in near future was very bleak, the court said.
The case against Navlakha and others originally related to alleged inflammatory speeches made at the Elgar Parishad conclave held in Pune on December 31, 2017. Pune Police, who probed the case initially, claimed that the conclave had been backed by the Maoists, and the speeches triggered caste violence the next day near the Koregaon-Bhima war memorial in Pune district.

The Bombay High Court has granted bail to the Elgaar Parishad case accused Gautam Navlakha on December 19. The court also stayed NIA's move to knock at the Supreme Court door against the bail granted to the social activist. The court allowed the bail appeal of Navlakha, a journalist and rights activist, against the special court order that had denied him bail. The NIA has sought a six-week stay on the order, however, the HC bench comprising of Justice Ajey S Gadkari and Shivkumar G Dige granted only three weeks' time to the central probe agency. Since his arrest in April 14, 2020, Navlakha has been in custody. Out of 16 accused in the Elgaar Parishad case, Navlakha is the seventh accused who has been granted bail either by the Supreme Court or a &nbsp;high court. The two-judge bench concluded the hearing on November 7 and gave the verdict on December 19. Setting aside the September 5, 2022 order of the special court, the HC asked the special judge to restore Navlakha's bail application and reserve a decision within four weeks. 16 people were accused in the Elgar Parishad case of which nine were arrested by Pune police and seven others were arrested by the NIA after the investigation agency took over the case.

Gautam Navlakha, an accused in Elgar Parishad-Maoist links case, was released from Taloja prison in Navi Mumbai on Saturday evening and will live under house arrest for a month.
He was immediately taken to a building in Navi Mumbai's Belapur-Agroli area by a police team where he would be staying.
Navlakha left the prison around 6 pm, said a senior prison official.
On Friday afternoon, the Supreme Court had rejected the NIA's application opposing his house arrest. It had ordered that Navlakha be placed under house arrest "without fail" within 24 hours.

The Bombay High Court on Friday granted bail to scholar-activist Anand Teltumbde, arrested in the Elgar Parishad-Maoist links case.
The high court, however, stayed its order for a week so that the National Investigation Agency (NIA), the prosecuting agency, can approach the Supreme Court. This means that Teltumbde will not be able to walk out of jail till then.
A division bench of Justices A S Gadkari and M N Jadhav allowed the bail plea filed by 73-year-old Teltumbde, who has been in jail since his arrest in the case in April 2020.
The court granted him bail on a surety of Rs one lakh.
The NIA sought the court to stay its order for one week so that it can appeal in Supreme Court. The bench accepted this and stayed its order for a week.

Teltumbde, who is presently lodged at the Taloja prison in Navi Mumbai, had moved the high court last year after a special court refused to grant him bail.
In his plea, Teltumbde had claimed that he was never present at the December 31, 2017 Elgar Parishad event held in Pune nor made any provocative speeches.
The prosecution's case is that provocative and inflammatory speeches were made at the event that was allegedly backed by banned terror outfit CPI (Maoist), which later led to violence at Koregaon Bhima village near Pune.
Teltumbde is the third accused in the case to be granted bail. Poet Varavara Rao is out on a medical bail and lawyer Sudha Bharadwaj is out on regular bail.

There existed no evidence to even suggest that he intended to or supported activities to cause disaffection against India, the plea said.
The NIA had opposed the bail plea, arguing that Babu actively participated in activities to promote Naxalism and wanted to overthrow the government.
Additional Solicitor General (ASG) Anil Singh, appearing for the NIA, had claimed Babu was a member of the banned outfit CPI (Maoist) and the prosecution seized material from his laptop to show he was in constant contact with other accused in the case.
Hany Babu wanted to promote and expand Naxalism and was part of the conspiracy to wage a war against India by overthrowing the elected government, Singh said.
He along with others wanted to set up "Janata Sarkar" i.e. people's government by arms struggle, Singh had told the court.
The ASG had also argued that Babu used to train other members of the outfit on how to avoid phone tapping.

One of the accused in the case, tribal rights activist Father Stan Swamy, who was suffering from similar ailments as the petitioner, passed away even before the trial could start in 2021.

The Supreme Court on Monday agreed to list a medical bail plea for hearing on Tuesday filed by activist and an accused in the Bhima Koregaon-Elgar Parishad case, P Varavara Rao, challenging the Bombay High Court order rejecting his prayer for permanent medical bail in the matter.&nbsp;
A bench headed by Justice U.U. Lalit responded to Solicitor General Tushar Mehta who requested that he be allowed to place on record a compilation of documents and the matter be heard tomorrow.&nbsp;
"Allow me to place it on record and have it tomorrow. His interim protection is till tomorrow," Mehta told the bench, also comprising Justices S R Bhat and Sudhanshu Dhulia.&nbsp;
Senior advocate Anand Grover, appearing for Rao, said he has no objection to this. "Can it be taken up today? I am ready, my friend is ready. We can finish it today," Grover said.&nbsp;
In his plea filed through advocate Nupur Kumar against the April 13 order of the high court, Rao has said, "The petitioner is an 83-year-old renowned Telugu poet and orator, who has undergone over two years of incarceration as an under-trial, and is currently enlarged on bail on medical grounds by the Bombay High Court respectfully submits that any further incarceration would ring the death knell for him as an advancing age and deteriorating health are a fatal combination".&nbsp;
The plea said Rao has challenged the high court order as he was not granted an extension of bail despite his advanced age and precarious health condition, and his prayer to shift to Hyderabad was also denied.&nbsp;

He was arrested on August 28, 2018 from his Hyderabad residence and is an under-trial in the Bhima Koregaon case for which an FIR was lodged by Pune police on January 8, 2018 under various sections of the Indian Penal Code (IPC) and the Unlawful Activities (Prevention) Act (UAPA).&nbsp;
The case pertains to alleged inflammatory speeches made at the Elgar Parishad conclave held in Pune on December 31, 2017, which, the police claimed, triggered violence the next day near the Koregaon-Bhima war memorial located on the outskirts of the western Maharashtra city.&nbsp;
The Pune police had also claimed that the conclave was organised by people with alleged Maoist links. Later, the National Investigation Agency took over the probe in the matter.&nbsp;
Initially, Rao said he was put under house arrest pursuant to an order of the apex court and ultimately, on November 17, 2018, he was taken into police custody and later, shifted to the Taloja jail. On February 22, 2021, the Bombay High Court had granted him bail on medical grounds and he was released from jail on March 6, 2021. &nbsp; On April 13, the high court had rejected the plea but extended the time for the activist to surrender before the Taloja prison authorities by three months, to enable him to undergo cataract surgery. It had also dismissed Rao's application seeking that he be permitted to stay in Hyderabad instead of Mumbai, while out on bail.&nbsp;

Bharadwaj was released from the Byculla women's prison after the NIA court set bail conditions yesterday. She is the first to be granted default bail in the case.
The Supreme Court had two days ago rejected the National Investigation Agency's plea to stay the default bail granted to her by the Bombay High Court on December 1.
Father Stan Swamy, 84, also arrested under UAPA in the case, died in July while fighting for bail on health grounds.
Another accused in the case, political activist and poet Varavara Rao, was granted bail on medical grounds earlier this year.
Sudha Bharadwaj was arrested on August 28, 2018, and was later placed under house arrest. She was then taken into custody on October 27, 2018.

Swamy&rsquo;s lawyers had moved the Bombay High Court on Monday morning, seeking an urgent hearing on his medical bail plea after the 84-year-old's health took a turn for the worse on Sunday and he was put on ventilator support. Swamy had sought interim bail on grounds of the pandemic citing his various health issues, including Parkinson&rsquo;s disease.
