The Editors Guild of India on January 18 urged the government to &ldquo;expunge&rdquo; the draft amendment to the IT Rules asking social media companies to take down news articles that have been deemed "fake" by the Press Information Bureau (PIB).
"The Guild urges the Ministry to expunge this new amendment, and to initiate meaningful consultations with press bodies, media organisations and other stakeholders, on the regulatory framework for digital media, so as to not undermine press freedom," a statement issued by the Editors Guild of India said. "At the outset, determination of fake news cannot be in the sole hands of the government and will result in the censorship of the press," the Guild said in a statement here, voicing "deep concern" over the draft amendment to the Information Technology (IT) Rules.
It said that already multiple laws exist to deal with content that is found to be factually incorrect.
"This new procedure basically serves to make it easier to muzzle the free press, and will give sweeping powers to the PIB, or any &lsquo;other agency authorised by the Central government for fact checking&rsquo;, to force online intermediaries to take down content that the government may find problematic," the Guild said.
The Ministry of Electronics and Information Technology (MeitY) on January 17 released a modification to the draft Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 it had previously released for public consultation.

The Editors of Guild of India has approached the Supreme Court with a public interest litigation seeking a court monitored probe by a Special Investigation Team into the Pegasus snooping row.&nbsp;
Challenging the Constitutional powers of the government for authorising such interception, the PIL has sought SC directives to the Centre to show the orders produced authorising monitoring &amp; hacking of electronic devices of Indian citizens under the relevant law.
The PIL seeks a list of all those monitored in such a way and the reason behind the said surveillance, along with details of those who selected the citizens to be monitored and those who authorised the monitoring.&nbsp;
"The citizens of India have a right to know if the Executive government is infringing the limits of their authority under the Constitution," the Guild submitted in its plea.&nbsp;
The PIL has also sought details of all agreements the Centre has entered with foreign companies for the purchase of surveillance tools for use on Indian citizens with straightforward answers on the purchase of spyware from the NSO Group.&nbsp;
The journalistic body told the top court that the government has avoided public debate on the issue with obfuscated answers and all attempts to seek accountability trough Parliamentary processes have been stonewalled.&nbsp;
This is the 4th PIL in the top court in relation to the Pegasus snooping. Rajya Sabha MP John Brittas, journalists N Ram and Sashi Kumar and advocate ML Sharma had also approached the court. A bench led by Chief Justice of India will consider a judicial probe into the matter on August 5th.&nbsp;

The Editors Guild of India on Sunday hit out at the Yogi Adityanath government in Uttar Pradesh, alleging that the law enforcement agencies under it "prevented" media persons from reporting on developments in and around Hathras in connection with the alleged sexual assault and murder of a Dalit woman.
In a statement, the Guild said not allowing the media to visit the incident spots and tapping the phone conversations of journalists undermine and obstruct the functioning of the media.
The Guild demanded that the government create conditions in Hathras that do not obstruct journalists in any way.
