The Centre is reportedly planning to include digital media in the Registration of Press and Periodicals Bill to regulate and hold it accountable for “violations”. The bill with these changes is likely to be presented before the Cabinet soon. 

Centre to regulate digital media, proposes changes in 2019 press bill

The new bill, if passed, will require digital media to register with the Press Registrar General within 90 days of the law coming into effect which will have powers to&nbsp;suspend or cancel their registrations and impose penalties.&nbsp;

The Centre is reportedly planning to include digital media in the Registration of Press and Periodicals Bill to regulate and hold it accountable for &ldquo;violations&rdquo;. The bill with these changes is likely to be presented before the Cabinet soon.&nbsp;
The new bill, if passed, will require digital media to register with the Press Registrar General (PRG) within 90 days of the law coming into effect. &nbsp; PRG is the equivalent of the Registrar of Newspapers for India (RNI) which is a statutory body of the Ministry of Information and Broadcasting that regulates and monitors the printing and publication of newspapers in the country. &nbsp; This body will have powers to act against digital media for &ldquo;violations&rdquo;, suspend or cancel their registrations, and impose penalties on them.&nbsp;
The Information and Broadcasting ministry, which in this case will be the "administrative ministry", will reportedly amend the bill to include "news on digital media through any electronic device" to effectively bring digital media under government regulation. &nbsp;
The government is also planning to have a board of appeal to be headed by the Chairperson of the Press Council of India, as per media reports.&nbsp;
In 2019, the Centre put out a draft of the same bill that defined news on digital media as &ldquo;news in digitised format that can be transmitted over the internet, computer or mobile networks and includes text, audio, video and graphics".&nbsp;
The draft had sparked a huge controversy with critics calling it out as an attempt to &lsquo;control&rsquo; digital news media. The widespread reproval ultimately led to the bill being put on the back-burner.&nbsp;

It has submitted that although the right to freedom of speech and expression, including the freedom of press, is critical for a vibrant democracy, citizens "cannot be treated as passive consumers."
The Centre submitted that there have been "past incidents of disinformation on digital media leading to disturbance of public order". It has asserted that digital media "allows sensational content being re-circulated in a different context leading to misinterpretation by the audience", making it susceptible to being used as fake news.
"IT Rules seek to prevent the misuse of the freedom of press by empowering the audience with a mechanism to raise their grievances related to the content being published by the digital news publishers through a grievance redressal mechanism with an emphasis on the self-regulatory architecture for digital news publishers, and are therefore not only within the ambit of the Act, but also fulfill the object sought to be achieved by the (IT) Act," said the affidavit recently filed jointly by the Ministry Of Information and Broadcasting and Ministry Of Electronics and Information Technology.
"Before the notification of the Rules, digital news media was largely unregulated. It is submitted that before the notification of the Rules, no such mechanism was currently in operation with regard to news on digital media, thereby leading to a discriminatory imbalance within the news media ecosystem with respect to content on traditional media," it added.
The Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, which were notified in February, impose several obligation on online entities including an obligation to take down contentious content quicker, appoint grievance redressal officers and assist in investigations.
In its affidavit, the Centre has claimed that the regulation of media content in the electronic form, including news and current affairs content and online curated content, is well within the scope of the IT Act and the new rules do not provide any additional restrictions apart from what is already prohibited by existing statutes.
The Centre has argued that as opposed to the traditional media, the reach of digital media is "far wider as compared to traditional media" which "makes it a powerful tool for information campaigns by foreign state and non-state actors to influence public opinion in any nation".

The Delhi High Court on Monday declined to stay the Centre&rsquo;s May 28 notice asking digital news portals to comply with the new IT Rules 2021. The court said it was not in agreement with the petitioners on passing such an order at this stage.
Foundation for Independent Journalism, The Wire, Quint Digital Media Ltd and Pravda Media Foundation, parent company of Alt News, sought a stay on the Information technology Rules, 2021, on the ground that a fresh notice has been issued to them to comply with the rules or else coercive action will be taken.
A vacation bench said the notice has been issued to them only for implementation of notification on which there was no stay.
