A bench consisting of Justices Vikram Nath, Sanjay Karol, and Sandeep Mehta ordered Hussain's release from jail under the jail manual timing upon the deposit of approximately 2 lakh per day (12 hours).&nbsp;
Hussain is facing charges in the murder case of Intelligence Bureau (IB) officer Ankit Sharma during the 2020 North-East Delhi riots, which led to 53 deaths and many injuries. Hussain has been named in 11 FIRs related to the riots.
Tahir Hussain is contesting the Delhi Assembly elections against BJP's Mohan Singh Bisht, an incumbent MLA from the neighboring Karawal Nagar, AAP's Adil Ahmad Khan, and Congress' Ali Mehdi, the son of former MLA Hasan Mehdi.&nbsp;
The elections will be held on February 5, with the vote counting taking place on February 8. The Congress party, which had been in power for 15 years, has faced setbacks in the last two assembly elections, failing to secure any seats.&nbsp;
Meanwhile, AAP emerged victorious in the 2020 elections, winning 62 out of 70 seats, while BJP secured only eight seats.

The Supreme Court on Tuesday granted six-day custody parole to former AAP councillor and February 2020 riots accused Tahir Hussain, who is contesting on a AIMIM ticket, to campaign for Delhi assembly polls.
Custody parole entails a prisoner being escorted by armed police personnel to the place of visit.
A full bench comprising Justices Vikram Nath, Sanjay Karol and Sandeep Mehta allowed Hussain's plea to campaign in police custody from January 29 to February 3.
The court said he would only be allowed to leave jail along with security for 12 hours, according to the jail manual.
The top court said the former councillor could walk out of jail at around 6 am and return by 6 pm.
The bench said Hussain's custody parole would be subject to the deposit of Rs 2.47 lakh per day as part of security expenses, including the police escort.
Hussain, said the court, should not visit his Karawal Nagar home, an alleged site of the riots, while restraining him from making any public comments over the case's merits.
It clarified the order will not be treated as a precedent as it was passed in the "peculiar facts and circumstances" of the case.
The court said Hussain's bail application in the Delhi High Court should be decided on its own merits without being influenced by the bench's order.
Senior advocate Siddharth Aggarwal, appearing for Hussain, argued only four-five days were left to campaign.
Aggarwal said his client was contesting from the Mustafabad seat and he won't visit his house and stay at a hotel aside from sharing the details.
Additional solicitor general S V Raju opposed the plea, saying his role in the riots was serious. If granted the relief, said Raju, everybody would fill nominations in jail.
The court asked Raju to seek instructions on the expenses and security would be required and told Aggarwal to inform the undertakings Hussain proposed to give.
The order was passed on Hussain's plea to allow him to campaign in custody for the upcoming Delhi assembly polls.
The former councillor failed to secure interim bail on January 22, after a two-judge bench of the apex court gave a split verdict.
The Delhi High Court granted custody parole to Hussain on January 14 to file his nomination papers from the Mustafabad constituency.
It , however, declined his plea for interim bail from January 14 to February 9 to contest the February 5 election, saying the gravity of the allegations against Hussain, being the main perpetrator in the violence that resulted in the death of several people, could not be overlooked.
The high court said 11 FIRs were lodged against Hussain in connection with the riots and he was admittedly in custody in a related money-laundering case and a case registered under the stringent Unlawful Activities (Prevention) Act (UAPA).
Violence broke out in northeast Delhi on February 24, 2020, leaving 53 people dead and several injured.
Hussain is an accused in a case connected to the death of Intelligence Bureau staffer Ankit Sharma.
According to the prosecution, on February 26, 2020, complainant Ravinder Kumar informed the Dayalpur police station that his son Sharma was missing since the previous day.
His body was reportedly found from the Khajuri Khas nullah in the riot-affected area and it bore 51 injuries.
On January 22, an apex court bench comprising Justices Pankaj Mithal and Ahsanuddin Amanullah delivered a split verdict on Hussain's plea.
While Justice Mithal dismissed Hussain's plea saying no case was made out, Justice Amanullah opined that he could be released on interim bail.
The judges asked the top court registry to place the matter before Chief Justice Sanjiv Khanna for a new bench to decide the issue.

The Delhi High Court on Wednesday granted bail to student activist Sharjeel Imam in connection with a 2020 communal riots case involving allegations of sedition and unlawful activities.
Imam assailed a trial court order refusing to grant him bail even though he has undergone more than half of the maximum sentence that can be awarded to him in case of a conviction.
"Appeal is allowed," a bench of Justices Suresh Kumar Kait and Manoj Jain said after hearing the counsel for Imam and the Delhi Police.
According to the prosecution, Imam allegedly made speeches at Jamia Millia Islamia on December 13, 2019 and at the Aligarh Muslim University on December 16, 2019 where he threatened to cut off Assam and the rest of the North East from the country.
Imam was booked in the case registered by Delhi Police's Special Branch, which was initially registered for the offence of sedition and Section 13 of UAPA was invoked later. He has been in custody since January 28, 2020 in the matter.
Imam had claimed before the trial court that he has been in custody for the last four years and the maximum sentence for the offence under section 13 (punishment for unlawful activities) of Unlawful Activities (Prevention) Act is 7 years, if convicted.
As per Section 436-A CrPC, a person can be released from custody if he has spent more than half of the maximum sentence prescribed for the offence.
The trial court, while refusing to grant him bail on February 17, had ruled that the accused's custody could be extended for a further period in "exceptional circumstances" after hearing the prosecution's case.
Imam is an accused in several cases arising from the communal riots of 2020, including the case concerning alleged larger conspiracy behind the violence. He is in judicial custody in the conspiracy case as well.

According to the prosecution, an inspector and a head constable were injured in the incident.
"The whole process of identification of the accused persons by these two victims or injured (police) officials is shadowed with clouds of doubt," the court said, taking note of the evidence before it.
"I find merit in the argument of the defence that it could not have been a mere coincidence for both these witnesses to visit the police station without any purpose and find both the accused persons with the investigating officer (IO)," the judge said.
He said as the evidence regarding their identification was not "fool proof", it was not safe to rely on the testimonies of the two police witnesses.
"Hence, I find that both the accused persons are entitled to the benefit of the doubt," the judge said, adding, "The accused are acquitted of all the charges levelled against them in the present case." The Bhajanpura police station had registered an FIR against the duo under various penal provisions, including for unlawful assembly, voluntarily causing grievous hurt to deter a public servant from his duty and assault or criminal force on a public servant.

The Delhi High Court on Monday refused to grant bail to an accused in a Delhi riots case, saying that there was &ldquo;pre-planned and pre-meditated conspiracy to disturb law and order in the city&rdquo;. The court observed that the events in February 2020 &ldquo;did not take place in a spur of the moment&rdquo;.
While hearing the bail application moved by one Mohd Ibrahim in the case concerning the alleged murder of Delhi Police head constable Ratan Lal, the court observed that there was a systematic disconnection and destruction of the CCTV cameras in areas near the place of the incident. &ldquo;Innumerable rioters ruthlessly descended with sticks, dandas, bats, etc. upon a hopelessly outnumbered cohort of police officials,&rdquo; the court observed.
&ldquo;The systematic disconnection and destruction of the CCTV cameras also confirm the existence of a preplanned and pre-meditated conspiracy to disturb law and order in the city,&rdquo; it added.
The judge while acknowledging the importance of personal liberty in a democratic polity, clarified that &ldquo;individual liberty cannot be misused in a manner that threatens the very fabric of civilized society by attempting to destabilise it and cause hurt to other persons&rdquo;.

The Delhi High Court on Monday refused to grant bail to an accused in a Delhi riots case, saying that there was &ldquo;pre-planned and pre-meditated conspiracy to disturb law and order in the city&rdquo;. While hearing the bail application moved by one Mohd Ibrahim in the case concerning the alleged murder of Delhi Police head constable Ratan Lal, the court observed that there was a systematic disconnection and destruction of the CCTV cameras in areas near the place of the incident.
