Centre proposes community service as punishment for petty offences

In a landmark overhaul of colonial-era criminal laws, the Centre on Friday introduced in the Lok Sabha three bills to replace the IPC, CrPC and Indian Evidence Act,&nbsp;

People convicted of petty offences like defamation and drunken misconduct in public may soon get away with community service as a form of punishment, with Union Home Minister Amit Shah introducing the &lsquo;Bharatiya Nyaya Sanhita&rsquo; (BNS) Bill, 2023, which seeks to replace the IPC.
Shah introduced three bills in the Lok Sabha to replace the colonial-era Indian Penal Code (IPC), 1860, the Code of Criminal Procedure, 1898, and the Indian Evidence Act, 1872.
Though Indian courts have been letting off those convicted of petty crimes after ordering them to plant trees, serve at religious places, shelter homes and orphanages, or manage traffic signals, it is for the first time that the provision of community service has been proposed in penal law for minor offences under the &lsquo;Bharatiya Nyaya Sanhita&rsquo; (BNS) Bill.
The Bill has proposed community service as one of the punishments for petty offences like defamation, public servant unlawfully engaging in trade, non-appearance in response to a proclamation and attempt to commit suicide to compel or restrain the exercise of lawful power.
Under the IPC, the offence of criminal defamation carries a punishment of simple imprisonment of up to two years or fine or both.
According to the BNS Bill, the offence of defamation will be punishable with simple imprisonment of up to two years or with fine or with both or with community service.
Under the IPC, the offence of misconduct in public by a drunken person is punishable with simple imprisonment which may extend to 24 hours or with fine of a maximum of Rs 10 or with both, in the BNS Bill, the amount of fine has been raised to Rs 1,000 and the provision of community service has been added.
The modified provision under the Bill for attempted suicide to compel or restrain the exercise of lawful power also includes community service.
It says, &ldquo;Whoever attempts to commit suicide with the intent to compel or restrain any public servant from discharging his official duty shall be punished with simple imprisonment for a term which may extend to one year or with fine or with both or with community service.&rdquo; Under the IPC, attempt to suicide is an offence which entails a maximum punishment of one year.
The BNS Bill also says that in cases of theft, where the value of the stolen property is less than Rs 5,000 and a person has been convicted for the first time, he shall upon return of the value of property or restoration of the stolen property, shall be punished with community service.
Shah said the changes were proposed in order to provide speedy justice and create a legal system that keeps in mind the contemporary needs and aspirations of the people.

Student who accused Chinmayanand of rape turns hostile in court

The LLM student categorically denied in court that she had levelled any allegation against former Union minister Chinmayanand

A 23-year-old law student, who had last year accused former BJP MP Chinmayanand of rape, turned hostile at a hearing in a special court in Lucknow on Tuesday. The LLM student categorically denied that she had levelled any allegation against the former Union minister. The student now faces a perjury charge. 72-year-old Chinmayanand was arrested last year in the rape case, and was granted bail in February. Earlier in her statement to cops and then before a magistrate the woman had accused Chinmayanand&nbsp;of sexually abusing and threatening her.&nbsp;

Lucknow, PTI: In a courtroom twist Tuesday to the high-profile case, a law student who had accused former Union minister Chinmayanand of sexually exploiting her disowned her statements to police and now faces a perjury charge.
Appearing before an MP-MLA court in Lucknow, the LLM student categorically denied that she had levelled any allegation against the former Union minister as the prosecution had charged.
At this, the prosecution immediately moved an application under Section 340 of the CrPC, seeking action against her for perjury.
Judge P K Rai directed his office to register the application and asked the prosecution to furnish a copy of the application to the victim and the accused.
The court fixed October 15 for hearing on the application.
The Allahabad High Court in February this year granted bail to Chinmayanand, whose trust runs the Shahjahanpur law college where the woman studied. He was arrested in September last year.
The case was registered under Section 376-C of the IPC, an offence pertaining to the abuse of one's position by a person in authority to "induce or seduce" a woman under his charge to have "sexual intercourse not amounting to the offence of rape".
Chinmayanand (72) also faced charges under Sections 342 (wrongful confinement), 354-D (stalking) and 506 (criminal intimidation) of the IPC.
According to government lawyer Abhay Tripathi, the victim had lodged an FIR in this regard with the Lodhi Colony police station of New Delhi on September 5, 2019.
Her father lodged another complaint in Shahjahanpur and both FIRs were merged.
An SIT had recorded her statement. Later, her statement under Section 164 of the CrPC was recorded in Shahjahanpur.
In both statements, she had supported the FIR version but now during the trial, she changed her statement and denied the facts mentioned in the complaint.
&ldquo;Since she has turned hostile, I have moved an application under Section 340 of the CrPC,&rdquo; Tripathi said.
Earlier, the investigation officer had cited 33 witnesses and 29 documentary evidence in the 13-page charge sheet.
The Allahabad high court had on February 3, 2020 transferred the trial from Shahjahanpur to the Lucknow's MP-MLA court.
The case first came to light after the woman went missing on August 24, a day after she posted a video on social media alleging that a "senior leader of the sant community" was harassing and threatening to kill her.

Mumbai Police on Tuesday issued a show-cause notice to Republic TV's Editor-in-Chief ArnabGoswami over his alleged communal comments during his coverage of the Palghar lynching case and the Bandra migrants incident in April this year. Goswami&nbsp;has been asked why&nbsp;a bond of good behaviour should not be taken from him, a police official told PTI.&nbsp;He has been asked to appear before the Special Executive Magistrate and Assistant Commissioner of Police, Worli Division on Friday at 4 pm.&nbsp;

Mumbai, PTI: Mumbai Police on Tuesday issued a show-cause notice to Republic TV's Editor-in-Chief Arnab Goswami over his alleged communal comments during his coverage of the Palghar lynching case and the Bandra migrants incident in April this year. The notice has been sent under section 108 of the Code of Criminal Procedure (CrPC), asking Mr Goswami to show reasons as to why a bond of good behaviour should not be taken from him, a police official said.
He has been asked to appear before the Special Executive Magistrate and Assistant Commissioner of Police, Worli Division on Friday at 4 pm, the official added.
On April 21, Arnab Goswami conducted a debate on his show "Puchhta Hain Bharat" on Republic Bharat about the attack on two monks and their driver in Maharashtra's Palghar.
The show-cause notice said during the debate (in Hindi), Mr Goswami asked whether it was a crime to be Hindu and wear saffron clothes and whether people would have remained silent had the victims not been Hindus.
A case under relevant sections of the Indian Penal Code for "giving provocation to cause riot" and "promoting enmity between different groups on the basis of religion" and other sections has been registered against Mr Goswami following the program, it added.
His comments could create communal disharmony and hatred between Hindus and Muslims, and the show evoked strong reactions on YouTube, the notice said.
Only because of the coronavirus pandemic there was no violence but the comments posed a threat to communal integrity and law and order, so as a preventive action the police had now started the process of taking an undertaking for good behaviour from Arnab Goswami, the official said.
A bond of ₹ 10 lakh for the duration of one year with one guarantor "who is well-known in society and who can control his behaviour" will be taken from Mr Goswami, he added.

PDP chief Mehbooba Mufti being released: JK administration

PTI,&nbsp;Srinagar:&nbsp;PDP president and former chief minister of Jammu and Kashmir Mehbooba Mufti is being released after being in preventive detention for more than 14 months following the abrogation of Article 370 last year.
"Ms. Mehbooba Mufti being released," JK government spokesman Rohit Kansal tweeted.
Mehbooba, who became the first woman chief minister of the erstwhile state of Jammu and Kashmir in 2016 as head of the PDP-BJP alliance, was arrested along with other leaders hours ahead of the Centre bifurcating the state into two union territories and abrogating Article 370.
She was first detained under Sections 107 and&nbsp;151 of CrPC but later booked under the controversial Public Safety Act.
Initially, Mehbooba was lodged at Cheshma Shahi guest house and then shifted to another government guest house at M A Link Road here.
The PDP president was then taken to her residence where she remained under house arrest.
Mehbooba's daughter, Iltija, had challenged her detention in the Supreme Court, which last heard the case on September 29.
