Justice Chandrachud once again upheld the courtroom decorum as he reprimanded a lawyer during the listing of a petition on January 3.

Chief Justice of India DY Chandrachud issued a warning to a lawyer, who engaged in a heated argument with him over the listing of a petition, on January 3.
Expressing his displeasure with the lawyer's 'tone', the CJI interrupted and cautioned him against attempts to intimidate the court.&nbsp;
Asking him to lower his voice, the CJI said, "You're arguing before the first court of the Supreme Court of India; lower your pitch, otherwise, I will have you removed from the Court".
Admonishing him, CJI also questioned the lawyer's usual practice: "Where do you normally appear? Is this the way you shout at judges every time?"
He said, "If you think you can browbeat us by raising your voice, you're mistaken. It has not happened in 23 years; it will not happen in the last year of my career."
The advocate promptly apologized and altered his approach as the petition proceedings resumed. This wasn't the first instance when Justice Chandrachud upheld the courtroom decorum by reprimanding the lawyer. Earlier, he rebuked a lawyer for using a mobile phone and, in March last year, he slammed a senior advocate for urging expedited consideration of a case.

He further said that he is now looking forward to fulfilling Prime Minister Narendra Modi's vision in the Earth Sciences Ministry.
Rijiju's remarks came hours after he was divested of the Law and Justice portfolio and made the Minister for Earth Sciences in a surprise reshuffle of ministers by the prime minister.
"It has been a privilege and an honour to serve as Union Minister of Law and Justice under the guidance of Prime Minister Narendra Modi ji," Rijiju said on Twitter.

Justice DY Chandrachud on Wednesday was sworn in as Chief Justice of India after Justice Uday Umesh Lalit demitted office.

The senior-most judge of the <a href="https://www.editorji.com/india-news/10-quota-for-poor-cleared-by-supreme-court-1667799702752">Supreme Court of India</a> Justice D Y Chandrachud on Wednesday has become the 50th head of the Judiciary of the country. He will have a tenure till November 10, 2024. Last Month the Centre Government had notified the name of Dr Justice Dhananjaya Yashwant Chandrachud, Judge of the Supreme Court, as the Chief Justice of India, with effect from November 9, 2022.
The press statement issued in this regards stated that "In exercise of the power conferred by clause (2) of Article 124 of the Constitution of India, the President is pleased to appoint Dr Justice Dhananjaya Yashwant Chandrachud, Judge of the Supreme Court, as the Chief Justice of India, with effect from November 9, 2022." Justice Chandrachud's father Justice YV Chandrachud was the 16th Chief Justice of India serving from February 2, 1978, to July 11, 1985.
This has become the first time in the history of the judiciary, Father and son have become CJI.

According to the Memorandum of Procedure (MoP), which governs the process of appointment of judges in the higher judiciary, the outgoing CJI initiates the process of naming the successor after getting a communication from the Law ministry.
The MoP says the senior-most judge of the apex court is considered fit to hold the office of the CJI and the views of the outgoing head of the judiciary have to be sought "at an appropriate time".
The MoP, however, does not specify the time limit for the initiation of the process of recommending the name of the successor CJI.

He was judge of the Bombay High Court from March 29, 2000 until his appointment as the Chief Justice of the Allahabad High Court.

After completing BA with Honours in Economics from St Stephen's College, New Delhi, Justice Chandrachud did his LLB from Campus Law Centre, Delhi University, and obtained LLM degree and a Doctorate in Juridical Sciences (SJD) from Harvard Law School, USA.
He practised law at the Supreme Court and the Bombay High Court and was a visiting professor of comparative Constitutional law at the University of Mumbai.

'Actions & inactions of the CBI raise questions of credibility now': CJI Ramana

Justice Ramana said institutions including the Police and the investigative bodies should not allow any authoritarian tendencies to creep in&nbsp;

CBI's credibility has come under deep public scrutiny with the passage of time as its actions and inactions have raised questions in some cases, Chief Justice N V Ramana Friday said and called for creating an "independent umbrella institution" to bring various investigating agencies under one roof.
"When it comes to the CBI, it possessed immense trust of the public in its initial phase. In fact, the Judiciary used to be flooded with requests for transfer of investigations to the CBI, as it was a symbol of impartiality and independence.
"Whenever the citizenry doubted the skill and impartiality of its own state police, they sought an investigation by the CBI, as they wanted justice to be done. But, with the passage of time, like every other institution of repute, the CBI has also come under deep public scrutiny. Its actions and inactions have raised questions regarding its credibility, in some cases," Justice Ramana said.
The CJI, who was speaking at the 19th D P Kohli Memorial Lecture of CBI on "Democracy: Role and Responsibilities of Investigative Agencies," said there was an "immediate requirement for the creation of an independent umbrella institution for the investigating agencies to bring various agencies like CBI, SFIO, ED, etc under one roof".
Justice Ramana said the body was required to be "created under a statute" clearly defining its powers, functions, and duties.
He said such a law will also need too much needed "legislative oversight" for the "upright organisation" to be headed by an "independent and impartial authority" to be appointed by a committee which appoints the director of the CBI.
"The head of the organisation can be assisted by deputies who are specialists in different domains. This umbrella organisation will end a multiplicity of proceedings. A single instance these days gets investigated by multiple agencies often leading to dilution of evidence, contradictions in depositions, prolonged establishment of innocence. It will also save the institutions from being blamed as the tools of harassment," he said.
Once an instance is reported, the organisation should decide as to which specialised unit should take up the investigation, Justice Ramana said.
Justice Ramana said the Police and the investigative agencies may have De-Facto legitimacy, but yet, as institutions, they still have to gain social legitimacy.
"Police should work impartially and focus on crime prevention.&nbsp; They should also work in co-operation with the public to ensure law and order prevails in the society," he said.
Justice Ramana said institutions including the Police and the investigative bodies should not allow any authoritarian tendencies to creep in and need to function within the democratic framework as any deviation will hurt them and will weaken our democracy.
"All the institutions including the Police and the investigative bodies uphold and strengthen the democratic values. They should not allow any authoritarian tendencies to creep in.
"They need to function within the democratic framework as prescribed under the Constitution. Any deviation will hurt the institutions and will weaken our democracy," he said.
Justice Ramana said that as an institution, CBI has so many achievements to its credit and in the process, many of its personnel have put their health and lives at risk.
"Some have also made the supreme sacrifice. In spite of all this, it is ironical that people hesitate to approach the police in times of despair. The image of the institution of police is regrettably tarnished by allegations of corruption, police excesses, lack of impartiality, and close nexus with the political class.
"Often, the police officers approach us with the complaint that they are being harassed after the change in the regime. When you try to endear yourselves to the powers, you will have to face the consequences. The need of the hour is to reclaim social legitimacy and public trust," Justice Ramana said. The CJI said the first step to gain the same is to break the nexus with the political executive.
"Often the best of talents enter this system in expectation of recognition and accolades. But, if the threat of infection looms large, honest and upright officers find it difficult to stand by their oath," he said.
Justice Ramana praised CBI Director S K Jaiswal and said he comes across as an officer who is committed towards improving the functioning of the organisation.
"I remember the times when, CBI in its anxiety, used to conduct several press conferences even before conducting a proper investigation. I am happy to note that under the present leadership the organization is maintaining a low profile, as it should be.&nbsp; My only wish, Mr. Director, is that you abide by the rule book and stand by principles. I wish you, and all the officials of CBI, the best for the future," he said.
The CJI paid tributes to D P Kohli, the founding director of CBI, and said he was an exemplary officer.
"Shri Kohli was renowned for his courage, conviction, and remarkable efficiency. His vision turned CBI into the premier investigative agency of India. The tales of his unimpeachable integrity travelled far and wide," the CJI said.

Nearly 50 per cent of the court complexes don&rsquo;t have a library, and 46 per cent don&rsquo;t have the facility to purify water.&rdquo;
Stressing that work cannot continue under the present condition, Ramana urged the Law Minister to make sure the proposal to set up the National Judicial Infrastructure Authority is taken up in the winter session of parliament.
Earlier, the CJI had sought a speedy approval from the government for recommendations made by Supreme Court collegium for the appointments of judges in high courts.

The Supreme Court on Wednesday took suo moto cognizance of the Lakhimpur Kheri violence. Chief Justice-led apex court bench will hear the Lakhimpur Kheri violence case on Thursday. The court will take place at 11 am.
The violence in Uttar Pradesh's Lakhimpur Kheri, that left eight people including four farmers dead left the country shaken and led to an uproar with opposition parties slamming the government for the alleged involvement of a union minister's son.

The Supreme Court on Tuesday entrusted Allahabad high court to monitor the CBI probe into the gang-rape and murder of a dalit girl in Uttar Pradesh's Hathras. The Supreme Court was hearing a batch of pleas which have sought a court-monitored probe into the Hathras case, in which a Dalit girl was allegedly brutally raped and died of injuries.
A bench headed by Chief Justice S A Bobde said that plea for transfer of trial out of Uttar Pradesh in the case would be considered later after the CBI probe is completed.

In an unprecedented move, Andhra Pradesh CM YS Jagan Mohan Reddy has accused a Supreme Court judge and the state high court of conspiring to topple his govt, reports said. In a letter to CJI SA Bobde, Jagan has alleged that a top court judge, who is seen as CJI-in-waiting is acting on behalf of TDP leader and former CM Chandrababu Naidu to destabilise his government. The letter also states that the SC judge was influencing the Andhra Pradesh High Court, and it names the High court Chief Justice and four other judges. The CM has also listed out cases and examples to allege that judgments have been delivered in favour of the Telugu Desam leaders and to obstruct the work of his govt.

A Shenzen-based big-data firm with links to the Chinese government, and the Chinese Communist Party, is monitoring over 10,000 Indian individuals and organisations in its global database of &ldquo;foreign targets,&rdquo; The Indian Express reported.&nbsp;
 Zhenhua Data Information Technology monitors the subject&rsquo;s digital footprint across social media platforms, keeps track of the target&rsquo;s friends and relationships, and even tracks geographic location using Artificial Intelligence tools.
 The targets identified and monitored in real time include President Ram Nath Kovind, Prime Minister Narendra Modi and a wide range of Indians in politics, business, judiciary, media, and civil society.
