The top court declared the election results declared by the returning officer invalid.

) AAP Rajya Sabha MP Sandeep Pathak on Monday welcomed the Supreme Court's observations on the Chandigarh mayoral polls, saying it is because of such decisions that people's "hopes are pinned on the legal system".
He also sought that the criminal liability and culpability should be fixed for the events that unfolded on the day of the elections.
Pathak's statement came hours after the apex court ordered that the Chandigarh mayoral poll ballots and the video of the electoral proceedings be preserved.
Taking note of a plea of an Aam Aadmi Party (AAP) councillor alleging wrongdoing in the polls, the court issued notices to the Chandigarh authorities, including the civic body, calling the incident a "mockery of democracy".
Speaking to PTI Videos, Pathak said the SC's decision is "quite encouraging".

The Supreme Court on February 5 came down heavily on the Returning Officer of Chandigarh Municipal polls over the manner in which the results were declared, which saw the BJP defeating the Congress-AAP alliance.
Issuing a notice to Returning Officer Anil Masih, the top court directed that entire records of the municipal elections be sequestered with the High Court Registrar General, and the ballots and videos be preserved.
A bench of Chief Justice of India (CJI) DY Chandrachud with Justices JB Pardiwala and Manoj Misra took strong exception to the Returning Officer defacing ballot papers and making a mockery of democracy.
The apex court said that it was appalled by the behaviour of the returning officer of the elections. "Why is he looking at the camera and running like a fugitive?", the CJI said after seeing the video of the proceedings, reports LiveLaw outlet.
It also temporarily stayed the activities of the Municipal Corporation and ordered the ensuing meeting of the corporators to be deferred. &nbsp;
The Court also effectively stayed any activity on the part of the Municipal Corporation for the time being.
"The ensuing meeting of Chandigarh Municipal Corporation shall be deferred till the next date. Let the papers be handed over to the High Court registrar general by today 5 pm. List on the next Monday week," the Court ordered.
A plea was filed Aam Aadmi Party (AAP) councillor Kuldeep Kumar challenging the Punjab and Haryana High Court's refusal to grant an immediate stay on the election result in which a Bharatiya Janata Party (BJP) candidate was declared elected Chandigarh Mayor.
BJP&rsquo;s Manoj Sonkar was elected as Mayor on January 30 after he bagged 16 votes against the 12 votes received by the Congress-AAP candidate Kumar.

A few hundred metres down the road, outside BJP headquarters, Delhi Chief Minister Arvind Kejriwal and Punjab Chief Minister Bhagwant Mann led AAP protests against alleged "cheating" in the Chandigarh Mayoral election. Police detained several AAP workers from the protest site, in addition to those deatined en route to the demonstration.
The showdown in Central Delhi left commuters stranded in long traffic jams as police barricaded roads and diverted vehicles.

The Chandigarh mayoral elections which were to be held on January 18, have been postponed citing ill health of the presiding officer. This sparked protests from Aam Aadmi Party and Congress leaders and workers.&nbsp;
Congress leader Pawan Kumar Bansal said that the presiding officer has been hospitalised with the intention to postpone the mayor election by the BJP. Bansal called it a totally undemocratic thing. AAP and Congress have teamed up up to take on BJP in Chandigarh mayoral polls.
The alliance is aiming to oust the BJP from the chair of mayor which it has been winning for the last eight years. For the mayor seat, the BJP has fielded Manoj Sonkar while the AAP has nominated Kuldeep Kumar Tita. For the post of senior deputy mayor, the contest will be between BJP's Kuljeet Sandhu and Congress's Gurpreet Singh Gabi.
In the 35-member Chandigarh Municipal Corporation, the BJP has 14 councillors. It also has an ex-officio member MP (Kirron Kher) who has voting rights.
The AAP has 13 councillors and the Congress seven. The Shiromani Akali Dal has one councillor in the House.
The MC officials have said that no mobile phone, camera and any other electronic gadget will be allowed during the voting at the assembly hall of the MC office.
The mayor is elected by the councillors through secret ballots. Hence, the possibility of cross-voting cannot be ruled out.

The Congress abstained from voting in 2022 and 2023, leading to the BJP's victory in the mayoral polls.
Elections for the three posts are held every year during the five-year term of the House. This year, the mayor's seat has been reserved for the Scheduled Caste category. This time the mayor will be elected for the third term.
