The Indian government proposes IBC amendments to streamline CCI approval and improve the insolvency process.

The government is working on amending the insolvency law, including the provision related to bidders requiring CCI approval for resolution plans involving combinations before they approach the Committee of Creditors, according to a senior official.
The Insolvency and Bankruptcy Code (IBC) provides for a market-linked and time-bound resolution of stressed assets and under the framework, Committee of Creditors (CoC) is a key element.
As part of further improving the insolvency ecosystem as well as reduce the resolution timelines, the corporate affairs ministry has been working on amending the IBC.
The senior official on Tuesday said the ministry is working on amendments to the IBC and they are likely to be moved in the next Parliament session.
Among other provisions, amendments are likely in Section 31 (4) of the IBC that requires bidders to seek approval from the Competition Commission of India (CCI) before submitting their resolution plans to the CoC.
The proposed amendment to Section 31 (4) is aimed to ease the burden on the CCI and will be part of the overall amendments, the official said.
As per this section, for resolution plans that have a provision for combination, as referred to in section 5 of the Competition Act, 2002 (12 of 2003), the resolution applicant shall obtain the approval of the CCI under that Act prior to the approval of such resolution plan by the CoC.
The ministry has made six amendments to the IBC and at least 122 amendments in regulations since the inception of the Code.
A total of 1,119 cases have been resolved through the Corporate Insolvency Resolution Process (CIRP) leading to a recovery of about Rs 3.58 lakh crore to the creditors under the Code till December 31, 2024.

Amidst concerns and complaints over predatory pricing ways, Competition Commission chief Ravneet Kaur on Tuesday said the new cost of production norms will help in having more accurate and objective assessments for easier enforcement outcomes.
Speaking at the function to mark the 16th Annual Day of the Competition Commission of India (CCI) in the national capital, she also said that digital markets see rapid change and the first-mover advantage gets concretized very quickly.
"We have the possibility of algorithmic decision-making and self-preferencing by those having the first-mover advantage," she said.
Against this backdrop, Kaur said there is a need to have a balance in looking at such conduct, where the approach is "evidence-based, proportionate, and anchored in rigorous economic analysis."
Earlier this month, the Competition Commission of India (Determination of Cost of Production) Regulations, 2025 was notified.
Kaur said it is very essential to have a consistent approach for determining the costs, especially when it comes to digital markets and platforms on predatory pricing and deep discounting.
With the new norms, she said it is expected that assessing the cost of production will be much more accurate and objective and much easier for enforcement outcomes to be decided.
According to Kaur, CCI has been proactive in recalibrating its regulatory tools and framework to respond effectively to the complexities of the digital markets, globalization, and evolving business models.
"CCI is committed to ensuring that there is market access for small businesses, encourages innovation, prevents monopolistic practices and promotes digital inclusion," she noted.

Unfair practices, that the allegation against&nbsp;Zomato, Swiggy&nbsp;owing to which&nbsp;National Restaurant Association of India (NRAI) has asked anti-trust body CCI&nbsp;to conduct a detailed probe into the issue.&nbsp;Restaurant owners are accusing Zomata, Swiggy&nbsp;of bundling of services, data masking and charging of exorbitant commissions and deep discounting.&nbsp;"We have been in constant dialogue with the food service aggregators over last 15-18 months to resolve critical issues impacting the sector. However, despite all our efforts, we have unfortunately not been able to resolve them with the aggregators. The needle hasn&rsquo;t moved much on these issues," NRAI President Anurag Katriar was quoted as saying.&nbsp;Reports indicate that&nbsp;restaurant owners have been pushed&nbsp;by Zomato&nbsp;and Swiggy&nbsp;in recent weeks to opt for discounting models like &ldquo;Deal of the Day&rdquo; and &ldquo;Everything at one price&rdquo;.During the pandemic, NRAI said the magnitude of anti-competitive practices by&nbsp;Zomato&nbsp;and&nbsp;Swiggy&nbsp;had increased manifold and despite discussions.
