Amid Telangana MLA poaching allegations KCR govt withdraws general consent to CBI

On August 31, the Chief Minister had said in Bihar's capital Patna that all states should withdraw the general consent given to the CBI.

The Telangana government has withdrawn general consent given to the Central Bureau of Investigation (CBI) in the state.
According to a state government order issued on August 30, prior consent of Telangana is required for the central probe agency on a case-to-case basis to investigate in the state.
Though the government order (GO) was issued two months ago, it did not figure in the public domain until Saturday when the Additional Advocate General (AAG) informed the Telangana High Court, during arguments on a petition filed by the BJP seeking a CBI probe into the TRS MLAs poaching case, that the general consent for CBI was withdrawn by the state government.
"Government of Telangana hereby withdraws all previous general consents issued by the State Government under Section 6 of the Delhi Special Police Establishment Act, 1946 (Central Act XXV of 1946), vide any letters or notifications including the Notification issued in G.O.Ms.No.160, Home (SC) Department, dt.23.09.2016, to all the Members of Delhi Special Police Establishment to exercise the powers and jurisdiction under the said Act in the State of Telangana," the GO read.

The development comes after the BJP and TRS have indulged in a war of words over several issues in recent past that has led to acrimony between the two parties.
The BJP also dragged Chief Minister K Chandrasekhar Rao's daughter K Kavitha's name in the Delhi liquor policy scam which is being probed by the CBI and the Enforcement Directorate. She, however, denied the allegations.
On August 31, the Chief Minister had said in Bihar's capital Patna that all states should withdraw the general consent given to the CBI.
Addressing a press conference in Patna with Bihar Chief Minister Nitish Kumar by his side, Rao alleged that all central agencies were being "misused" by the BJP to target its political opponents.
"All central investigative agencies, including the CBI, are being misused by the Centre to target the BJP's political rivals in the country. This should stop now and all state governments should withdraw their consent to the CBI. After all, policing is a state subject," he said.
According to Section 6 of the Delhi Special Police Establishment (DSPE) Act, 1946, the CBI needs consent from the respective state governments for conducting investigations in their jurisdictions.
If the general consent is withdrawn, the agency has to seek permission from the state government for registering a case.
Eight states, including West Bengal, Chhattisgarh, Rajasthan, Punjab and Meghalaya, have currently withdrawn general consent for the CBI to probe cases in their jurisdiction. Maharashtra had earlier withdrew the consent but later revoked the decision.&nbsp;

The Aam Aadmi Party has alleged Rs 1,400 crore corruption by Saxena while he was the chairman of Khadi and Village Industries Commission back in 2016. 
Taking to twitter the LG said "I called for good governance, zero tolerance to corruption and better services for the people of Delhi. But unfortunately Hon'ble CM Arvind Kejriwal in desperation has resorted to diversionary tactics and false accusations." 
Saxena, sharing a brief statement on Twitter, said he would not be surprised if "more such baseless personal attacks" were made on him and his family in the coming days.
AAP has demanded a CBI probe into the corruption charges. Meanwhile the LG on Wednesday decided to take legal action against four AAP MLAs for false and defamatory charges against him.

The CBI on Saturday registered an FIR against 10 people in connection with the murder of TMC leader Bhadu Sheikh, which apparently led to the killing of nine people in West Bengal's Birbhum district, a senior official said.
Among those named in the FIR are Palash Shiekh, Sanju Shiekh, Sona Shiekh and Choto Shiekh -- who have been arrested, he said.
The case was filed under IPC sections 302 (murder) and 120B (criminal conspiracy), and relevant sections of the Explosive Substances Act.
The CBI visited Rampurhat police station during the day, and collected the case diary and documents linked to Bhadhu Sheikh's murder investigation, the official said.
"The CBI officers spoke to the police personnel there. They also spoke to witnesses of the murder and took stock of the situation," he said.
CBI officers also visited Bogtui Mor where Bhadu Sheikh was killed, he added.
The CBI took over the investigation of murder from the police, following an order of the Calcutta High Court.
Sheikh's murder is believed to have led to the killing of nine people on March 21 in Bogtui village. The nine people, including two children, died of burn injuries after their houses were allegedly firebombed.

The bench said that the CBI probe was being ordered in the interest of justice.
Eight people, including two children, were charred to death in Bogtui village of Bengal’s Birbhum district in the suspected fallout of a TMC panachayat official’s murder.
The bench had suo motu taken up the case of the gruesome incident.

The Supreme Court Thursday transferred to CBI the investigation against former police commissioner of Mumbai Param Bir Singh over the allegations of misconduct and corruption.
A very murky affair is going on amid echelons of power on who should investigate the matter, a bench of Justices S K Kaul and M M Sundresh said.
The apex court said a thorough investigation is required to regain faith of people in the state police. 
The bench said: "We are unable to accept the contention that an FIR is registered by those who had complaints against the petitioner. We are of the view that state itself should have allowed CBI to carry the investigation.
"We are of the prima facie view that there is some concerted effort which needs the investigation by CBI. What is the truth, who is at fault how does such scenario come to prevail is something which investigation must get into. CBI must hold an impartial inquiry into all these aspects".
The top court said it was not commenting on merits of the allegations as it does not want the investigation to be influenced in any manner.
"We do not want the investigation to be influenced by the observation of this court. The High Court has treated this as a service dispute which it is not and thus we set aside the HC verdict. We allow the appeal and direct the probe into 5 FIRs be transferred to CBI with all records.
"Such transfer to be completed within one week and all officials to extend full cooperation to CBI to try arrive at the truth," the bench said.
