Calcutta High Court orders MGNREGA resumption in West Bengal from August 1 with special oversight to prevent past irregularities, ensuring scheme benefits rural employment.

The Calcutta High Court on Wednesday directed the center to implement the MGNREGA scheme prospectively in West Bengal from August 1.
The HC said the center is empowered to impose special conditions, restrictions, and regulations, which have not been imposed in other states of the country, so as to ensure that no illegality or irregularity occurs when the scheme is being implemented in the state.
Allowing the center to continue its inquiry into the allegations of irregularities in some districts of the state, a division bench presided over by Chief Justice TS Sivagnanam directed that the scheme be implemented prospectively with effect from August 1.
The court directed that the authorities in charge of the implementation of the scheme are entitled to impose special conditions to ensure that whatever had occurred three years prior should not recur.
The court said that it is not in dispute that certain irregularities have been pointed out by the Centre in the disbursement of wages under the MGNREGA (Mahatma Gandhi National Rural Employment Guarantee Act) scheme.
The bench, also comprising Justice Chaitali Chatterjee (Das), noted that with regard to allegations of irregularities, action has been initiated, recoveries made and that such amount is being maintained in a bank account of the state nodal agency of MGNREGS, West Bengal.
The division bench said that at this juncture, the endeavour of the court is to ensure implementation of the scheme, which has been kept in abeyance for the past close to three years in the state.
The court said that no one can allow a person who illegally took advantage of the scheme to go scot-free.
"At this juncture, the court is concerned about the implementation of the scheme in West Bengal prospectively," the bench observed.
"The scheme of the Act does not envisage a situation where the scheme would be put to cold storage for eternity," it said.
The bench said that the Centre has sufficient powers to inquire into irregularities or illegalities in the manner of disbursement of the wages.
The court said that there can, however, be a line drawn between past actions and future steps to be taken to implement the scheme.
It said that this would be "in public interest" and subserve the object and purpose for which the central law was enacted.

The bench said that the opinion and advice of the Backward Classes Commission is ordinarily binding on the state legislature under the National Commission for Backward Classes Act, 1993.

The Calcutta High Court on Wednesday struck down several classes as Other Backward Classes (OBC) under an Act of 2012 of West Bengal for reservation of vacancies in services and posts in the state, finding these illegal.
Passing judgement on petitions challenging the provisions of the Act, the court clarified that the services of citizens of the struck down classes, who are already in service or have availed the benefit of reservation or have succeeded in any selection process of the state will not be affected by the order.
The court struck down several classes for reservation as Other Backward Classes (OBC) given under The West Bengal Backward Classes (Other than Scheduled Castes and Scheduled Tribes) (Reservation of Vacancies in Services and Posts) Act, 2012.
In the judgement, the division bench comprising justices Tapabrata Chakraborty and Rajasekhar Mantha clarified that the executive orders of the state government classifying 66 classes of OBC before 2010 were not interfered with, since these were not challenged in the petitions.
The bench directed that the executive orders classifying 42 classes made by the state from March 5, 2010 till May 11, 2012, were also quashed, with prospective effect, in view of the illegality of the reports recommending such classification.
The bench said that the opinion and advice of the Backward Classes Commission is ordinarily binding on the state legislature under the National Commission for Backward Classes Act, 1993.
The bench directed the Backward Classes Welfare Department of the state, in consultation with the Commission, to place a report before the legislature with recommendations of inclusion of new classes or for exclusion of remaining classes in the state list of OBCs.

The court noted that the definition of cruelty under Section 498A does not solely rely on the allegations made by the complainant (wife) and cannot be proven based solely on her testimony of harassment and torture.

Gujarat polls speech: Calcutta HC quashes FIR against actor Paresh Rawal

The court noted that Rawal, who had moved a petition before it seeking quashing of the FIR, has already given clarifications and tendered an apology over the speech in question.

&nbsp;Calcutta High Court on Monday quashed an FIR filed against actor Paresh Rawal by the CPI(M)'s West Bengal unit secretary Mohd Salim who claimed that the Padma Shri awardee had made derogatory comments against the Bengali community. The court noted that Rawal, who had moved a petition before it seeking quashing of the FIR, has already given clarifications and tendered an apology over the speech in question. It said the speech was made in Gujarati and some of the criticisms that have been made against the speech are by persons who may not necessarily understand the language. Considering all aspects of the case, Justice Rajasekhar Mantha quashed the FIR, observing that further continuation of the proceedings was not desirable.
Advocate Varun Chugh, counsel for Rawal, said the FIR was registered with the intention to gain political mileage with ulterior motives.
"It is evident that it is a politically motivated FIR to damage the reputation of a celebrity and public figure like my client," he said. Rawal, a former BJP MP, stated in the petition that his speech delivered in Gujarati on November 29, during a campaign for the Gujarat assembly elections last year, was misinterpreted and mistranslated for political vendetta. He maintained that he has given clarifications on his statement and apologised on December 2, the same date when Salim filed an FIR at Taltala police station in Kolkata.

The Calcutta High Court has ordered the police in West Bengal to register the cases of all victims of <a href="https://www.editorji.com/story/cm-mamata-banerjee-calls-post-poll-violence-claims-in-bengal-bjp-s-gimmick-1623940120927" target="_blank">post-poll violence</a> amid allegations that complaints were not being filed by the authorities concerned.
Bengal&rsquo;s TMC government was strongly condemned by the Court on Friday over the violence that erupted in May after the elections, saying the administration was in &ldquo;denial mode&rdquo;. It also said that&nbsp;there is enough evidence to establish the post-poll violence, and added the state has been caught &ldquo;on the wrong foot&rdquo;.
The <a href="https://www.editorji.com/story/bengal-governor-pm-modi-called-expressed-concerns-over-post-poll-violence-1620123406294" target="_blank">Mamata&nbsp;Banerjee&nbsp;led state government</a> has been asked to ensure medical treatment and ration are provided to all the victims, even if they don&rsquo;t have ration cards.

Fearing a spike in Covid cases in West Bengal owing to crowding during Durga Puja, the Calcutta High Court on Monday said the pandals would be no-entry zones for visitors. The court ruled revelers would not be allowed within a five-metre distance for small pandals and 10 metre for big pandals while directing organisers to erect barricades at their entrance. Only organisers or puja committee members would be allowed inside the pandals, the court said as it limited the number to 25 for big pandals and 15 for the smaller ones. &nbsp;The HC also asked each puja committee to submit a blueprint on crowd management. &nbsp;Considering the pandemic situation, several pandal committees have made arrangements for virtual &lsquo;darshan&rsquo; this time.
