Imam was accused of giving inflammatory speeches in Aligarh Muslim University and Jamia Millia Islamia during the anti-CAA protests.

The Delhi High Court on Wednesday granted bail to student activist Sharjeel Imam in connection with a 2020 communal riots case involving allegations of sedition and unlawful activities.
Imam assailed a trial court order refusing to grant him bail even though he has undergone more than half of the maximum sentence that can be awarded to him in case of a conviction.
"Appeal is allowed," a bench of Justices Suresh Kumar Kait and Manoj Jain said after hearing the counsel for Imam and the Delhi Police.
According to the prosecution, Imam allegedly made speeches at Jamia Millia Islamia on December 13, 2019 and at the Aligarh Muslim University on December 16, 2019 where he threatened to cut off Assam and the rest of the North East from the country.
Imam was booked in the case registered by Delhi Police's Special Branch, which was initially registered for the offence of sedition and Section 13 of UAPA was invoked later. He has been in custody since January 28, 2020 in the matter.
Imam had claimed before the trial court that he has been in custody for the last four years and the maximum sentence for the offence under section 13 (punishment for unlawful activities) of Unlawful Activities (Prevention) Act is 7 years, if convicted.
As per Section 436-A CrPC, a person can be released from custody if he has spent more than half of the maximum sentence prescribed for the offence.
The trial court, while refusing to grant him bail on February 17, had ruled that the accused's custody could be extended for a further period in "exceptional circumstances" after hearing the prosecution's case.
Imam is an accused in several cases arising from the communal riots of 2020, including the case concerning alleged larger conspiracy behind the violence. He is in judicial custody in the conspiracy case as well.

During the hearing, Prasad apprised Additional Sessions Judge Amitabh Rawat that Imam attempted to create complete anarchy and gave divisive speeches during the protests against the Citizenship Amendment Act (CAA) and the National Register of Citizens (NRC).
The SPP read out a January 16 speech given by the JNU student in Aligarh and said, &ldquo;He [Sharjeel Imam] begins this speech by saying 'As-salamu alaykum', which shows that it is only subjected to one community&rdquo;.
&ldquo;The people called upon to take action were also from one community. The speech was definitely divisive. It was not made for the general public at large but a specific community. He is attempting to create complete anarchy,&rdquo; Prasad added.

Furthermore, the purported speeches made by Imam during the protests were read out by the prosecutor line-by-line during the virtual hearing.
One portion of the speech as read by the SPP stated, &ldquo;It is our responsibility to cut off Assam. They [the government] will listen to us only when Assam is cut off from the rest of the country. You are aware of the condition of Muslims in Assam.&rdquo; Imam is accused of offenses relating to sedition, promoting enmity between different groups on grounds of religion, race, place of birth, imputations prejudicial to national integration, and public mischief under the Indian Penal Code, and indulging in unlawful activities under the UAPA.
Delhi Police had filed a charge sheet against Imam in the case, in which it alleged that he allegedly gave speeches inciting hatred, contempt, and disaffection towards the Central Government and instigated the people which led to the violence in December 2019.
&ldquo;In the garb of CAA, he (Imam) exhorted people of a particular community to block highways leading to major cities and resort to ''chakka jaam''. Also, in the name of opposing CAA, he openly threatened to cut off Assam and other Northeastern states from the rest of the country,&rdquo; the charge sheet said.

A Delhi Court on Thursday granted bail to former JNU&nbsp;student&nbsp;Umar Khalid in a case related to the violence in Delhi on February 24, 2020 over the Citizenship Amendment Act (CAA) protests.
The court said that Khalid had been chargesheeted on insignificant material which is unwarranted, adding that there is no evidence of Khalid&rsquo;s presence at the scene of crime.
Opposing his bail, the prosecution had argued that many people related to the &lsquo;riotous mob&rsquo; are yet to be identified, but the Court said that Khalid cannot be incarcerated in jail for infinity just because others who were part of the mob have not yet been identified and arrested.
The charge sheet also accused Umar&nbsp;Khalid of &lsquo;criminal conspiracy&rsquo; in connection with former AAP counsellor&nbsp;Tahir Hussain and alleged that he had planned violence during the former US President Donald Trump's visit to Delhi. The court went on to say that it could not find any rationale in the act of the police involving Khalid in this isolated case for the offence of conspiracy.
The court, however gave him bail on several conditions - Khalid has been asked to furnish a personal bond of Rs 20,000, appear before the Court on every date of hearing, furnish his mobile number to the police upon his release from the jail and also install the &ldquo;Aarogya Setu App&rdquo;.
