The Bombay High Court on Monday quashed the convictions of 12 accused in the 2006 Mumbai train blasts case, citing lack of conclusive evidence by the prosecution.

The Bombay High Court on Monday quashed the conviction of 12 persons in the 2006 Mumbai train blasts case and acquitted them, noting the prosecution has "utterly failed" to prove the case against them.
The judgment comes 19 years after the terror attack that shook the city's Western Railway network, resulting in the loss of over 180 lives and leaving several others injured.
A special bench of Justices Anil Kilor and Shyam Chandak said the evidence relied by the prosecution was not conclusive to convict the accused persons.
"The prosecution has utterly failed to prove the case against the accused. It is hard to believe that the accused committed the crime. Hence their conviction is quashed and set aside," the HC said.
The bench said it refuses to confirm the death penalty imposed on five of the convicts and also the life imprisonment on the remaining seven, and acquitted them.
The court said the accused shall be released from jail forthwith if not wanted in any other case.
A special court in 2015 convicted the 12 persons in the case, of whom five were sentenced to death and the remaining seven were given life imprisonment.
After the HC's judgment was pronounced on Monday, the convicts, who were produced before the court via video conference from various jails across the state, thanked their lawyers.
On July 11, 2006, seven blasts ripped through Mumbai local trains at various locations on the western line, killing more than 180 persons and injuring several others.

In a minor relief to Jet Airways founder Naresh Goyal, the Bombay High Court on Monday granted him an interim medical bail of 2 months. The Enforcement Directorate arrested Naresh Goyal on a money laundering case.
"The applicant (Goyal) shall be released on interim bail for a period of two months. He shall abide by all conditions imposed," the bench said.

A single bench of Justice N J Jamadar said Goyal shall pay a surety of Rs 1 lakh and not leave Mumbai without prior permission from the trial court. The High Court has also asked Naresh Goyal to surrender his passport.&nbsp;
The Jet Airways founder sought the interim bail on medical and humanitarian grounds as both he and his wife Anita Goyal are suffering from cancer. A special court in February refused bail to Goyal but permitted him to be admitted in a private hospital of his choice and seek medical treatment.
Goyal then moved the HC, seeking bail on merits and to be released on interim bail on medical grounds. Goyal's counsel Harish Salve had urged the court to consider the case on humanitarian grounds.
However, ED's counsel Hiten Venegaonkar opposed the bail and said the agency did not have any problem if Goyal's hospitalisation was extended.
Venegaonkar had submitted that the court may extend Goyal's hospitalisation for a period of four weeks and then call for a fresh medical report to assess his situation. But Salve said that apart from deteriorating physical health, Goyal's mental health was also not good.
Goyal was arrested by the ED in September 2023 on allegations that he had laundered money and siphoned off loans to the tune of Rs 538.62 crore given to Jet Airways by the Canara Bank. His wife was arrested in November 2023 when the ED submitted its chargesheet in the case. She was granted bail by the special court the same day considering her age and medical condition

Bombay High Court's retired chief justice Ramesh Deokinandan Dhanuka was recently duped of ₹50,000 in an online banking scam. Police in Colaba filed a first information report (FIR) against an unknown individual for cheating the former chief justice of the Bombay High Court.&nbsp;
Police reported that Justice (Retd) Ramesh Deokinandan Dhanuka, 62, received a message on his mobile phone on November 27. In the message, it was mentioned that he needed to update his PAN card. Police further mentioned that the former chief justice was informed that his State Bank of India account would be closed if he failed to update the card.&nbsp;
Justice Dhanuka then clicked on the link and filled in his personal information. As soon as he clicked on the submit button, an amount of &nbsp;₹50,000 was deducted from his account.&nbsp;
After this, the SBI representative called Justice Dhanuka and told him that a transaction has been made from his account. However, Justice Dhanuka denied it and blocked his internet banking ID.&nbsp;
Later, Justice Dhanuka lodged a complaint on helpline number 1930 and gave a written statement to Colaba police on November 28.&nbsp;

The Supreme Court has imposed a cost of Rs 5 lakh on a man for claiming in a PIL that the oath taken by the Bombay High Court chief justice was "defective", and said it was a frivolous attempt to gain publicity.
A bench headed by Chief Justice DY Chandrachud said the oath having been administered by the Governor and having been subscribed to after the administration of the oath, such objections cannot be raised.
The top court said this was only a frivolous attempt to use the PIL jurisdiction to propagate some publicity for the petitioner.
"The petitioner does not, as he possibly cannot, dispute that the oath of office was administered to the correct person. The oath having been administered by the Governor and having been subscribed to after the administration of the oath, such objections cannot be raised.
"We are clearly of the view that such frivolous PILs occupy the time and attention of the Court thereby deflecting the attention of the court from more serious matters and consuming the infrastructure of the judicial manpower and Registry of the Court," the bench also comprising Justice JB Padriwala and Justice Manoj Misra said.
It said the time has come when the court should impose exemplary costs in such frivolous PILs.
"We accordingly dismiss the petition with costs of Rs 5,00,000, which shall be deposited by the petitioner in the Registry of this Court within a period of four weeks," the bench said.
The apex court said that if the cost is not deposited within the aforesaid period, the same shall be collected as arrears of land revenue through the Collector and District Magistrate at Lucknow.
The top court was hearing a PIL filed by Ashok Pandey contending that he is aggrieved by what he described as a 'defective oath' administered to the Chief Justice of the High Court of Judicature at Bombay.

Justice Rohit Deo, a judge of the Bombay High Court, on Friday, said he resigned due to personal reasons.
Making the announcement in his courtroom in Nagpur, where the high court has a bench, Justice Deo said that he could not compromise on self-respect, according to a lawyer who was present.
"Those who are present in the court, I apologise to each one of you. I scolded you because I want you to improve. I don't want to hurt anyone of you because you all are like family to me and I am sorry to tell you that I have submitted my resignation. I can't work against my self-respect. You people work hard," Justice Deo was quoted as saying in the courtroom by the lawyer.
Speaking to reporters later, the judge said he has quit due to personal reasons and sent his resignation letter to the President of India.
In 2022, Justice Deo acquitted former Delhi University professor GN Saibaba in an alleged Maoist links case, setting aside the life imprisonment awarded to him and noting that the trial proceedings were null and void in the absence of valid sanction under the Unlawful Activities (Prevention) Act (UAPA).
Last week, Justice Deo stayed the operation of a Maharashtra Government Resolution (order) of January 3 through which the state was empowered to cancel punitive proceedings initiated by the revenue department related to the illegal excavation of minor minerals by contractors engaged in the construction of the Nagpur-Mumbai Samruddhi Expressway.

The Aurangabad bench of the Bombay High Court has refused to permit a 15-year-old rape victim to abort her 28-week pregnancy as doctors have opined the baby would be born alive even if forcible delivery is performed at this stage.
The baby would require neonatal care, as per the doctors.
A division bench of Justices R V Ghuge and Y G Khobragade in its order of June 20 said if a child is going to be born even with forcible delivery, then they might as well let the baby be born full-term keeping its future in mind.
The court was hearing a petition filed by the rape victim's mother seeking permission to abort the girl's 28-week pregnancy.
The woman in the plea said her daughter went missing in February this year and was found with a man in Rajasthan three months later by police.
A case was lodged against the man under relevant sections of the Protection of Children from Sexual Offences (POCSO) Act.
A medical board after examining the girl said even if the pregnancy termination proceedings are done, the baby would be born alive and would have to be admitted in a neonatal care unit and the girl would also be at risk.
The HC bench noted a child would be born whether by forcible medical intervention or by natural delivery.
If a forcible delivery is to be done, then an underdeveloped child would be born and there would be chances of certain deformities being developed, it said.
"If in any case the child is going to be born and the natural delivery is just 12 weeks away, we are of the view that the health of the child and its physical and mental development need to be considered,&rdquo; the high court said.
&ldquo;When a live child is going to be born even today, we might as well let the child be born after 12 weeks and under medical advice. If later the petitioner desires to give away the child to an orphanage, she shall have the liberty to do so,&rdquo; it said.
The disadvantage of permitting forcible delivery of the child today is that the child who would have naturally developed into a well-grown baby will have to be brought into this world at a premature stage and that too forcibly, the court said.
If the baby is well developed and delivered naturally as a full-term baby, there would be no deformity and the chances of adoption would brighten, the HC said.
The girl's mother then sought the court to permit the girl to be kept in some NGO or hospital till she delivers the child.
The court said the girl could be kept either at a shelter home in Nashik which cares for pregnant women or the government's shelter home for women in Aurangabad.
After the baby is delivered, the girl will be at liberty to take a decision on whether to keep the baby or give the child up for adoption, the HC said.
