SC refused to stop the Bihar government from publishing caste survey data further.

The Supreme Court Friday refused to restrain the Bihar government from publishing further data from its caste survey, saying it cannot stop the state from taking any policy decision.
A bench of Justices Sanjiv Khanna and S V N Bhatti issued a formal notice on a batch of pleas challenging the August 1 order of the Patna High Court that gave the go-ahead for the caste survey in Bihar. It listed the matter in January 2024.
The top court rejected the objections of the petitioners that the state government has preempted the stay order by publishing some data and demanded that a complete stay should be ordered on further publication of data.
"We are not staying anything at this moment. We cannot stop the state govt or any govt from taking a policy decision. That would be wrong&hellip;We are going to examine the other issue regarding the power of the state govt to conduct this exercise," the bench said.
Senior advocate Aprajita Singh, appearing for the petitioners, said there is breach of privacy in the matter and the High Court order is wrong.
To this, the bench said since the name and other identities of any individual have not been published, therefore the argument that there was a breach of privacy may not be correct.
"The more important issue for consideration of the court is breakdown of data and its availability to the public," the bench said.
On October 2, the Nitish Kumar government in Bihar released findings of its caste survey, months ahead of the 2024 Parliamentary elections. The data revealed that OBCs and EBCs constitute a whopping 63 per cent of the state's total population.

Brahmins have the highest number comprising 3.65% of Bihar's population, while Rajputs form 3.45% of the population, showed caste survey.

The Bihar caste survey has revealed that 2,02,91,679 people or 15.52% of the state's total population belong to the general category, commonly known as the 'forward castes'.
Among these, Brahmins have the highest number, accounting for 3.65% of the state's population. Rajputs form the second biggest chunk with 3.45% of the population, while the Bhumihar's make up for 2.87%.
People belonging to the Kayastha caste form 0.60% of the state's population. According to the data, EBCs, OBCs, SCs and STs combinedly account for 84% of the state's population.
According to the Indian Express, the EBCs are the biggest social group comprising 4,70,80,514 individuals or 36.01% of the state&rsquo;s population. The OBCs number 3,54,63,936 (27.12%), and the Scheduled Castes (SCs) 2,56,89,820 (19.65%).&rsquo;
Scheduled Tribes (STs) number only 21,99,361 (1.68%), the bulk of the tribal population having become part of Jharkhand after the bifurcation of the state in 2000. The &ldquo;unreserved&rdquo; category comprises 2,02,91,679 individuals (15.52%).
Bihar&rsquo;s population, according to the survey, is 13,07,25,310, compared to the 10.41 crore recorded in the 2011 census.

The Bihar caste survey has shown that the people belonging to the Scheduled Castes, commonly known as Dalits make up for 19.65% of the state population. The tribals or the members of the Scheduled Tribes account for 1.68%.
Considered the most disadvantaged socio-economic groups, the groups jointly comprise 21.33% of the population.
Among the Dalits, Dusadhs account for 5.31%, while Chamars or Mochis form 5.25% of the state's population.
In central government jobs or centre-funded educational institutions, 17% of seats are reserved for SCs, while 7.5% for STs.

The results of the caste survey in Bihar showed that Hindus comprise 81.99% of the state's population, followed by Muslims with 17.70%.
Christians, Sikhs, Jains and those following other religions have a minuscule presence, together making up for less than 1% of the total population.
The data has revealed that OBCs and EBCs form the largest chunk, comprising 63% of the population, while people belonging to the general or unreserved category make up 15.52%.
According to the data released here by Development Commissioner Vivek Singh, the state&rsquo;s total population stood at a little over 13.07 crore, out of which the Extremely Backward Classes (36 per cent) were the largest social segment followed by the Other Backward Classes at 27.13 per cent.
Chief Minister Nitish Kumar came out with a statement lauding the teams of government officials who undertook the gigantic exercise.
He also said, "A meeting will soon be convened of all the nine political parties with an electoral presence in the state legislature and the facts and figures will be shared with them." RJD president Lalu Prasad, who is Kumar&rsquo;s ally as well as the father of his deputy Tejashwi Yadav, also issued a statement, declaring that the exercise will set the tone for &ldquo;a nationwide caste census which will be undertaken when we form the next government at the Centre&rdquo;.
