Scholar-activist Anand Teltumbde accused in the Bhima Koregaon case was released from a Navi Mumbai prison on Saturday.
On Friday the Supreme Court rejected the NIA's plea challenging his bail.
Earlier this week, the Bombay High Court had made a prima facie observation that there was no evidence for the offence of terrorist activity against Teltumbde.
73-year-old Teltumbde was arrested in April 2020 in a case related to alleged inflammatory speeches made at the Elgar Parishad conclave held in Pune on December 31, 2017.

A Special Court in Mumbai ordered the release of Gautam Navlakha in the 2017 Bhima Koregaon case. He will now live under house arrest for a month as per the Court's order

Gautam Navlakha, an accused in Elgar Parishad-Maoist links case, was released from Taloja prison in Navi Mumbai on Saturday evening and will live under house arrest for a month.
He was immediately taken to a building in Navi Mumbai's Belapur-Agroli area by a police team where he would be staying.
Navlakha left the prison around 6 pm, said a senior prison official.
On Friday afternoon, the Supreme Court had rejected the NIA's application opposing his house arrest. It had ordered that Navlakha be placed under house arrest "without fail" within 24 hours.

The Supreme Court on Tuesday will hear the plea filed by activist and an accused in the Bhima Koregaon-Elgar Parishad case seeking a permanent bail on medical grounds.

Bhima Koregaon case: SC lists Varavara Rao's plea for permanent medical bail on Tuesday 

One of the accused in the case, tribal rights activist Father Stan Swamy, who was suffering from similar ailments as the petitioner, passed away even before the trial could start in 2021.

The Supreme Court on Monday agreed to list a medical bail plea for hearing on Tuesday filed by activist and an accused in the Bhima Koregaon-Elgar Parishad case, P Varavara Rao, challenging the Bombay High Court order rejecting his prayer for permanent medical bail in the matter.&nbsp;
A bench headed by Justice U.U. Lalit responded to Solicitor General Tushar Mehta who requested that he be allowed to place on record a compilation of documents and the matter be heard tomorrow.&nbsp;
"Allow me to place it on record and have it tomorrow. His interim protection is till tomorrow," Mehta told the bench, also comprising Justices S R Bhat and Sudhanshu Dhulia.&nbsp;
Senior advocate Anand Grover, appearing for Rao, said he has no objection to this. "Can it be taken up today? I am ready, my friend is ready. We can finish it today," Grover said.&nbsp;
In his plea filed through advocate Nupur Kumar against the April 13 order of the high court, Rao has said, "The petitioner is an 83-year-old renowned Telugu poet and orator, who has undergone over two years of incarceration as an under-trial, and is currently enlarged on bail on medical grounds by the Bombay High Court respectfully submits that any further incarceration would ring the death knell for him as an advancing age and deteriorating health are a fatal combination".&nbsp;
The plea said Rao has challenged the high court order as he was not granted an extension of bail despite his advanced age and precarious health condition, and his prayer to shift to Hyderabad was also denied.&nbsp;

He was arrested on August 28, 2018 from his Hyderabad residence and is an under-trial in the Bhima Koregaon case for which an FIR was lodged by Pune police on January 8, 2018 under various sections of the Indian Penal Code (IPC) and the Unlawful Activities (Prevention) Act (UAPA).&nbsp;
The case pertains to alleged inflammatory speeches made at the Elgar Parishad conclave held in Pune on December 31, 2017, which, the police claimed, triggered violence the next day near the Koregaon-Bhima war memorial located on the outskirts of the western Maharashtra city.&nbsp;
The Pune police had also claimed that the conclave was organised by people with alleged Maoist links. Later, the National Investigation Agency took over the probe in the matter.&nbsp;
Initially, Rao said he was put under house arrest pursuant to an order of the apex court and ultimately, on November 17, 2018, he was taken into police custody and later, shifted to the Taloja jail. On February 22, 2021, the Bombay High Court had granted him bail on medical grounds and he was released from jail on March 6, 2021. &nbsp; On April 13, the high court had rejected the plea but extended the time for the activist to surrender before the Taloja prison authorities by three months, to enable him to undergo cataract surgery. It had also dismissed Rao's application seeking that he be permitted to stay in Hyderabad instead of Mumbai, while out on bail.&nbsp;

On Wednesday, the police submitted its report before the commission.

The Bombay High Court on Wednesday granted default bail to lawyer-activist Sudha Bharadwaj, who was arrested in the Elgar Parishad-Maoist links case in August 2018 under provisions of the stringent UAPA, but rejected the pleas of eight other co-accused, including Varavara Rao Sudhir Dhawale and Vernon Gonsalves.
A bench of Justices S S Shinde and N J Jamadar said in its order that Bharadwaj, accused of being part of a conspiracy to overthrow the Union government, was entitled to such bail and its denial would be in breach of her fundamental right to life and personal liberty guaranteed under Article 21 of the Constitution.
The bench directed that Bharadwaj, currently lodged in the Byculla women's prison here, be produced before the Mumbai special NIA court on December 8, and conditions of her bail and date of release be then decided by the special court.
Bharadwaj is the first among 16 activists and academicians arrested in the case to have been granted default bail. Poet-activist Varavara Rao is currently out on medical bail. Jesuit priest Stan Swamy died in a private hospital here on July 5 this year while waiting for medical bail. The others are all in custody as undertrials.
The HC on Wednesday rejected the default bail plea filed by eight other co-accused in the case - Sudhir Dhawale, Varavara Rao, Rona Wilson, Surendra Gadling, Shoma Sen, Mahesh Raut, Vernon Gonsalves and Arun Ferreira.
The petition filed by Bharadwaj and the one filed by Dhawale and others had raised the common primary argument that the judges, who had taken cognisance of the case filed against them by the Pune police in 2018, did not have the legal jurisdiction to do so.
As per their pleas, two additional sessions judges of the Pune sessions court, K D Vadane, who remanded Bharadwaj to custody, and R M Pande, who remanded Dhawale and the seven other petitioners to custody in 2018, had not been designated as special judges and therefore, could not have taken cognisance of their case registered for scheduled offences under the Unlawful Activities (Prevention) Act (UAPA).
Bharadwaj, through her counsel Yug Chaudhry, had raised the additional ground that Judge Vadane also passed an order granting additional time to the Pune police to file their charge sheet in the case.
As per the Criminal Procedure Code (CrPC), a charge sheet must be filed within 90 days of registration of an offence. According to the law, a prosecuting agency cannot detain an accused beyond the 90-day period without filing the charge sheet. The accused in such cases are entitled to default bail.
The 90-day period, however, can be extended by a court if it feels that the prosecution deserves more time to investigate the case.
In Bharadwaj's case, she was arrested in August 2018 and placed under house arrest. She was taken into custody on October 27, 2018 and remanded by Judge Vadane to 10 days of police custody thereafter.
On November 22, 2018, the Pune police sought extension of time for filing the charge sheet and Bharadwaj subsequently filed a plea seeking default bail on the ground that the 90-day period of her custody was over.
On November 26, Judge Vadane granted an additional 90 days to the Pune police to file their charge sheet.
Advocate Chaudhry argued before the HC that since Judge Vadane was not a designated special judge, his order extending time for filing of the charge sheet was not a legally valid one.
In effect, Bharadwaj was entitled to default bail, since she had been in custody for over 90 days without a charge sheet, he said.
The National Investigation Agency's (NIA) counsel, Additional Solicitor General Anil Singh, had opposed both the pleas and argued that the Pune sessions court taking cognisance of the case did not cause any prejudice to the accused persons.
The HC, however, held that the sessions judges did not cause any prejudice to the fundamental rights of the accused in taking cognisance of the case, but in allowing the Pune police's request for the extension of time to file their charge sheet, and thereby extending Bharadwaj's custody, the judge committed an error.
"We deem it appropriate to record that the aspect of prejudice operates in different spheres qua twin challenges--namely, the challenge to the authority to grant the extension of period of detention, and competence to take cognisance. The former, in our view, stands on a higher pedestal," the HC said.
"By a catena of decisions, it has been held that the right of the accused to be released on bail, if the investigation is not completed and charge sheet is not filed within the period prescribed under the CrPC and as extended by special enactments, is indefeasible," it said.
The HC further said that such extension of an accused's custody infringed upon his or her "fundamental right flowing from the procedure established by law under Article 21 of the Constitution of India".
The high court held that the Pune judges were not competent to either take cognisance of the said case and to extend the time for filing of charge sheet.
However, while taking cognisance of the case did not cause any prejudice to the rights of the petitioner accused persons, extending the time for filing of charge sheet and in the process, extending Bharadwaj's detention in the absence of a charge sheet was in breach of her fundanental right to life and liberty, the HC said.
Such an extension of time for filing the charge sheet could have only been granted by a designated special judge, the court observed.
It, accordingly, granted default bail to Bharadwaj and rejected the pleas filed by Dhawale and the seven others, who had raised the primary grievance of cognisance.
"The aspect of competence to take cognisance, on the other hand, is a matter which does not necessarily entail the consequence on personal liberty," the HC said.
"The failure to take cognisance or defect in jurisdiction in taking cognisance, once the charge sheet was laid, does not entail the consequence of default bail," it said.
The HC refused to accept the NIA's request for a stay on its order granting default bail to Bharadwaj.
Just as the bench was about to pronounce its order on the two pleas by Bharadwaj and others, ASG Singh intervened, saying he wished to bring to the court's notice a recent judgement of the Supreme Court, which held that an error in taking cognisance of a case did not automatically make the accused person entitled to default bail.
The HC, however, said once it had reserved orders in a case, there was no question of the parties citing new judgements.
"We are aware of the SC judgement that you are talking about. That is why we have rejected the second petition (Dhawale and others)," the HC said.
"Also, in default bail, there can't be any stay granted. Let the special court decide on her (Bharadwaj's) bail conditions now," it said.
The case relates to alleged inflammatory speeches delivered at the Elgar Parishad conclave, held at Shaniwarwada in Pune on December 31, 2017, which the police claimed triggered violence the next day near the Koregaon-Bhima war memorial located on the city’s outskirts.
The Pune police had claimed the conclave was backed by Maoists. The probe in the case was later transferred to the NIA.

Hearing appeals filed by&nbsp;late Jesuit priest Stan Swamy&nbsp;in the Bhima&nbsp;Koregaon-Elgaar Parishad case posthumously on Monday, the Bombay High Court remarked that the tribal rights activist was a 'wonderful person' and the court has 'great respect' for his work.
The observations were made by a bench of Justices S S Shinde and N J Jamadar that had also presided over&nbsp;Swamy&rsquo;s medical bail plea&nbsp;on July 5, when the HC was informed about the&nbsp;84-year-old priest&rsquo;s death at the Holy Family Hospital&nbsp;in Mumbai that day following a cardiac arrest.
Swamy, who was arrested in the Bhima Koregaon-Elgaar Parishad case on October 8, died at the Holy Family Hospital on July 5, where he was shifted on the directions of the Bombay High Court in May after his health began deteriorating.

Swamy, who was arrested in the Bhima Koregaon-Elgaar Parishad case on October 8, died at the Holy Family Hospital on July 5, where he was shifted on the directions of the Bombay High Court in May after his health began deteriorating.

They further stated that Swamy was denied treatment for his various ailments including debilitating Parkinson&rsquo;s, adding that even a sipper to drink liquids was made available to him in jail only after a nationwide protest.
