The Supreme Court has granted custody of the four-year-old son of Atul Subhash, a Bengaluru techie who tragically died by suicide in December, to his estranged wife, Nikita Singhania. This decision came after a plea was filed by Anju Devi, the mother of Mr. Subhash, seeking custody of her grandson.
The ruling, made by Justices BV Nagarathna and SC Sharma, came after a brief video interaction with the child. The court concluded that the child should stay with his mother, emphasizing that the boy had not spent enough time with his grandmother. The judges considered what was in the best interest of the child, taking into account his minimal bond with his maternal grandmother.
The legal battle began when Anju Devi filed a plea after her daughter-in-law, Nikita Singhania, and her family were accused of abetting Atul Subhash's death. Although Singhania, along with her mother and brother, was initially arrested on these charges, they were later granted bail.
In a prior hearing, Ms. Singhania informed the court that her son was attending a boarding school in Faridabad, Haryana, but she planned to move with him to Bengaluru to meet bail conditions.
Justice Nagarathna acknowledged that while Anju Devi's concerns were valid, custody matters were better suited to a lower court with jurisdiction over family-related cases. The judge also remarked that the child was "practically a stranger" to the grandmother.
Background
Atul Subhash and Nikita Singhania married in 2019 and had their son in 2020. Their relationship deteriorated in 2021, and in 2022, Ms. Singhania filed a case against her husband and his family.
Atul Subhash was found dead on December 9, 2024, in his Bengaluru apartment, leaving behind a heartbreaking 81-minute video and a 24-page suicide note. In the note, he accused Nikita Singhania and her family of harassment and attempting to extort ₹3 crore from him.
The case has sparked a nationwide conversation about the possible abuse of legal protections meant to safeguard women, as well as concerns about the potential weaponization of such laws.
The court's decision has been met with mixed reactions. Some have welcomed the emphasis on the child&rsquo;s best interests, while others call for further investigation into the serious allegations made by Atul Subhash before his death.

The Supreme Court on Tuesday denied the mother of Atul Subhash, Bengaluru techie who died by suicide in 2024, his minor son's custody saying she was "stranger to the child".
A bench of Justices Bela M Trivedi and N Kotiswar Singh said the issue of the child's custody could be raised before the court conducting the trial.
"Sorry to say but the child is a stranger to the petitioner. If you wish, please visit the child. In case you want the custody of the child, there is a separate procedure," said the bench.
Subhash, 34, who was found hanging at his house in Bengaluru&rsquo;s Munnekolalu on December 9, 2024, purportedly left behind lengthy messages, blaming his wife and in-laws for taking the extreme step.
The top court was hearing a habeas corpus petition filed by Anju Devi, Subhash's mother, seeking custody of her four-year-old grandson.
During the hearing, the top court was informed by the counsel appearing for Subhash's estranged wife Nikita Singhania that the child was studying at a boarding school in Haryana.
"We will take the child to Bengaluru. We have taken the boy out of school. The mother has to remain in Bengaluru to fulfil the bail conditions," submitted the counsel.
Advocate Kumar Dushyant Singh, representing Devi, sought the child's custody and alleged her estranged daughter-in-law had kept child&rsquo;s location under wraps.
He argued a child below six years of age should not be sent to a boarding school and relied on photos to show the petitioner interacting with the child when he was only a couple of years old.
The apex court directed the child to be produced in court on the next hearing on January 20, and said the case couldn't be decided on the basis of a media trial.
A Bengaluru court on January 4 granted bail to Subhash&rsquo;s estranged wife, her mother Nisha Singhania and brother Anurag Singhania, in the suicide abetment case.
Following his death, an FIR was registered in Bengaluru against Nikita and her family under Sections 108 (abetment of suicide) and 3(5) (common intention) of the Bharatiya Nyaya Sanhita, 2023.

The court emphasized that alimony is meant to provide the dependent spouse with a reasonable standard of living, not to equalize financial disparities between former partners.
The judgment came in the context of a high-profile case involving tech professional Atul Subhas, who claimed that his estranged wife and her family had demanded a monthly maintenance of Rs 2 lakh, later increasing it to Rs 3 crore annually.
A bench of Justices BV Nagarathna and Pankaj Mitha, while dissolving the marriage on the grounds of irretrievable breakdown, directed the husband to pay Rs 12 crore as a full and final alimony settlement. The court stressed that maintenance should not be used as a tool for coercion or exploitation.
"The women need to be careful about the fact that these strict provisions of law in their hands are beneficial legislation for their welfare and not means to chastise, threaten, domineer or extort from their husbands," the bench remarked.
The wife had claimed her husband&rsquo;s net worth exceeded Rs 5,000 crore, with businesses and properties in both the US and India, and that he had paid his first wife at least Rs 500 crore during their separation, excluding a house in Virginia.
The court highlighted the importance of a balanced approach, considering not just the income of the husband, but also the wife&rsquo;s income, reasonable needs, and residential rights.
"We have serious reservations with the tendency of parties seeking maintenance or alimony as an equalisation of wealth with the other party. It is often seen that parties in their application for maintenance or alimony highlight the assets, status and income of their spouse, and then ask for an amount that can equal their wealth to that of the spouse," the court stated.
The bench further asked, "We wonder, would the wife be willing to seek equalisation of wealth with the husband if due to some unfortunate events post-separation, he has been rendered a pauper?"
The court also addressed concerns over the misuse of criminal complaints, noting instances where wives and their families use such complaints as leverage to pressure husbands and their families for financial demands.
The Supreme Court quashed the criminal cases filed by the wife against her estranged husband, sending a clear message about the need for fair and just use of legal provisions.

The court emphasized that these guidelines should be applied consistently across the country. The eight factors for determining alimony include:

A day after a 34-year-old techie from Uttar Pradesh died by suicide after blaming his wife and her family, the police on Tuesday said they have been booked for abetment of suicide. &nbsp; &nbsp;&nbsp; Atul Subhash, who worked for a private firm in Bengaluru, left behind a 24-page death note, giving extensive details of what he alleged was years long of emotional distress of marital issues; multiple cases filed against him and harassment by his wife, her relatives, and a judge based in Uttar Pradesh, police said. &nbsp; &nbsp;&nbsp; Subhash's body was found hanging at his residence in the Manjunath Layout area, which falls under the Marathahalli police station limits, they added. A placard reading "Justice is due" was found in the room where he ended his life. &nbsp; &nbsp;&nbsp; Before taking the drastic step, he recorded an over 80-minute video on Rumble, explaining the circumstances under which he had decided to die by suicide. &nbsp; &nbsp;&nbsp; In the video, which has now gone viral on social media platforms, Subhash can be heard saying, "I feel that I should kill myself because the money I earn is making my enemies stronger. That same money will be used to destroy me, and this cycle will keep going. &nbsp; &nbsp;&nbsp; "With the money from my taxes, this court and police system will harass me, my family, and other good people. So, the supply of value should be finished." &nbsp; &nbsp;&nbsp; He demanded that, after his death, his wife and her family should not be allowed near his body. Until his alleged harassers were punished, he asked his family not to immerse his ashes. &nbsp; &nbsp;&nbsp; Demanding justice, Subhash urged his family to throw the ashes outside the court's gutter if his alleged harassers were not found guilty. &nbsp; &nbsp;&nbsp; "Based on a complaint from his family, we have registered a case of abetment of suicide against his wife and her family members. All the allegations are being looked into, and we are investigating the matter," a senior police officer said. No arrests have been made yet, he added. &nbsp; &nbsp;&nbsp; According to police, preliminary investigations revealed that Subhash had been facing marital discord with his wife, who had also registered a case against him in Uttar Pradesh. &nbsp; &nbsp;&nbsp; He also sent his death note via email to several people and shared it with a WhatsApp group of an NGO he was associated with, the officer said. &nbsp; &nbsp;&nbsp; Additionally, in his death note, Subhash requested that custody of his child be granted to his parents, stating that they could "provide better values". &nbsp; &nbsp;&nbsp; In his death note, Subhash mentioned getting married in 2019. The couple had a son, the following year. &nbsp; &nbsp;&nbsp; He alleged that his wife&rsquo;s family repeatedly harassed him for money, demanding several lakh. When he refused, his wife reportedly left their Bengaluru home with their son in 2021, he alleged in this suicide note. &nbsp; &nbsp;&nbsp; Subhash further alleged, "My wife will keep my child alienated and file more cases to harass me, my elderly parents, and my brother, using the money I pay her as maintenance. Instead of using it for our child's welfare, she is weaponising it against us."
