Hathras Case: UP Requests Supreme Court to monitor CBI probe

The UP government urged the Supreme Court to monitor the CBI probe into the Hathras&nbsp;case &amp; direct the agency to submit fortnightly&nbsp;reports

The Uttar Pradesh government on Wednesday requested the Supreme Court to monitor the CBI probe into the alleged gang rape and torture of the Hathras Dalit woman who died last month in the capital. The state government also requested the top court to direct the investigating agency to submit fortnightly status reports.
It stressed on its &lsquo;commitment to provide complete security to victims' family and witnesses&rsquo; and in its affidavit submitted a list of police personnel posted for security. The apex court was informed that eight CCTV cameras have been installed outside the victim&rsquo;s home to keep a watch.

Hathras gangrape: What SC said on protection of victim's family

While directing the Uttar Pradesh govt to file an affidavit about the steps taken to protect the witnesses in the case and also inform if the victim&rsquo;s family chosen a lawyer, the Supreme Court termed the&nbsp;Hathras&nbsp;gangrape &lsquo;horrible&rsquo; and &lsquo;shocking&rsquo;.&nbsp;&nbsp;
Senior Advocate Indira Jaising who appeared on behalf of some intervenors told the Supreme Court that fair investigation warrants protection of the victim&rsquo;s family and witnesses in the case. The UP govt however argued that the family was already under protection. The SC&nbsp;asked&nbsp;UP govt to submit a report by October 8.&nbsp;&nbsp;
While saying it will&nbsp;it will ensure that the&nbsp;probe&nbsp;is smooth in the case, the&nbsp;SC&nbsp;bench&nbsp;of&nbsp;Chief Justice S A Bobde and Justices A&nbsp;S Bopanna and V Ramasubramanian&nbsp;also asked to know if the victim&rsquo;s family had chosen a lawyer. &nbsp;
&nbsp;The apex court&nbsp;heard&nbsp;a PIL seeking a CBI or a SIT probe monitored by a sitting or retired Supreme Court or High Court judge. &nbsp;&nbsp;

With the Supreme Court setting August 31 as the deadline and later extending it by a month for the CBI court to give its verdict&nbsp;in&nbsp;Babri&nbsp;demolition, the trial court started day-to-day hearing to complete the task in time.&nbsp;The central agency produced 351 witnesses and 600 documents as evidence before the court. Charges were framed against 48 people, but 17 have died during the course of trial.&nbsp;The trial under the serious criminal conspiracy charges commenced against the&nbsp;accused&nbsp;after having been dropped by the trial court in 2001. The verdict was upheld by the Allahabad High Court in 2010, but the apex court ordered restoration of the conspiracy charge against them on April 19, 2017.&nbsp;The top court ordered daily hearing in the high-profile case and directed the special judge to conclude it in two years.&nbsp;

The two episodes of the show were to be aired on Tuesday and Wednesday.&nbsp;Terming it a 'rabid&nbsp;programme' 'without any factual basis', a&nbsp;three-judge SC bench observed&nbsp;that&nbsp;at this stage, prima facie it does appear the&nbsp;programme 'vilifies the Muslim community' while adjourning the matter to September 17. Asking can such&nbsp;programmes&nbsp;be allowed in a free society, the&nbsp;bench of&nbsp;Justices D Y Chandrachud, KM Joseph and Indu Malhotra said 'such insidious charges also put a question mark on the UPSC&nbsp;exams'.&nbsp;The bench told&nbsp;Sudarshan TV&nbsp;lawyer&nbsp;that&nbsp;his&nbsp;client is doing a 'disservice to the nation'.&nbsp;The apex court observed that revenue model of TV channels and their ownership patterns should be put in public domain on the website.&nbsp;

The Supreme Court on Friday is scheduled to consider a review plea by six opposition-ruled states against its&nbsp;earlier order&nbsp;allowing the NEET&nbsp;and JEE&nbsp;entrance examinations amid&nbsp;Covid-19&nbsp;pandemic. While rejecting the plea for further postponement of exams, the apex court had said that &ldquo;life cannot be stopped&rdquo; and the &ldquo;career of students cannot be put in jeopardy&rdquo;. Six ministers from Maharashtra, Punjab, West Bengal, Jharkhand, Rajasthan and Chhattisgarh had&nbsp;moved the apex court&nbsp;saying that if the order is not reviewed, &ldquo;grave and irreparable harm and injury would befall on the student community&rdquo;. The JEE&nbsp;Mains exam is currently underway and will end on Sunday.&nbsp;
