<p>The Allahabad High Court has sought responses from four major political parties of Uttar Pradesh on a plea seeking a complete ban on caste-based rallies in the state.</p>

<p>The Lucknow bench of the Allahabad High Court on Monday issued notices to the four major political parties of Uttar Pradesh seeking their response on a PIL seeking a complete ban on caste-based rallies.</p>
<p>The bench has fixed April 10 as the next date of hearing in the matter.</p>
<p>A bench of Chief Justice Arun Bhansali and Justice Jaspreet Singh passed the order on an old Public Interest Litigation (PIL) filed by local lawyer Motilal Yadav.</p>
<p>The petitioner had sought a ban on the caste-based rallies in Uttar Pradesh. Hearing the matter on July 11, 2013, the bench had put an interim ban on organising caste-based rallies in the state.</p>
<p>The bench had also issued notices to the main political parties -- the BJP, the Samajwadi Party, the BSP and the Congress -- to submit their response in the matter.</p>
<p>The bench found on Monday that the notices were not served to the said political parties.</p>
<p>Expressing concern over this, the bench has issued fresh notices to enable the political parties to file their response.</p>
<p>Meanwhile, the Election Commission of India has filed the response, but since the copy of the response was not traceable on record, the bench has sought fresh copy of its response.</p>
<p>In its order passed in 2013, the bench had observed, "The unrestricted freedom to hold caste-based rallies, which is to the total disliking and beyond the comprehension of the modern generation and also being contrary to the public interest, cannot be justified. It will rather be an act of negating the rule of law and denying the fundamental rights to citizens." The bench had also said, "In their attempt to seek political base in the caste system by means of politicization, it appears that the political parties have seriously disturbed the social fabrics and cohesiveness. It has rather resulted in causing social fissions." In the PIL, the petitioner submitted that the caste minorities in the country, because of anti-democratic activities of political parties designed in order to woo the votes of majority groups, have been reduced to the category of second-class citizens in their own country.</p>
<p>"Despite the clear constitutional provisions and the fundamental rights enshrined therein, they are feeling disillusioned, dismayed and betrayed because of being placed in disadvantageous position in the number game of vote politics," the petitioner added.</p>

<p>The Allahabad High Court has ruled that an unmarried daughter, irrespective of her religion or age, has the right to obtain maintenance from their parents under the Domestic Violence Act.</p>
<p>The high court made the observation while dismissing a petition filed by Naimullah Sheikh and another under the Protection of Women from Domestic Violence Act, 2005. The parents of three daughters had challenged a lower court's order granting maintenance to them.</p>
<p>"There remains no doubt that an unmarried daughter, whether Hindu or Muslim, has a right to obtain maintenance, irrespective of her age. This is made clear again that the courts have to look for other laws applicable when the question pertains to the right to be maintained. However, where the issue does not pertain to mere maintenance, the independent rights are available to an aggrieved under section 20 of the domestic violence act itself," Justice Jyotsna Sharma observed.</p>
<p>The three daughters had filed a case in a court claiming maintenance under the Act, alleging mistreatment by their father and stepmother. The trial court ordered interim maintenance, which was challenged by the respondents arguing that the daughters were adults and financially independent.</p>
<p>In the decision dated January 10, the high court rejected the petitioners' argument that the daughters, being majors, cannot claim maintenance.</p>
<p>The court emphasised that the Domestic Violence (DV) Act aims to provide more effective protection to women. It further added that the substantive right to receive maintenance may emanate from other laws, however, quick and shorter procedure to obtain the same has been provided in the 2005 Act.</p>
<p>It was submitted on behalf of the petitioners that the learned court below failed to consider the fact that their father is an old and infirm person having no source of income and that he has already been maintaining the respondents and that the application for grant of maintenance under the DV Act, was filed at the behest of their maternal uncle.</p>

<p>The Supreme Court on Tuesday stayed the Allahabad High Court order that allowed a court-monitored survey of the Shahi Idgah mosque adjoining the Krishna Janmabhoomi temple in Mathura.</p>
<p>A bench of Justices Sanjiv Khanna and Dipankar Datta stayed the implementation of the December 14, 2023 order by which the HC had agreed to the appointment of a court commissioner to oversee the survey of the mosque premises which, the Hindu side claims, hold signs suggesting that it was a temple once.</p>
<p>The bench said there are certain legal issues which have arisen and questioned the &ldquo;vague&rdquo; application made before the high court for appointment of a court commissioner for the survey.</p>
<p>&ldquo;You can&rsquo;t file a vague application for appointment of court commissioner. It should be very specific on the purpose. You can&rsquo;t leave everything to the court to look into it,&rdquo; the bench told senior advocate Shyam Divan, appearing for Hindu bodies like Bhagwan Shri Krishna Virajman and others. The bench said it is issuing a notice to the Hindu bodies and sought their response by January 23, while making it clear that proceedings before the high court in the dispute will continue.</p>
<p>The top court was hearing a plea of the Committee of Management, Trust Shahi Masjid Idgah challenging a high court order that allowed a court-monitored survey of the Shahi Idgah.</p>
<p>The mosque committee, in its plea, has submitted that the high court ought to have considered its petition for rejection of the plaint before deciding on any other miscellaneous applications in the suit.</p>
<p>The committee had sought rejection of the plea on the grounds that the lawsuit is barred by the Places of Worship (Special Provisions) Act, 1991, which prohibits conversion of any place of worship and to provides for the maintenance of their religious character. The law was brought to prevent a religious dispute like that over Ram Janmabhoomi in Ayodhya.</p>

<p>The survey will be carried out by advocate commissioners appointed by the court.&nbsp;</p>
<p>The peition seeking the survey claimed that Krishna's birthplace lies beneath the mosque and that there are many signs which establish that the mosque was a Hindu temple.</p>

<p>Allahabad High Court has slammed the makers of &lsquo;Adipurush&rsquo; over its dialogues that have irked a large section of the audience.</p>
<p>The court directed co-writer Manoj Muntashir Shukla to be made a party in the case and issued a notice directing him to respond within a week.</p>
<p>The court said Ramayana is a paragon and people read Ramcharitmanas before leaving home.</p>
<p>It added that films shouldn't touch certain things.</p>
<p>The Allahabad High Court further questioned if the censor board fulfilled its responsibility.</p>
<p>The court said that it is good that people did not harm the law and order situation after watching the film.</p>
<p>&lsquo;Lord Hanuman and Sita have been shown like they are nothing. These things should have been removed from the very beginning. Some scenes seem to be of "A" (adult) category. It's very difficult to watch such films," the court observed.</p>
<p>When the Deputy Solicitor General informed the court that the objectionable dialogues have been removed from the film, the court asked him to ask the censor board what it has been doing.</p>
<p>&lsquo;That alone won't work. What will you do with the scenes? Seek instructions, then we will definitely do whatever we want to do... In case the exhibition of the film is stopped, then the people whose feelings have been hurt, will get relief,&rsquo; the court said.</p>
<p>Regarding the argument of the respondents that a disclaimer had been added to the film, the bench said, &lsquo;Do the people who put the disclaimer consider the countrymen, and youth, to be brainless? You show Lord Rama, Lord Laxman, Lord Hanuman, Ravana, Lanka and then say it is not Ramayana?&rsquo;</p>

<p>Hearing in the case will continue on June 28.</p>

“The legal questions of sanction will be kept open to be dealt with an appropriate case,” the bench also comprising Justices Hima Kohli and C T Ravikumar said.
In its verdict delivered in February 2018, the high court had said it has not found any procedural error either in the conduct of an investigation or in the decision-making process of refusal to grant sanction to prosecute.
An FIR was lodged at a police station in Gorakhpur against Adityanath, then a Member of Parliament, and several others on alleged charges of promoting enmity between two groups.
It was alleged that several incidents of violence were reported in Gorakhpur on that day after an alleged hate speech by Adityanath.
