Ajit Pawar-led faction was declared as the real Nationalist Congress Party by Maharashtra Speaker Rahul Narwekar. The speaker also refused to disqualify the 41 MLAs who rebelled against Sharad Pawar in June last year, which eventually split the party into two factions.
&ldquo;All the petitions seeking disqualification of MLAs are rejected,&rdquo; Narwekar said, reading out the ruling at the legislature complex here.
The disqualification petitions were filed by the rival factions led by Sharad Pawar and his nephew Ajit Pawar after Ajit Pawar joined the Shiv Sena-BJP government in Maharashtra in July 2023 along with his followers, and was sworn in as deputy Chief Minister. Questioning party founder Sharad Pawar&rsquo;s decisions or defying his wishes did not amount to defection but it was only internal dissent, Narwekar said in the ruling, adding that the tenth schedule of the Constitution, which deals with anti-defection provisions, was misused in this case.
Party leadership can not use tenth schedule to stifle dissent of large number of members by threatening to disqualify them, Narwekar said, reports PTI news agency.
The events that unfolded in the NCP (in July 2023) were clearly in the nature of intraparty dissent, the ruling held.
The Ajit Pawar faction had &ldquo;overwhelming&rdquo; legislative majority when the party split, the Speaker noted.
Decisions of the Ajit Pawar faction constituted the `will of the NCP political party&rsquo;, he said.
Narwekar&rsquo;s ruling followed the decision of the Election Commission last week to hold the Ajit Pawar-led party to be the real NCP.
Reacting to the Speaker&rsquo;s decision, Supriya Sule, MP of the NCP &ndash; Sharadchandra Pawar party, said it was a &ldquo;copy-paste&rdquo; of Narwekar&rsquo;s earlier decision in the Shiv Sena disqualification case
Before the split, the NCP had 53 MLAs.&nbsp;

The Sharad Pawar camp of the Nationalist Congress Party will move the Supreme Court against the Election Commission decision recognising the faction led by his nephew Ajit Pawar as the real NCP.
In a big setback to senior Pawar, the EC also allotted the party's poll symbol 'Clock' to the Ajit Pawar group.
The Maharashtra Deputy Chief Minister said the EC ruling underlined the priority assigned to the majority in a democracy. "In a democracy, priority is given to the majority which is why the poll commission has allotted the party name and symbol to us," Ajit Pawar said.
He said 50 NCP MLAs are with his camp, besides most of the district presidents in the state and chiefs of the party cells (frontal organisations).
Senior NCP leader Praful Patel said the EC ruling proves that the majority of party workers and elected representatives are with Ajit Pawar.
Sharad Pawar's daughter and Rajya Sabha MP Supriya Sule termed the decision as a victory of "invisible power" and conspiracy against the people of the state. "This is a huge conspiracy against Maharashtra and Marathi people. However, I am not at all surprised by this decision," she said.
Sharad Pawar loyalist and former state minister Anil Deshmukh dubbed the decision a "murder of democracy". "What happened is unfortunate. The poll panel gave this ruling under pressure from above,&rdquo; Deshmukh told a TV channel.
Maharashtra NCP president (Sharad Pawar group) Jayant Patil said the Supreme Court is the "last hope" for them and they are expecting a stay on the EC ruling.
Maharashtra Chief Minister Eknath Shinde and his deputy from BJP, Devendra Fadnavis, welcomed the poll body's decision.
"The Election Commission has given the verdict based on merit and majority. The majority has an important role in democracy. The ECI has taken a similar decision during our case as well," said Shinde, who heads Shiv Sena.
He said the Shiv Sena, BJP, and NCP led by Ajit Pawar will win more than 45 LS seats in Maharashtra and the assembly elections as well.

"I am the president of NCP," veteran Sharad Pawar asserted on Thursday after a meeting of the party's Working Committee which approved the decision to expel Praful Patel, Sunil Tatkare and nine others who joined hands with NDA recently.
Briefing the media, party leader P C Chacko said eight resolutions were passed in the meeting.
Pawar also said the "truth will come out" on Ajit Pawar' claim of having majority.
Chacko said the organisation was behind Pawar.
"NCP Working Committee approves decision to expel Praful Patel, Sunil Tatkare and nine who joined hands with NDA. Sharad Pawar was elected national president. We don't take seriously claims of someone being national president.
"Our organisation still intact and we are with Sharad Pawar," Chacko asserted.
He also said every three years, NCP holds elections and people are elected regularly.
The resolutions passed by the working committee include a stand against the undemocratic and unconstitutional actions of the BJP government and the misuse of government agencies against the Opposition.
It also condemned the central government policies resulting in spiralling inflation, unemployment and women's plight.
Several of them have been accused of corruption and are being investigated by central probe agencies.&nbsp;

Nine NCP MLAs, including Ajit Pawar, were sworn-in as ministers in the Maharashtra government at a surprise cabinet expansion on Sunday.

Maharashtra deputy chief minister Ajit Pawar-led NCP has informed the Election Commission that he has been elected national president of the party.
A statement issued on Wednesday on behalf of the Ajit Pawar-led faction said the Election Commission has been informed through an affidavit that he was elected NCP chief through a resolution dated June 30, 2023, signed by an "overwhelming majority" of members of NCP, both from the legislative and organisational wing.
Praful Patel continues to be NCP working president, the release said.
The NCP has also decided to appoint Ajit Pawar as the leader of the NCP Legislative Party in the Maharashtra Legislative Assembly and this decision was also ratified by the resolution passed by an overwhelming majority of NCP MLAs, the statement said.
&ldquo;An attempt is being made by certain elements within the NCP to spread a sense of fear and confusion amongst the elected representatives of the NCP and also the party cadre working in different organisational posts of NCP,&rdquo; the release said.
&ldquo;The earlier appointment of Jayant Patil as the state president of Maharashtra NCP was patently illegal since the same was done without following any procedure mandated by the constitution of NCP,&rdquo; it said.
Praful Patel, in his capacity as the working president of NCP, has removed Patil from the post and appointed Sunil Tatkare as state NCP president, the statement said.
&ldquo;The National President as well as all the other office bearers of the party were appointed in an alleged National Convention dated 10th/11th September 2022. The said appointment is itself a void and ab initio since there is absolutely no record of the persons who attended the national convention and voted in favour of Shri Sharad Pawar,&rdquo; the statement said.
The factional fight of the Nationalist Congress Party (NCP) has reached the doorstep of the Election Commission with the group led by Ajit Pawar filing over 40 affidavits of MLAs and MPs in his support.
The Sharad Pawar camp has filed a caveat with the poll authority urging it to hear them first before passing any directive in connection with the factional fight, Election Commission sources said.
The Election Commission is likely to process applications in the coming days and ask both sides to exchange the respective documents submitted before it.

Surrounded by party workers, including 32 of NCP&rsquo;s 53 MLAs, Maharashtra deputy chief minister Ajit Pawar on Wednesday reminded his 83-year-old uncle Sharad Pawar that it was time for him to retire.
"In BJP, leaders retire at 75, when are you going to stop,&rdquo; Ajit Pawar said, speaking at the meeting convened by him in suburban Bandra as a show of strength.
&ldquo;Everybody has his innings. The most productive years are from 25 to 75 years,&rdquo; 63-year-old Ajit Pawar said.
He also blamed Sharad Pawar for NCP losing out on the chance to have a chief minister in 2004. &ldquo;We had more MLAs than Congress in 2004, but our senior leader allowed Congress to bag the CM's post,&rdquo; he said.
&ldquo;For us, Saheb (Sharad Pawar) is a deity and we have deep respect for him,&rdquo; he said.
&ldquo;IAS officers retire at 60. Even in politics, BJP leaders retire at 75. You can see the example of L K Advani and Murli Manohar Joshi,&rdquo; Ajit Pawar said.
&ldquo;You are 83, aren't you going to stop? Give us your blessings and we will pray that you live a long life,&rdquo; Ajit Pawar said.&nbsp;
