Shraddha Walkar murder: court frames charges against Aftab Poonawala for murder, disappearance

Poonawala had scattered pieces of Walker's body at different places in the national capital to avoid getting caught and the police were not able to recover all the body parts.&nbsp;

&nbsp;A court Tuesday framed charges of murder and disappearance of evidence against Aaftab Amin Poonawala who is accused of strangling his live-in partner Shraddha Walkar to death and chopping her body into pieces.
Additional Sessions Judge Manisha Khurana Kakkar said prima facie a case for offences under IPC sections 302 (murder) and 201 (causing disappearance of evidence of offence) was made out against the accused.
Poonawala, however, denied the charges and demanded a trial. The matter has been posted for further proceedings on June 1.
The Delhi Police had filed a 6,629-page charge sheet in the case on January 24.
Walkar was allegedly strangled by Poonawala on May 18 last year, following which he sawed her body into pieces and kept them in a fridge for almost three weeks at his residence in South Delhi's Mehrauli.
He scattered the pieces at different places in the national capital to avoid getting caught.&nbsp;

The Delhi Police chargesheet notes that Aaftab Poonawalla kept moving Shraddha Walker's body from the refrigerator to the kitchen cabinets whenever his dating app partner visited his flat.&nbsp;
The 6,629-page charge sheet against Poonawala in the Mehrauli murder case states that after she left, he would reposition Shraddha body. Poonawalla brought a fridge so that he could dispose of the body parts more easily.
Poonawalla allegedly cut Shraddha's body into 17 pieces, dividing her hands, legs, and other body parts into three pieces. He initially deceived the police by claiming that he crushed and disposed of Shraddha's body in a stone grinder.

This contrasts police's assertion that Poonawala has confessed to killing Walker and dumping her body parts at different locations across Delhi.

Aaftab Amin Poonawala has not yet confessed to killing his live-in-partner Shraddha Walkar in the court of law, his lawyer said on Tuesday.

"I spoke to Poonawala for five-seven minutes today. When I spoke to him in the morning, he appeared relaxed and was very confident. He did not show any signs of aggressiveness," said Defence Counsel Abinash Kumar, who is representing Poonawala.
The lawyer said when he asked Poonawala if he is able to follow the legal proceedings in the case and if he was satisfied with the defence, he replied in the affirmative "He has never confessed in the court of law that he killed Walkar," Kumar told PTI.
This contrasts police's assertion that Poonawala has confessed to killing Walker and dumping her body parts at different locations across Delhi.
Kumar said Poonawala's family is scared to come out and they are waiting for the matter to subside a bit.
"They are scared after what has happened and wish to stay out of media glare for now. Even I have not been able to meet them yet. I am also planning to file a plea in the court to get in touch with Poonawala's family," he added.
On Tuesday, a Delhi Court granted the Delhi Police four more days of custody of Poonawala. The five-day custody granted earlier ended on Tuesday.
Poonawala is accused of killing his live-in partner and cut her body into 35 pieces before disposing it of.
The court on Tuesday extended his police custody.
The court noted that in the application seeking the extension of Poonawala's police remand, the investigating officer said some more body parts of the deceased including her jaws were recovered from a jungle on November 20.
The IO also requested for the extension of his police custody on the ground that more body parts or bones and weapons can be recovered on the basis of the disclosures made by the accused, the court said.

It is further submitted that a rough site plan has been found at the house of the accused which may assist in the search and custodial interrogation, the court said, adding the accused will also be required to connect the chain of events in the crime.
Separately, another court of Vijayshree Rathore allowed the police application for conducting a polygraph test on Poonawala.

A court on Tuesday gave Delhi Police permission to conduct a polygraph test on Aaftab Amin Poonawala. who allegedly killed and dismembered the body of his live-in partner Shraddha Walkar, police sources said on Tuesday.
Delhi Police had moved it application in court on Monday.
"Yes. We have received permission from the Delhi Court to conduct a polygraph test on Poonawala," a police official told PTI.
A polygraph test is a non-invasive technique in which no medicine is used. The subject is attached to a machine and questions are asked to him/her about the matter related to any case or incident. The variation in the graph when the subject answers the questions are mapped to draw a conclusion.
&nbsp;According to the American Psychological Association (APA), polygraph tests measure a person's "heart rate/blood pressure, respiration, and skin conductivity". The purpose of the test is usually to prove whether or not a person committed a crime.

Terming it a 'publicity interest litigation', the Delhi High Court on Tuesday dismissed with costs a PIL seeking directions for the Shraddha Walkar murder investigation to be transferred from Delhi Police to the Central Bureau of Investigation (CBI).
The court, however, did not specify the cost amount.
A bench of Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad said it was a publicity interest litigation and not a single ground was made out.
The plea alleged that the presence of media and public in places of recoveries amounts to interference with evidence.
It alleged that Delhi Police had revealed every detail to the media and public persons regarding each step of its investigation and this is not permitted under the law.
Aaftab Amin Poonawala, 28, allegedly strangled Shraddha Walkar and sawed her body into 35 pieces which he kept in a fridge for almost three weeks at his home in south Delhi's Mehrauli locality. He then dumped the body parts across the city over several days in the dead of the night.
Police has said the couple frequently argued over financial issues. It is suspected a fight between them resulted in Poonawala killing 27-year-old Walkar on the evening of May 18.

Earlier on Friday, Delhi police, which is probing the spine-chilling murder case sent teams to Maharasthra Haryana and Himachal Pradesh to hunt for evidence in the Shraddha Walkar murder case with sleuths recovering some body parts in Gurugram.&nbsp;
Additionally, Shraddha's father and brother's blood samples were collected by the police for DNA matching with the skeletal remains recovered till now. The cops have also summoned several of Shraddha's friends and recorded their statement in the case.&nbsp;
Meanwhile, a Delhi court has directed the investigating team to complete the narco analysis test of Aaftab Amin Poonawala within five days.

Here's a look at the cases in the past which horrified India.
The first case is of Shakereh Namazi. On 28 May 1991, Namazi was killed by her husband. She was buried alive in the backyard of her Bengaluru house. Namazi was the granddaughter of the former Dewan of Mysore. Her husband, Murli Manohar Misra aka Swami Shraddhanand, was found guilty. Misra, who was Namazi's second husband, had added sedatives to her tea, and then put an unconscious Namazi into a coffin, before burying her in the backyard.

Misra was accused of killing Namazi to gain possession of her wealth. Namazi's body was exhumed in 1994 and it was reportedly the first case in India of DNA testing to identify the victim. Misra eventually confessed and was handed a death sentence. This was later reduced to life in jail without remission.
The next case became known across the country as the 'tandoor' murder scandal.
On 2 July 1995, Naina Sahni was killed by her husband Sushil Sharma. Sushil, a Congress politician, had suspected Naina of having an extramarital affair. Sushil shot Naina twice in a drunken rage at their Delhi home. He first thought of dumping her body in the Yamuna river, but dropped the plan after seeing many cars on the bridge. Sushil then went to Baigya, a restaurant managed by his friend Keshav. The two then ttried to burn Naina's chopped body in a tandoor, or clay oven.

Subsequently, Sushil went on the run, but was arrested within a week. The first autopsy of Naina's body said that the death had occurred due to burns. But the second autopsy revealed bullet wounds. Sushil then confessed and was sentenced to death. This was later changed to life imprisonment. His accomplice Keshav Sharma was sentenced to 7 years in jail. In 2018, the Delhi High Court ordered Sushil's release as he had served his sentence.
A decade later, a serial killer duo shocked the national capital region.
In Dec 2006, Noida police found skeletal remains in a drain in the city's Nithari area. Subsequently, they arrested the owner of the house near the drain, and his domestic help. Skulls and bones of 16 persons, mostly children, were recovered from the site. Businessman Moninder Singh Pandher and his help Surinder Koli were accused of rape, murder of multiple people. The duo killed several girls, chopped their bodies, and threw them out. Pandher was sentenced to death in at least 3 cases, while Koli got the death sentence in more than 10 cases.
Two years later, India's financial capital was stunned by a high-profile murder.
On 7 May 2008, Neeraj Grover, a senior executive at a TV production company, was stabbed to death. Former Navy officer, Emile Jerome Mathew, was accused of murder. The death occurred at the home of Mathew's wife Maria Susairaj, a Kannada actor. Mathew had suspected his wife of having an extra-marital affair. He had flown to Mumbai after hearing a man's voice on phone while talking to Maria.
Mathew was accused of killing Neeraj in jealousy and anger. Mathew and Maria then allegedly chopped Neeraj's body, and stuffed it in bags. The couple then allegedly drove to a forest, poured petrol on the body, and burned it. Mathew was sentenced to 10 years of rigorous imprisonment in 2011. Maria Susairaj was sentenced to 3 years in jail for destroying evidence.
A few years, it was Bengaluru's turn to be stunned by a cold-blooded crime.
In July 2015, MG Gokul, a techie, allegedly beat his wife to death. Gokul was accused of hatching an elaborate plan to marry his college friend. The alleged plan involved murder and a terror attack hoax. In July 2015, Gokul allegedly got his wife Anuradha drunk, and then used a Ganesh idol to club her to death. Gokul said that a drunk Anuradha had died by hitting her head on a table.
The case was initially closed, but reopened after a series terror hoax calls a few weeks later. Gokul had also procured SIM cards in the name of his college friend's husband. In Sept 2015, Gokul allegedly called airports with bomb threats. He allegedly tried to frame his friend's husband, and portray him as an ISIS agent. Gokul wanted the husband arrested so he could get romantically involved with his friend. The investigators traced the threat calls to Gokul and claimed to have uncovered the entire plot.
The latest case which has gripped the nation's attention took place in Delhi a few months ago, but the facts have begun emerging now.
In May this year, Shraddha Walkar was allegedly killed by her live-in partner. Aaftab Amin Poonawala has been accused of strangling Shraddha to death. But he apparently didn't stop there. Aaftab allegedly chopped Shraddha's body into 35 pieces, and then stored them in a refrigerator.
Aaftab allegedly kept the body parts at his Mehrauli house for 3 weeks. He went out past midnight over several days to dump the body parts, according to police. Disturbingly, Aaftab allegedly invited other women to his home while he had Shraddha's body parts there. Aaftab was recently arrested, and is being questioned by police to piece together the entire story.

Dr Anil Kumar recalled Poonawalla was very aggressive and restless when he had come to him for treatment and when he asked him about his injury, he claimed he got hurt while cutting fruit.

A doctor who treated Aaftab Amin Poonawalla, accused of murdering his live-in partner, chopping the body into pieces and dumping them in a forest area, said the accused had visited him in May, the same month when the woman was killed, for treating a wound.
Dr Anil Kumar recalled Poonawalla was very aggressive and restless when he had come to him for treatment and when he asked him about his injury, he claimed he got hurt while cutting fruit.
"In May, he came in the morning hours. My assistant told me that one person has come with an injury. When I saw him, I found it was not a deep injury but a superficial one.
"The underline structure was intact. When I asked him how he sustained this injury, he replied it was while he was cutting fruit. I did not have any doubt as it was a small clean knife cut," said Kumar.
He said 28-year-old Poonawalla was a very bold and confident person when he met him for the first time during the treatment.
"Two days ago, police brought him to my hospital and asked whether I treated this guy. I recognised him and said yes.
"He was very aggressive and restless when he came for the treatment. He looked in to my eyes while speaking. He was very bold and confident. He was speaking in English and told me he was from Mumbai and came to Delhi as the city has good opportunities in the IT sector," Kumar said.

"When police informed me about the incident, I was shocked and never thought that this person had done something like this.
"My wife is also from Matunga in Mumbai and I told her that today I met a patient who was from Mumbai and came here for a good job. I did not doubt that he might have killed somebody. He got the stitches comfortably and did not show that he was having pain. He paid through online mode for the treatment," the doctor, who treated Poonawala at Apex Hospital here, said.

Delhi-Mehrauli Murder Case : Bharatiya Janata Party MLA Ram Kadam on Tuesday said he will write a letter to the Delhi Police to seek a probe into the possible &ldquo;Love Jihad&rdquo; angle behind the murder of Shraddha Walkar, a resident of Vasai near Mumbai.
"Love jihad" is a term used by right-wing groups and activists to allege a concerted effort by Muslim men to convert Hindu women to Islam through marriage.
Mumbai MLA Kadam and his supporters gathered in Ghatkopar area here on Tuesday and raised slogans against Walkar's live-in partner Aaftab Amin Poonawala, who is accused of killing her and has been arrested by the Delhi Police.
They had also brought an effigy of Poonawala to mark their protest.
The Delhi Police on Tuesday took Poonawala to the jungle areas of south Delhi's Chhatarpur area where he had allegedly dumped Walkar's body parts after killing her in May this year.
Poonawala had told the police during investigation that he killed Walkar after a quarrel over marriage and the idea of chopping her body into 35 pieces was inspired by "Dexter", an American crime TV series.

Speaking to reporters here, MLA Kadam said, &ldquo;I will write a letter to the Delhi Police requesting them to conduct a probe into the possibility of 'Love Jihad' behind the killing of Shraddha by Aaftab Poonawala. Are there any groups or gangs behind such an incident? Is an enemy state involved in it? It should be probed.&rdquo; Walkar's murder should not be seen as a standalone case, he said, adding that similar incidents have taken place earlier.
Kadam also extended his support to the deceased woman's family.
According to the Delhi Police, Poonawala had bought a fridge to preserve the body parts and used to step out past midnight to dispose them of.
The accused had meticulously planned which ones to dispose of first depending upon which part starts decomposing at the earliest, they said.
According to police officials, 13 body parts were found after the accused pinpointed the areas in Delhi where he had thrown them, but only after their forensic examination, it can be confirmed if they belong to the victim.
The police are yet to find the murder weapon.
