In a big blow to builder Supertech, Supreme Court on Tuesday ordered the demolition of twin 40-storey towers in the Emerald Court project in Noida for violation of building norms.
A bench headed by Justice DY Chandrachud pronounced the verdict stating that there was collusion between NOIDA officers and the builders in facilitating the construction.
"The record of the case is replete with instances which shows collusion of Noida authority with the builder. Collusion is writ large in the case," Justice Chandrachud mentioned, stating that "illegal construction has to be dealt with strictly."
The apex court has asked that the work of demolition should be carried out by the Supertech within a period of three months at its own cost. Keeping the interest of consumers in mind the verdict has also directed the real estate company to reimburse all flat owners along with 12% interest.
The apex court pointed out, "the protection of environment and well-being of the people who occupy this has to be balanced with the need of increasing demand for urban housing."
The two towers have 857 apartments in total. Of those, about 600 flats were sold.
Supertech launched the Emerald Court in 2006 in Noida Sector 93A.
In 2012, the RWA moved court saying that Supertech flouted the building safety norms and distance criteria, while constructing the twin towers by encroaching upon the garden area and thereby blocking the views, air and sunshine of residents.

Allahabad HC had in April, 2014, ordered the demolition of the twin tower complex in Noida while directing Supertech to refund money to homebuyers with 14% interest in three months.
Supertech moved Supreme Court saying it had approvals from the Noida Authority.
In July, the Supreme Court had ordered an inspection into the Supertech twin towers that were ordered to be demolished by the Allahabad high court for violation of norms.
