The Supreme Court Tuesday stayed a Allahabad High Court order that held that apprehension of death due to the Covid-19 pandemic is a valid ground for anticipatory bail
The top court said that courts shall not consider the directions issued by the HC on May 10 for grant of anticipatory bail to accused. Anticipatory bail must be based on the merits of each individual case, the top court stressed.
The Uttar Pradesh government had challenging an Allahabad High Court order that said anticipatory bail could be granted on grounds of apprehension of death in view of the surge in Covid cases and overcrowding in jails.
