In the porn racket case, in which businessman and the husband of Bollywood actress Shilpa Shetty, Raj Kundra has been arrested, his lawyer argued in court that ‘vulgar content’ can't be classified as pornography.
He also objected to the application of Section 67A of the Information Technology Act on sending obscene content in electronic form, along with other sections, with respect to pornography. He said, these laws consider 'actual intercourse' as porn and the rest everything is termed 'vulgar content'.
The lawyer concluded saying that Kundra's arrest wasn't made as per law, adding that the arrest should be made only, when the investigation cannot go ahead without it. Raj Kundra has sought anticipatory bail in the case.
