Compensation guidelines for Covid-19 deaths: how to apply

The Supreme Court has approved the scheme of granting Rs 50,000 compensation to the kin of those who died of Covid-19 in India.  

The apex court on Monday ordered that the money is to be disbursed within 30 days of applying and said that the payment will be made from State Disaster Relief Funds.  

The families of the deceased will have to submit their claims through a form issued by the state authorities along with specified documents, including a death certificate.

The court has added that all deaths occurring within 30 days of testing or from the date of being clinically determined as a Covid-19 case, will be treated as deaths due to coronavirus infection, even if the death took place outside the hospital.

Also, the apex court has mentioned that states can’t deny compensation on the sole ground that the death certificate does not mention Covid-19 as the cause of death.  

The top court noted that on the production of essential documents like RTPCR test, the concerned authorities can modify death certificates.  

These committees in charge can examine the medical records of the deceased and take a call within 30 days and order the compensation.

It further added if any family member has grievances regarding the death certificate already issued, he or she can move the grievance redressal committee to be constituted by states 

The district disaster management authorities will ensure that the process of claim, verification, sanction, and disbursal is simple, robust, and people-friendly.  

The court also asked the concerned authorities to publish the name of the beneficiaries in the print media.
