Same sex marriages not in tune with Indian values: Centre tells Delhi High Court

Deeming the idea of same-sex marriages contrary to the idea of family in Indian culture and ethos, the Centre on Thursday opposed petitions seeking legal recognition of same-sex marriages.

The Centre told the Delhi High Court that even though homosexuality is decriminalised under Section 377, there is no fundamental right for same-sex marriage for being recognised under the laws of the country.

The Centre added that living together as same-sex partners and having a sexual relationship, is not the same as the Indian family unit concept of a husband, wife and children, which presupposes a biological man as ‘husband’, a biological woman as ‘wife’ and children born out of the union.

Seeking dismissal of the plea, the government said that marriage in India is a sacrament, has a sanctity attached to it and is governed by uncodified personal laws or codified statutory laws, adding that recognition of marriage is a subject to be decided by law, and not by adjudication.
