Consensual sex in prolonged live-in not rape: Supreme Court

The Supreme Court on Monday ruled that consensual sex during a prolonged live-in cannot be called rape if the man doesn't keep his promise of marriage. A bench of Chief Justice S A Bobde and Justices A S Bopanna and V Ramasubramanian said that 'making a false promise to marry is wrong' and even a woman shouldn't make such false promises but that 'does not mean that in a prolonged live-in consensual intercourse would be categorised as rape'.

The court was hearing a case related to a couple who were living together for 5 years but the man eventually married someone else. The woman then filed a rape case against him accusing him of having sex with her under the pretext of marriage.
