Supreme Court seeks report on allegations against Ashish Mishra in Lakhimpur Kheri case

The Supreme Court on Monday directed the Uttar Pradesh Police to submit a report on allegations that Ashish Mishra, son of Union minister Ajay Mishra, is influencing witnesses in the 2021 Lakhimpur Kheri violence case. The directive was issued by a bench of Justices Surya Kant and N Kotiswar Singh, asking the Lakhimpur Kheri superintendent of police to conduct a fact-finding inquiry and file the report.

Ashish Mishra has denied the allegations in an affidavit, claiming that such claims are routinely made whenever the matter is listed in court to seek the cancellation of his bail. Mishra was granted bail by the Supreme Court on July 22, 2022, with restrictions on his movement to Delhi or Lucknow.

Advocate Prashant Bhushan, representing the complainants, alleged that Mishra attempted to influence witnesses and violated his bail conditions by attending a public meeting. Bhushan claimed to possess an audio recording as evidence and urged the court to verify its authenticity.

Senior advocate Siddharth Dave, representing Mishra, refuted the allegations, stating his client was being unfairly targeted and was present at the Lok Sabha Secretariat in Delhi on the day of the alleged meeting.

The bench directed both Bhushan and Dave to submit their evidence to Ruchira Goel, the standing counsel for the Uttar Pradesh government, to be forwarded to the Lakhimpur Kheri SP. The matter is scheduled for further hearing in four weeks.

The case stems from the October 3, 2021 violence in Tikunia, Lakhimpur Kheri, where eight people, including four farmers, were killed during a protest against Deputy Chief Minister Keshav Prasad Maurya's visit. The violence involved a vehicle mowing down farmers, the lynching of a driver and BJP workers, and the death of a journalist.
