The family of the deceased has refused to collect the body from the hospital, and the live-in partner is not considered legal heir as per law.

Queer man moves High Court to claim live-in-partner's body

After the family of a queer man refused to collect their body from the hospital, the deceased's live-in-partner from Kerala's Kochi approached the High Court to seek permission for receiving the mortal remains.

According to an India Today report, on February 2, Manu, who was living with their partner Jebin fell from the terrace of their home in Kochi. He was admitted to the hospital in critical condition.

Manu was on ventilator support for two days, but on the night of February 4, they passed away. After the demise, their family refused to cover the medical expenses and claim their body. Manu's partner Jebin, too, couldn't claim the mortal remains, as the law does not recognise them as a legal heir.

Jebin filed a petition with the High Court seeking permission to claim Manu's body. The High Court has reviewed the petition and issued a notice to the private hospital.

The High Court also requested an explanation from the government regarding the protocol for unclaimed bodies. According to the protocol, when biological family members or legal heirs fail to claim a body, it gets transferred to a government medical college for medical research.

The Ernakulam HC is scheduled to hear this case on Thursday afternoon and has also asked a family member of the deceased to appear before it on the day of the hearing.
