Amid the political tussle in Maharashtra, the Eknath Shinde rebel camp has approached the Supreme Court challenging the disqualification notices issued to 16 of them by the Deputy Speaker of the Maharashtra Assembly.

A no-confidence motion against Deputy Speaker Narwari Zirhal that was rejected has also been challenged by the Shinde camp in the Supreme Court. Further, the camp has urged the SC to order the Deputy Speaker to not take any action over their disqualification till his removal is decided.

The Shinde camp has also challegend the appointment of Ajay Choudhuri as the legislative party leader in the Assembly. Eknath Shinde was the Shiv Sena legislative party leader till he rebelled and was consequently removed from the post by the party.

Devdutt Kamat, the legal advisor-cum-counsel for Shiv Sena, said, 'The Deputy Speaker of the Maharashtra Assembly has full powers to adjudicate in the absence of the Speaker- the post is lying vacant.'

A day earlier, the Maharashtra legislature secretariat had issued 'summons' to 16 rebel Shiv Sena MLAs, including senior minister Eknath Shinde, seeking written replies by the evening of June 27 to the complaints seeking their disqualification.

Claiming that the disqualification notices were illegal unless done for matters pertaining to the Assembly, the camp said that they were not valid for not attending a party meeting.

Kamat said that disqualification proceedings have been initiated against 16 rebel MLAs as per para 2.1.A of the 10th schedule of the Constitution.

'Several verdicts of the Supreme Court had shown that actions of legislators outside the House amount to the anti-party activity and they are liable to be disqualified. They haven't responded to the party directives to attend meetings convened,' he said. When asked about the options available for the dissident group of MLAs, Kamat said disqualification applies to them until they merge with another political outfit.

The rebels, however, have denied merging with any other party, including the BJP.

The Shinde camp plea further alleges that in 2019 when Shinde was appointed the legislative party leader, all 55 MLAs of Shiv Sena were present. However, for his removal, not even 35 percent MLAs were in the Assembly so it stands invalid, the plea stated.

The Shiv Sena national executive on Saturday authorised Uddhav Thackeray to take action against the rebel MLAs. Other than that sources close to the party claim that portfolios of Eknath Shinde, Gulabrao Patil and Dada Bhuse will be taken from them. On Sunday, Uday Samant, the higher and technical education minister also joined the rebel faction in Guwahati becoming the ninth minister of the MVA government to do so.
