AIMPLB moves SC against plea seeking ban on polygamy, nikah halala

Jan 27, 2020 14:47 IST

The All India Muslim Personal Law Board has moved the Supreme Court against a plea seeking a ban on polygamy and nikah halala, saying that people of another faith should not be allowed to question religious practices of Muslims. Speaking on the Uniform Civil Code, the muslim law board said, that Article 44 of the Constitution, which talked about having a common law for the entire country, was 'only a directive principle of state policy and is not enforceable'. The plea in the top court was filed by advocate and BJP member Ashwini Upadhyay, claiming practices like polygamy and nikah hala violate a Muslim woman's right to live with dignity. The Muslim law board countered saying these practices are beyond the purview of judicial review.
