We provide advertisers with reports about the kinds of people seeing their ads and how their ads are performing, but we don't share information that personally identifies you (information such as your name or email address that by itself can be used to contact you or identifies who you are) unless you give us permission. For example, we provide general demographic and interest information to advertisers (for example, that an ad was seen by a woman between the ages of 25 and 34 who lives in Mumbai and likes software engineering) to help them better understand their audience. We also confirm which Editorji ads led you to make a purchase or take an action with an advertiser.

iii)        Measurement partners

We share information about you with companies that aggregate it to provide analytics and measurement reports to our partners.

  1. iv) Partners offering goods and exclusive content through our Services

When you subscribe to receive premium content, or buy something from a seller in our Services, the content creator or seller can receive your public information and other information that you share with them, as well as the information needed to complete the transaction, including shipping and contact details.

We provide information and content to vendors and service providers who support our business, such as by providing technical infrastructure services, analysing how our Services are used, providing customer service, facilitating payments or conducting surveys.

We reveal only the last four digits of your credit card numbers when confirming an order or any paid services. Of course, we transmit the entire credit card number to the appropriate credit card company during order processing.

If you live in the domicile of India or otherwise outside the territory of India, the Editorji User Agreement comprises these Terms of Service , our Privacy Policy , the Editorji Rules and all incorporated policies.

TERMS OF SERVICE

 

This Terms of Service (“Terms”, sets forth the terms and conditions that apply to the use of this site (https://www.Editorji.com/ and www.Editorji.com) and all sub sites, SMS, APIs, email notifications, applications, buttons, widgets, ads, commerce services, and our other covered services that reside under the site (collectively "Editorji Sites"), …………….(to be inserted Editorji weblink ), and any information, text, links, graphics, photos, audio, videos, or other materials or arrangements of materials uploaded, downloaded or appearing on the Services (collectively referred to as “Content”) by a Subscriber or a Third Party Content Provider. We do not endorse, support, represent or guarantee the completeness, truthfulness, accuracy, or reliability of any Content or communications posted via the Services or endorse any opinions expressed via the Services.

You understand that by using the Services, you shall not upload or share any such Content that might be offensive, harmful, inaccurate or otherwise inappropriate, or in some cases, postings that have been mislabeled or are otherwise deceptive. All Content is the sole responsibility of the person who originated such Content/ or the one who shares.

We want people to use Services to express themselves and to share content that is important to them, but not at the expense of the safety and well-being of others or the integrity of the society at large.

  Permission without compensation : You agree that this license includes the right for Editorji to provide, promote, and improve the Services and to make Content submitted to or through the Services available to other companies, organizations or individuals for the syndication, broadcast, distribution, promotion or publication of such Content on other media and services, subject to our terms and conditions for such Content use. Such additional uses by Editorji or other companies, organizations or individuals, may be made with no compensation paid to you with respect to the Content that you submit, post, transmit or otherwise make available through the Services.

For example, you give us permission to use your name and profile picture and information about actions that you have taken on Editorji next to or in connection with ads, offers and other sponsored content that we display across our Services, without any compensation to you.

Permission to update software:  If you download or use our software, you give us permission to download and install upgrades, updates and additional features to improve, enhance and further develop it. We engage in research and collaborate with others to improve our Services. We do this is by analysing the data we have and understanding how people use them.

We use and develop advanced technologies such as artificial intelligence, machine learning systems and augmented reality so that people can use our Services safely regardless of physical ability  or geographic location. For example, technology like this helps a person who have visual impairments understand what or who is in photos or videos shared on our platform.

We also build sophisticated network and communication technology to help more people connect to the Internet in areas with limited access. And we develop automated systems to improve our ability to detect and remove abusive and dangerous activity that may harm our society and the integrity of our Services.

ACCESS TO SERVICES

Please review the Editorji Rules which are part of the User Agreement and provides an outline as to what is prohibited on the Services. You may use the Services only in compliance with these Terms and all applicable laws, rules and regulations.

 

Our Services may change from time to time, at our discretion. We may stop (permanently or temporarily) providing the Services or any features within the Services to you or to users generally. We also retain the right to create limits on use and storage at our sole discretion at any time. We may also remove or refuse to distribute any Content on the Services, suspend or terminate users.

 

In consideration for Editorji granting you access to and use of the Services, you agree that Editorji and its third-party providers and partners may place advertising on the Services or in connection with the display of Content or information from the Services whether submitted by you or others. You also agree not to misuse our Services, for example, by interfering with them or accessing them using a method other than the interface and the instructions that we provide. You may not do any of the following while accessing or using the Services:

 

We can remove content that you share in breach of these provisions and, if applicable, we may take action against you. We may also disable your account if you repeatedly infringe other people's intellectual property rights.

YOUR ACCOUNT

You will require creating an account to use our Services. You are responsible for safeguarding your account, so use a strong password and limit its use to this account. We cannot and will not be liable for any loss or damage arising from your failure to comply with the above.

These communications are considered part of the Services and your account, and you may not be able to opt-out from receiving them. TERMINATION

We want Editorji to be a place where people feel welcome and safe to express themselves and share their thoughts and ideas. 

You may end your legal agreement with Editorji at any time by deactivating your accounts and discontinuing your use of the Services. If you delete or we disable your account, these Terms shall terminate as an agreement between you and us.

If we determine that you have violated our terms or policies, we may take action against your account to protect our community and services, including by suspending access to your account or disabling it. We may also suspend or disable your account if you create risk or legal exposure for us or when we are permitted or required to do so by law. Where appropriate, we will notify you about your account the next time you try to access it.

 

 

DISCLAIMERS AND LIMITATIONS OF LIABILITY

Your access to and use of the Services or any Content are at your own risk. You understand and agree that the Services are provided to you on an “AS IS” and “AS AVAILABLE” basis. The “Editorji Entities” refers to Editorji, its parents, affiliates, related companies, officers, directors, employees, agents, representatives, partners, and licensors. Without limiting the foregoing, to the maximum extent permitted under applicable law, THE Editorji ENTITIES DISCLAIM ALL WARRANTIES AND CONDITIONS, WHETHER EXPRESS OR IMPLIED, OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

 

The Editorji Entities make no warranty or representation and disclaim all responsibility and liability for:

T O THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE EDITORJI ENTITIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

 

I N NO EVENT SHALL THE AGGREGATE LIABILITY OF THE EDITORJI ENTITIES EXCEED THE GREATER OF (EDITOR JI TO DECIDE THE CAPPING OF THE LIABILITY FOR THE DAMAGES CAUSED IN TERMS OF FINACIAL COMPENSATION IN TERMS OF INR) OR THE AMOUNT YOU PAID EDITORJI, IF ANY, IN THE PAST SIX MONTHS FOR THE SERVICES GIVING RISE TO THE CLAIM. THE LIMITATIONS OF THIS SUB-SECTION SHALL APPLY TO ANY THEORY OF LIABILITY, WHETHER BASED ON WARRANTY, CONTRACT, STATUTE, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, AND WHETHER OR NOT THE EDITORJI ENTITIES HAVE BEEN INFORMED OF THE POSSIBILITY OF ANY SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

DISPUTES

We try to provide clear rules so that we can limit or hopefully avoid disputes between you and us. If a dispute does arise, however, it is useful to know up front where it can be resolved and what laws will apply. In all the cases, you agree that the claim must be resolved exclusively in the  Courts of New Delhi under whose jurisdiction Head Quarter of Editorji Technologies Pvt. Ltd. falls. That, you submit to the personal jurisdiction of  these courts for the purpose of litigating any such claim, and that the laws of the Government of India will govern these Terms and any claim, without regard to conflict of the legal provisions.
