Article 370: Justice Kaul on human rights violation in J&K

SC's verdict on Article 370

The Supreme Court on Monday upheld the constitutional validity of the abrogation of Article 370 in 2019 that ended the special status of J&K.

"Insurgencies led to migration of one part of the population. The nation faced dangers, there is intergenerational trauma, the state needs healing."

Justice Kaul said, "1st step towards healing the wounds is acknowledgement of the acts of violations done by the state"

Human rights panel

Justice Kaul recommended setting up of an impartial Truth and Reconciliation committee to investigate and report on the violations of human rights.

Govt to set up panel

"It is for the government to decide how the Truth and Reconciliation Commission must be set up, considering sensitivities of issues involved."

The Commission must not turn into a criminal court and must be offering a platform for dialogue, said Justice Kaul.
