The Union government has reportedly told the Supreme Court that petitions seeking validation of same-sex marriage reflect an "urban elitist view for the purpose of social acceptance".

The government on 16 April 2023 said to the top court that the judiciary cannot rewrite an entire branch of law by recognising same-sex marriages.

The Modi administration added that creating a new "social institution" is beyond the judiciary's scope.

The government said that it is a facet of legislative policy.
