Plea in Supreme Court against automatic disqualification of convicted netas

A day after Rahul Gandhi was disqualified as a Lok Sabha MP, a public interest litigation has been filed in the Supreme Court challenging the law under which the action against him was taken. 

The Representation of the People Act states that any elected representative is immediately disqualified if they are sentenced to prison for two or more years. 

The plea questioned the constitutional validity of this law and called it arbitrary. 

It stated that the law is being blatantly misused for wreaking personal vengeance on political opposition. The plea added that the rule does not take the nature and gravity of the offences into consideration providing for blanket disqualification.
